Frazee Trial: Krystal Lee Kenney returns to the stand on day 5
The beginning of the fifth day of testimony in the trial against Patrick Frazee was delayed Thursday morning, due to Frazee and Krystal Lee Kenney feeling sick.

Back on the stand Thursday, Kenney said she traveled to Colorado on December 20, 2018 to be interviewed by investigators and to provide a full statement to the District Attorney’s Office.

She said it wasn’t easy to tell the truth.

On Thursday, Kenney added Frazee had also told her his young daughter was nearby, in a baby walker, when it happened.

Prosecutors showed jurors pictures of the interior of Berreth’s home and asked Kenny to point out where she had seen blood. Kenney also pointed out where she found some cleaning supplies.

Kenney told the court she saw bloody footprints leading up to the bathroom and the back room. As prosecutors went through pictures of evidence from Berreth’s home, she answered whether she wiped down items and with what specific cleaning product.

Kenney began to cry when prosecutors showed a picture of Berreth’s daughter, standing in front of items that Kenney said she found at the house, covered in blood, and had to throw away.

At this, Berreth’s father began to sob.

Frazee didn’t show any visible sign of emotion as the pictures were shown.

Jurors also watched a video showing Kenney talking to law enforcement at Frazee’s property on December 21, 2018, the day he was arrested.

In the video, Kenney showed investigators where she and Frazee had parked their vehicles and where she said Berreth’s body was burned.

As the video played out, Kenney looked away.

Frazee paid close attention to the screen.

A second video showed to jurors Thursday showed Kenney explaining to officers the contents of a garbage bag that was also burned on Frazee’s property in Florissant. Kenney added she’d thrown Berreth’s bible in the bag as well.

Kenney also claimed Shelia Frazee, Patrick’s mother, saw her and saw the fire burning. Shelia is expected to testify.

Kenney said there were also teenagers working around the property at the time of the fire.

Prosecutors asked if she’s looked at the tote when it was burning. Kenney said, “it was a burning heap and it started to melt.” She said she left while the fire was still burning.

Kenney said Frazee told her the fire burned well into the morning, but that it left remnant that needed to be taken to the dump. She testified that Frazee told her he was getting help from two boys. She said the boys didn’t know what they were helping with.

When the prosecutor asked why she didn’t tell anyone about what happened the weekend of Thanksgiving 2018 Kenney replied, “I didn’t want anyone else involved. I knew that I was in a lot of trouble and I didn’t want anyone else in trouble.”

The prosecutor also asked if she wanted Frazee to get caught.

She responded, “yes”.

After answering a list of questions from the jury, Kenney was excused for the day.

The defense attorney, Adam Stiegerwald, started his cross examination of Krystal Lee Kenney by listing the more serious crimes prosecutors could have charged her with — attempted first-degree murder or accessory to a crime — for her role in Frazee’s alleged murder of his fiancée, Kelsey Berreth. ...

The defense’s questioning ended the more than nine hours of testimony Kenney gave over two days. Kenney detailed her complicated relationship with Frazee and explained how she cleaned the Woodland Park condo where she said Frazee bludgeoned Berreth to death. Kenney ended her testimony Thursday afternoon, but could be brought back later if needed.

Kenney became emotional multiple times over the two-day course of her testimony, including Thursday when prosecutors projected a large photo of Kaylee, the young daughter of Berreth and Frazee. She choked back tears as she explained that Frazee told her the 1-year-old girl was in the condo while Frazee murdered Berreth.

One of Berreth’s family members leaned forward and sobbed as he looked at the photo of the happy child with chubby cheeks, grinning at the courtroom from the photo.

Kenney explained that there was a pool of dried blood on the floor and blood spatters high on the walls in the living room. She used a laser pointer to show where she saw the blood and how she used bleach and Windex to clean the evidence, a process that took four hours, Kenney said.

Kenney testified that she entered and left Berreth’s condo from the main door. ...

Although Thursday’s hearing was scheduled to begin at 8:45 a.m., it did not begin until after 10:30 a.m. because both Frazee and Kenney felt sick in the morning, Teller County District Court Judge Scott Sells explained when court convened.

Court was interrupted about 11:30 a.m., when deputies caught a man in the audience drawing pictures of witnesses in the case. Court deputies ripped multiple sketches from the man’s notebook. ...

Why Krystal Lee didn’t call law enforcement, waited to tell the truth about Kelsey Berreth

Those two ranch hands testified after Lee. One of them, KR, said he helped Frazee move on a rusted-out horse trough on his property the weekend of Thanksgiving, clean up ashes, and then cover a burned area with dirt.

Prosecutors showed a photo that depicted a part of the ground at the Frazee ranch that appeared to have burn marks.

