She is missing.
He claims to have seen her on the day she was last on video and no one has claimed to see her afterward.
He has their child.
How is this not enough to get a search warrant?
The 1 thing I wonder is what explanation he has provided LE that we are not aware of. Does he have a reasonable explanation for why she left and he did not consider her missing? Could he show them his text history with her which shows some sign of ongoing relationship or mental health issues or dreams of running away from her troubles? Can someone else or some sort of evidence corroborate his story? They have to check it all out, until they can eliminate the other possibilities.

Berreth's mother called police for a welfare check on November 25, but she wasn't there.

Search intensifies for mom who vanished on Thanksgiving Day
The chief of police stated that Kelsey's mother contacted LE on December 2. LE then conducted a community caretaker search at Kelsey's home and did not find her in the residence.

You would think that someone willing to travel to Idaho to create a false ping would also be willing to move one of her cars and pack a suitcase so it looks like she left on her own.

We don't know that one of her cars wasn't moved back to her place at some point as a misdirect. I have seen that in a few cases (ZuZu Verk case for one). But it's hard to move a car and leave it somewhere without getting seen on camera and without leaving evidence you were in the car. And then there is the problem of having an infant to care for while you move cars. I wonder how many car seats they owned and if the car seat Kelsey is seen carrying into Safeway was left inside one of her cars or if it is now in the possession of the fiance. JMO.

For LE to more strongly consider him a suspect, they would need proof that contradicts his testimony--evidence of an attack, video of him with her after he claimed she had disappeared, other eyewitness testimony that contradicts his, etc.

I imagine that it's not that simple to get a search warrant. They need solid proof that a crime has been committed for a judge to grant the search warrant.

I’ve never liked that theory.

It would ping along the way, and require someone to receive it on the other end (if mailed).

We just don’t see people doing that with any regularity.
It could be a new method to confuse murder investigations. Maybe he had professional assistance in creating a new method to confuse murder investigations.

I imagine that it's not that simple to get a search warrant. They need solid proof that a crime has been committed for a judge to grant the search warrant.
They don't need a search warrant if someone allows them on their property. Guess that's not happening? IDK.

There must be some reason why law enforcement is hesitant to get a search warrant on his property. Is he the son of a prominent judge? Is his mom the DA? Are numerous members of his family in law enforcement? What's really going on?
If he doesn't have a record and no 1 has witnessed any relationship problems or domestic violence etc., and there's no evidence of foul play, LE may be in a place where all they can do is ask for permission to search his house.

If I were innocent, would I let them search? Yep. Would I go to the presser? Yep. But...if the fiancé is protecting information that could harm her reputation, and if he is innocent and genuinely knows she left of her own accord or that he has nothing to do with it, he might not see how strangers digging around his house would help. If anything, it could just unearth details that cast her in a more negative light.

As more info surfaces it seems less and less of a possibility but I am holding out hope she left on her own accord. That is the only way I can see this having even somewhat of a positive outcome. The behavior of the father of her child certainly raises a lot of questions but it seems there are a lot of questions regarding the relationship overall. I just think moving to a new place, a new baby, then what seems to be a broken relationship, the upcoming holidays, coupled with who knows what else she was dealing with in her life I'm hoping she just decided to disappear. No, I do not think it is the most likely but it is certainly quite probable and one in which hopefully she could return from safely. MOO

The most significant piece of evidence that doesn't fit with the theory that she left on her own accord is the Nov. 25 ping/texts. Her mother talked with PF that date. She had to be beside herself with worry. I think she would have told him she intended to contact LE. The timing of the ping/texts and the fact that PF claims he received one is too much of a coincidence, imo. The tactic successfully delayed LE getting involved for a full week. JMO

I'm hoping some neighbor in her neighborhood has cameras that caught some movement in her driveway starting on Thanksgiving afternoon.

It’s possible, but I think it’s far less likely than the alternative.

It can’t be.

They certainly would have asked for consent to search at this point, and the fact that they haven’t conducted a search means that he likely told them no.

If someone really wanted to make it look like she'd left on her own, he'd then put the packed suitcase in the car along with her purse and cell phone, park it in an airport parking lot, and take a taxi/bus/train home - and pay cash.

Right now, there doesn’t appear to be enough evidence to indicate foul play, let alone assign responsibility.

There’s just not enough there (Atleast as far was we are aware) to legally remove that child from the custody of her father.

I cannot believe I forgot her name. But this reminds me of the lovely hairdresser, who dropped her young twins off to her abusive ex. ....she was never to be seen again....And her family tried to get custody for years and never were allowed to even see the children after that.

I'm not entirely sure Kelsey's mom talked to the fiance on Nov 25. I thought at first she did and then waited a week before calling LE, but after listening to the press conference once again, it sounds like she called the fiance on Dec 2 and the fiance told her he last received a text on Nov 25. And after hearing that, she called the police.

I wish someone would listen, starting at 2:11 on this video to see if that is how you hear the info too. I think everything got rolling on Dec 2 when Kelsey's mom starting looking into where her daughter was:

Reading back on admin postings on the sanctioned family's missing person page - the official page/admin responded to a comment on their December 6 at 8:21 AM · post:

"thank you for your prayers. Her family communicated with her that day. She was not depressed."

If you read more on the page, the family posted on December 2: "If you believe in prayer, please pray tonight for Kelsey Berreth’s safe return. We discovered today that she has been missing for a week."

Wonder why KB moved to Colorado and how she met the fiance... She had only been there 2 years or so.. And the baby is 15 months. Seems a short time to meet someone and have a baby unless they knew each other prior.. Doesn't seem that she had many friends in the area. She was far from family with a very young baby... Maybe it was a career motivated move?
