I missed it earlier today and do not have the will to go through the 47,000 posts from earlier today. Can someone help me out? Did they finally revealed to his lawyer the affidavit I believe it’s called for his arrest? Anybody?
Yes. Both PF and his lawyer have access to the arrest affidavit.

It’s still sealed for us though. :(

Is there any chance PF's criminal case might be thrown out and the Berreths were tipped off to that possibility and decided to file a civil case immediately?

(I really hope this isn't the case but I'm worried since there has been no news of another arrest.)

They operate independently.
In my experience and I am not an attorney, the civil case needs evidence held by LE to proceed with subpoenas, discovery - however it cannot jeopardize a criminal investigation or trial for that matter. Wouldn’t discovery be stayed to that end, bringing the civil case to a halt? correct?

I disagree. He caused her to be murdered, by his own hands or by soliciting. The filing of the suit is stating he caused her death, not an accomplice to her murder. MOO.

Actually, the criminal code is written similarly. They will do the criminal cases first.

I don’t think it affects custody at all. I worry it opens them to an Abuse of Process counterclaim. How do you bring a wrongful death suit for someone not declared dead? And if you bring that suit for the real purpose of trying to assist a criminal case, an “ulterior purpose”, you have abuse of process and the Berreth could be writing a check to PF.

My biggest question is how this was filed without her legally being dead

I actually heard myself say to someone on the phone the other day “I can’t wait for 10 years to find out what actually happened by watching dateline”. That is not OK

Look up the term Buckle Bunny.
Rodeos have a lot of athletic and skilled competitors. Some Rodeos have some serious money to be earned. Example, a girl I know brings in $250,000+ a year rodeoing (barrel racing), however it’s also an expensive sport. One event might reward $5000 for the fastest steer take down and tie. But a lot of people that rodeo do it like a person plays the lottery, hoping for a big win. Another friend’s ranch hand is a bull rider and spends more time with bruised ribs and stitches during the season and less time actually working, he saves up in the off season for entry fees.
There is a lot of time waiting around between events. Some people visit the beer garden (lots of people enjoy the whole rodeo from this “viewing location”). Competitors and regular folk could meet here. It’s also possible to meet walking around, or at socials after the actual rodeo (aka the bar).

Dont know the specifics of Colorado law but it's generally very hard to win abuse or process claims. I guess there's a conceivable risk there, but it's very easy for them to point to the fact that there have been charges brought against him for her murder as the basis for their claim.
I won an abuse of process claim. I think the saving grace here will be that the federal court will dismiss the case for lack of jurisdiction.

As we saw in the Watts case, Colorado has some pretty great open records laws.

We already know more about that one, than any television news magazine could ever cover in a two hour episode.

One theory I'm pondering is that there was no affair. That IN and comrades were solicited by PF and she was the sloppy one.
My thoughts exactly. IN doesn’t seem like PFs type when you look at the beautiful, intelligent KB. MOO

We still don't have any discovery, that I am aware of, for Natalie Bollinger though...

(I’ve noticed this on a few of those shows, for example in Lea Porter’s case (CO), while watching one of those shows about her case I realized how much had actually been left out. So often those shows barely scratch the surface.

For example, they didn’t mention that LE made the perp dig through trash at the landfill with them iirc (which was fabulous btw, moo).