During cross-examination, KR conceded that Frazee burned trash on the property all the time, and he didn’t find anything odd about this particular instance.

Lee testified that Sheila Frazee — Patrick Frazee’s mother — had been on the property’s patio during the fire. The two ranch hands said the patio was visible from where they had moved the trough.

Frazee trial: Defense asks why Kenney didn't alert authorities

She told the court she believes she was at Frazee’s ranch for about three or four hours after cleaning before she went back to Berreth’s townhome to send the text from Berreth’s phone to her mother. She reiterated the timeline of events she discussed Wednesday about how she and Frazee then went to a Florissant gas station and then drove to Nash Ranch to get the black tote that contained the bat allegedly used to kill Berreth and possibly her body.

In the video, Slater asked Kenney to describe the black tote, which she did, including details about the clasps and hinged lid. When asked where Frazee allegedly burned it, she said it was in a round aluminum water trough without a bottom.

She pointed out where she had first parked when she got to Frazee’s ranch on Nov. 24, noting that she got out and talked with Frazee for 60 to 90 minutes. He told her he needed to do chores and tend to Kaylee.

In the video, Kenney told Slater that Frazee had given her Berreth’s phone before she drove to Woodland Park, then back to a Conoco in Florissant. She further described how she and Frazee drove between Nash Ranch, Woodland Park and the Frazee ranch.

She said she brought the trash bags from Berreth’s home, containing items that were bloodied, to add to the fire. There were two white garbage bags and four black ones, she said. Kenney said she was present when Frazee first started the fire. In the video, she was seen showing authorities where Frazee got the wood from.

At one point, Slater could be heard on the video saying that Kenney mentioned Sheila Frazee, Patrick Frazee’s mother, came outside to look at the fire from the deck.

Kenney said Frazee poured gasoline into a “mineral bucket” and tossed that on the fire as well. Frazee put the entire black tote into the fire, she said. She left after that, so she didn’t see it completely burn, she said.

Viehman then introduced a second video.

... She put it all in trash bags, she said. She had been wearing a white jump suit that day, she said, with a gray sweater underneath and a black pair of leggings. Kenney said she put her socks, underwear and bra, and hairnet and shoe covers into the trash bags as well.

She said the following items were also in the trash bags:
  • Two big stuffed animals (including a white horse)
  • Wooden building blocks
  • Books, including Berreth’s Bible or some other religious-looking book
  • Plastic cookie cutters

The state then brought in a black tote, which Kenney said looked exactly like the tote from Frazee’s property. The state also brought in a cardboard box. Inside, Kenney said, appeared to be the gas can seen in the video which Frazee allegedly used to light the fire.

Amid tears, Kenney said it’s the faded, red gas can she saw.

Patrick Frazee trial: Star witness stands ground under cross-examination, declaring, 'It's the truth'

“That’s the story that you had to tell those agents to get your plea deal, is that right?” asked Adam Steigerwald, a public defender.

“I had to tell them the truth,” Krystal Lee replied.

The attorney pointed out that the plea deal spared Lee from being charged with far more serious charges, including attempted murder and accessory to murder. Lee pleaded guilty in February to evidence tampering, and faces from three years in prison to just probation.

“So you were looking at essentially the rest of your life in prison, did you know that?” Steigerwald asked, his voice rising.

“I did not,” Lee replied quietly.

“Just in case it’s not, you brought a hairnet? You brought a box of rubber gloves? You brought shoe covers? You brought a full body suit? You brought bleach?” Steigerwald asked. “But you were hoping this was a trick?”

Each time, Lee replied, “Yes.”

For two days, Lee wept, dabbed her tears with tissues and occasionally sobbed as she recounted the killing and its cover-up.

Until Thursday afternoon, when prosecutor Jennifer Viehman asked Lee to point out the man who beat Berreth to death with a baseball bat.

Rising slightly, Lee turned right and pointed straight at Frazee. He stared back at her, sitting expressionless with his defense team in a blue striped button-up shirt and khakis.

Two teenagers later testified that they unwittingly helped cover up the burn area with dirt from near Frazee’s driveway, at Frazee’s request. They also said they helped dispose of the trough, and one of them helped load a trash can that apparently contained ashes from the fire.

Frazee never told them anything other than wood and deer or elk antlers were burned in the fire, the teens testified.

Lee said she left to drive back to Idaho while it was still burning.

Even as the onslaught of questions from Frazee’s attorney continued, Lee’s responses grew more confident — and at times, defiant.

Steigerwald asked: Is her story — her testimony over the last two days — going to keep her out of prison?

“It’s the truth,” Lee replied.

Defense points out Kenney never tried to warn Berreth or police
Kenney took investigators to a trailer on the property where she said there was a red gas can Frazee used to accelerate the fire and used one match to light it.

