I don't get the feeling about the closed-door meeting. It's about the custody of a small child and not about the crime, and I think the judge is trying to keep the matters separate and not a circus. As much as I want info, I think the closed-door is a good thing. This is about little K and her well-being.

I also hope this all moves along quickly in favor of the B family.

I agree. A lot of stuff, there’s really no reason for the GP to know. IMO. Look how “large” the cinnamon rolls got. I never knew left over food could be discussed for weeks.

How to Make a Will Legally Binding Regarding Custody of Children
I wanted to bring this over. Yesterday, there seemed to be a few that believe K could not have made arrangements for her daughter, in the event she (K) died.
The “custody” issue may be nothing more than a formality.
Since K has not been legally declared dead, I think her mom might still be able to produce a doc’ stating her wishes. Furthermore, imo, K being a pilot & a single mom, would have arrangements in place. Jmo
Personally, I can’t imagine any parent/s not documenting their wishes, just in case. So, at least the kids and their estate are handled per wishes of deceased parent/s.

This is one of the biggest reasons for young people to make a will. Once you have children, its a good idea to make a will that sets out the parents wishes for the children in the event something happens to both parents. If one parent should pass away, the other will always get full custody (absent some termination of rights or incarceration issues). But its very common for wills to say that in the event both parents pass, it is declarant's wish that so and so be awarded custody and guardian for the minor children and often sets up a trust for the children. Court's will almost always follow those wishes as much as is possible.

Praying the Berreths get permanent custody without a long fight.

Me too because we dont yet know who all may have helped PF either before or after his alleged murder. LE may not even know who all could have helped PF in some way.

I would hope the courts would consider that and keep the child safe with KB's family.

Couldn’t the commission of the robbery occur at the same time that she was killed? For instance, say it was PF and an accomplice and PF stole a lot of the baby items and took them to his home and somehow LE knew those items belonged in KB’s home?

I'm not Praire wind, but baby items from her home wouldn't be robbery. That would be burglary. Robbery implies something was taken from her in person while she was alive. JMO.

*Pretrial Conference Hearing (re child custody) (@ 8:30am MT) - CO – Kelsey Berreth (29) (last seen Nov. 22, 2018, Woodland Park; phone pinged 800 miles away in Gooding, Idaho on 11/25/18 @ 5:13pm, reported missing Dec. 2, 2018) – Patrick Michael Frazee (32) “fiancé” arrested (12/21/18) & charged (12/21/18) with 1st degree murder & 3 counts of solicitation to commit 1st degree murder & 1st degree felony murder (for death during attempted robbery). Held without bond. Was a suspect as of 12/15/18. Search warrant executed 12/14/18. Search & arrest warrants are sealed. The little girl, who had been staying with her dad up until his arrest, is now in protective custody & will be reunited with Berreth’s family.
12/27/18: The court continued the temporary custody of the minor child with maternal grandparents, but the Teller County Dept. of Human Services will retain legal custody.
12/21/18 Hearing on Advisement; first appearance hearing set for 12/31/18.
12/24/18: Defense has filed a motion to limit the release of information about the case before it goes to trial. His attorneys cite “massive pre-indictment and pretrial negative publicity.” Prosecutors are fighting to have the motion denied without a hearing. Motion has been denied re a request to limit pretrial publicity. Request Denied.

The case is continued for a pre-trial conference on January 3, 2019.

12/31/18: Charged with 1st degree murder, 3 counts of solicitation to commit 1st degree murder & 1st degree felony murder. Defense motions to preserve law enforcement communication (emails & texts) and to limit pre-trial publicity (prevent press conferences, tweets & interviews) were both denied. No plea entered. No bond. DA asks for “consumptive testing” on unspecified evidence. Motion hearing on DNA testing & unsealing arrest affidavit scheduled for 1/4. A Preliminary hearing on 1/29.

With everyone being kicked out of the courtroom this morning, I get the feeling that there is more to this that they do not want revealed at this time. Anyone else feel that way?

Sending good thoughts to the Berreth family and the little one that things move positively today and that this is not drawn out endlessly.

I'm surprised they even said people could be in the courtroom to begin with. I thought most child custody matters were closed to the public to protect the privacy of the children. We normally only get updates on those types of cases from the family talking to the press. JMO.

Oh, no it is going to be long and drawn out. At least in the meantime she is with the Berreths. This will mean multiple homestudies, probably parental capacity assessments etc.

Im not sure the property has to be physically on the person. Just that the person was threatened with harm or force to get the property.

"Threatens the imminent use of force against the person of the owner or any person present with intent to compel acquiescence to the taking of or escaping with the property."

If PF is the one who took baby items, I don't think that would be burglary. He was the father of the child and I would assume had access and permission from KB to any items needed to care for his own child, Ykwim?

I think the burglary has to do with taking the cellphone and purse from the home after Kelsey died - the theft being from the home, not the person. Not sure if that is correct. JMO

  • Patrick Frazee and the woman who is under investigation for possibly disposing of Kelsey Berreth's cell phone were having an affair claim sources
  • Two people who have worked with the 32-year-old nurse said she met Frazee at a rodeo and began seeing him sometime after her divorce in 2016
  • One of the people also stated that the woman was in Colorado around Thanksgiving, which could explain how he the phone was transported
  • Frazee never once left the state in the 11 days between the time that Berreth was last seen alive and her mother first reported her missing
Two individuals who have worked with the Idaho women that is being investigated for disposing of Kelsey Berreth's cell phone say that she and Patrick Frazee had been in a romantic relationship for months.

The woman, whose identity is not being revealed as she has not yet been charged with a crime, could also be the person who had been plotting with Frazee about killing Berreth should the investigation prove she did in fact dispose of the cell.

DailyMail.com spoke with two people who know the nurse professionally, and they both said that they had been told that Frazee was having an affair with the woman.

The woman was divorced from her husband a few years back they explained, and had met Frazee at a rodeo.

Neither of those individuals knew exactly when the relationship started, but they believed it could have been as early as 2016 - prior to the birth of Frazee's child.

One of the the people DailyMail.com spoke with also said that the nurse was in Colorado around Thanksgiving.

That would explain how Frazee was able to get the cell phone to Idaho while never leaving the state.

If abc has it right, it would certainly explain more about how the phone ended up in Idaho. But, honestly, its all shocking to me.