She said she left so she didn't see it after the burn.

While Frazee was starting the fire, Kenney said his mother Sheila Frazee came outside and looked at the fire from the deck. She said Sheila came a little ways to look.

Specifically, an Elizabeth Police Department officer testified his bloodhound detected the scent of human remains in February at the Nash ranch -- the spot where #PatrickFrazee is accused of stashing #KelseyBerreth's body before burning it, southwest of Cripple Creek.

Instead, that dog found a scent (which can include feces or bodily fluids) in the upstairs bathroom. The officer thought it was due to underwear on the floor, but said later it could "absolutely" have been blood later found on the toilet.

Frazee trial: K-9 handlers say dogs hit on items tied to murder

... But prosecutors started the day by having two K-9 handlers testify, both of whom said their dogs hit on items at different locations that were involved in the murder plot.

Court started at 8:30 a.m. Friday, with Judge Scott Sells reminding the court that it will not be in session Monday because of Veterans Day. Fourth Judicial District Attorney Dan May then picked up with questioning.

JN, who co-owns Nash Ranch, told May that she leased grazing rights to Frazee and that he had a lease for the area, including the barn, as well as a key to the ranch, in November 2018. Nash said nobody else was leasing the ranch at the time and that she knew Frazee kept items in the barn, including a tractor and hay.

May then called Elizabeth Police Department Office Mike Hurst, who also previously worked for the Teller County Sheriff’s Office and who specializes working with K-9s – including bloodhounds, tracker dogs and cadaver dogs.

[...]

... Hurst said he and Radar have spent more than 5,000 hours training and have been in the field to find bodies or scents 30-40 times. Radar has never had a false hit, Hurst testified.

[...]

He said Radar sat after he smelled the hay bales again near the bottom of them, which indicated a positive hit. Hurst said he saw stains on the top of the 12-foot hay bales, so he decided to get on top of them.

Prosecutors showed a picture of the top of the hale bale taken on Dec. 21, showing indented hay that was discolored – brown or possibly dark red – and which looked wet. Hurst said that spot is where Radar indicated again once he and Hurst were atop the hay bale. May showed a video of Radar sniffing around on the hay bales and sitting by the stained area of hay. Hurst said that even though the tote had been removed from the bale months earlier, he believed Radar could still smell something there because the barn had protected the hay from weather.

May then called Brian Eberle, who has a bloodhound named Lucy and who previously worked with Jefferson County, who was asked to come out with Lucy to Woodland Park on Dec. 4, 2018. ...

... Toyota, where she gave a positive indication of a decomposing human scent on the back corner of the driver’s side. Eberle said it was possible that there could still be a scent there if there were bloody items loaded into trash bags nearby.

He said it was also possible that Lucy could pick up scents like the one she hit on if the bags were left 10 days earlier. She, like Radar, had never given a false positive, Eberle said, and was in the 90-95 percentile for accuracy.

The judge asked Eberly questions from the jury about how the bleach could have affected Lucy’s scent-finding, to which he said that they hadn’t trained with bleach before because it would be harmful.

Prosecutor Beth Reed called the senior director of the security department for the health system for which Kenney worked in Idaho to have him testify about Kenney’s badge usage at the hospital on Nov. 21 and 23. He said on Nov. 21, her schedule and movements were fairly normal, and that he had no reason to believe somebody else was using her badge.

Reed then called Kenney’s father, Sidney Kenney, to the stand. She asked him about the events surrounding Nov. 22. He said the plan was for all the family to sit down for Thanksgiving dinner in the afternoon. He said he saw both Kenney and her ex-husband that day and was at their house until around 6:30 p.m. that day. ...

... He said he saw Kenney again the evening of Nov. 23 around 7 p.m. but that she never said anything about plans for the weekend. He said he then saw her again sometime late on Nov. 25 or on Nov. 26.

... Upon cross-examination, Sidney Kenney told Stiegerwald that it was not unusual for Kenney to go to Colorado to visit her mother.

Court went into recess just before 10 a.m. and was back at 10:15 a.m.

In court for day 6 the #PatrickFrazee murder trial and crowds have noticably thinned. Today, we heard cadaver dogs had positive hits outside Berreth's home & in a barn on Nash Ranch. It wasn't animal blood, the handler says, his dog knows the difference.

Update: Testimony for the rest of this morning focuses on surveillance camera footage from two locations -- a Sonic Drive-In in Woodland Park and a Conoco gas station in Florissant, showing the movements of #PatrickFrazee and his mistress the day of Nov. 24, 2018.

Camera footage from the Sonic Drive-In showed Krystal Lee, who has previously used the last name Kenney, getting an order of food around 1 p.m. on Nov. 24. That fits with earlier testimony that she got food after cleaning the "mess" at #KelseyBerreth's apartment.

Also: Footage was shown at the Conoco gas station in Florissant. It included video of #PatrickFrazee filling up a six-gallon, faded red gas can with gasoline. Prosecutors say he later used that gas to fuel the fire that he lit to burn #KelseyBerreth's body. @csgazette

Lee said she left the gas station with #PatrickFrazee & retrieved #KelseyBerreth's body from land Frazee leased near Cripple Creek, then burned Berreth's body at Frazee's ranch. Lee returned to the gas station after returning from ranch & before returning to Idado that night.

One thing to add onto from earlier today... the officers who testified earlier, who were in charge of bloodhounds, said that bleach and cleaning supplies could affect the dogs' ability to detect the scents of decomposing human remains. @csgazette #PatrickFrazee #KelseyBerreth

Prosecutors attempt to corroborate witness in Patrick Frazee trial

The prosecution’s key witness, Krystal Lee Kenney, testified for the two days prior about how she helped Frazee clean the crime scene and burn Berreth’s body, giving an exact timeline of how she drove from Idaho to Colorado and how she and Frazee moved about Teller County to hide evidence.

Testimony on Friday showed the breadth of the investigation into the Woodland Park mother’s disappearance and alleged murder by her fiancé. Prosecutors called in Kenney’s father as well as a Woodland Park Sonic Drive In manager who helped investigators find video of Kenney at the fast food restaurant, and the man who runs security at the Idaho hospital where Kenney worked. Some of the witnesses’ testimony lasted less than five minutes.

Many of the witnesses gave testimony that corroborated Kenney’s account.

Kenney’s father, Sidney Dustin Kenney, corroborated his daughter’s story that she was at her Idaho home on Thanksgiving Day – the day Frazee allegedly killed Berreth.

The hospital security manager said that Kenney was indeed in the hospital on Nov. 23 when she said she was there to change her on-call shift scheduled for the next day. Kenney said she had to change her shift so she could travel to Colorado.

Images from a gas station showed Kenney and Frazee’s vehicles moving in and out of the parking lot, consistent with what Kenney told investigators, a Colorado Bureau of Investigation agent testified. The footage also showed Frazee filling a large red gas can on Nov. 24...

On Dec. 4, two days after Berreth’s mother reported her missing, a cadaver dog swept Berreth’s condo. While the dog alerted to a pair of dirty underwear in the bathroom, it did not alert anywhere else in the house, which Kenney said had been covered in blood a week prior.

One of the teens – soft-spoken and scared — testified that Frazee asked him in the days after Thanksgiving to move dirt to the area of the fire and cover up a burn scar left on the ground. Kenney later led investigators to the spot, and law enforcement removed the new dirt, revealing a large burn mark.

We heard from Julie Nash this AM, of the Nash Ranch. That’s where prosecutors say Patrick Frazee stored Kelsey’s in a tote inside a barn before he later burned it. Nash says only a few people had access to the barn, including Patrick, who leased some of the land for cattle.

Prosecution brings in Frank Hurst, a K9 officer (Elizabeth PD) who specializes in handling cadaver dogs. He testifies that he and his dog, Radar – a 140lb of bloodhound – helped search a barn on the Nash Ranch for human decomposition in the Berreth case.

Throughout this case the judge has certified experts as they testify in a certain area. Today, he certified “Radar” as an expert in detecting human decomposition. Judge Sells says:
“This is the first time I’ve ever certified an animal as an expert before”

Hurst testifies that Radar indicated human decomposition scent on top of a haystack in a barn at Nash Ranch. We watch a video of them working, when Radar finds the spot. Prosecutors say this is where Frazee stored the tote with Kesley’s body inside.

We hear from another K9 officer, Brian Eberle. He and his dog Lucy searched #KelseyBerreth ’s home. He says Lucy found human decomp scent outside by one of Kelsey’s vehicles.

Eberle says the only place inside Kelsey’s house where the dog indicated human decomp was a pair of underwear, in a bathroom. Prosecution asks if a dirty pair of underwear could alert a dog too? (not necessarily covered in blood) Eberle testifies yes – that would alert a dog.

Eberle says Lucy did not pick up any other scent inside Kelsey’s home. Remember Krystal testified that she cleaned the house using bleach. K9 handlers say bleach can cover decomp smell and affect the dog’s ability to find it

Krystal Lee’s father also took the stand. Testified that he spent Thanksgiving 2018 with his daughter (at her home, hosting a lot of family). That was 11/22/18. Said he also saw Krystal the next evening, 11/23/18.

Krystal testified that on 11/24/18, after cleanup and Sonic, she met Patrick at his ranch where he told her about the murder, then she went back to Woodland Park to send a text from Kelsey’s phone, then she drove to the Florissant Conoco to meet Patrick again.
