Note the ambiguity of that wording. Does it mean that she LEARNED IT on the 22nd? Or does it mean that a day or two after, she learned that it had happened on the 22nd?

Are jurors allowed to ask questions in the state of Colorado to people that are on the stand?
No, Colorado does not allow for this.

I was surprised that some states actually do allow that, several actually.

Ethically, DA cannot be the source of that information unless it's already public and he comments on what's already been published.

After confirming , he referred the reporter to the police department/investigators. I did not construe his "no comment" to suggest any truth to yesterday's HLN's media chatter! MOO
DA May repeatedly pointed out that someone would have to make a request for some sealed info - he made a point of saying it like he wanted the press to file an FOIA. He said his office had no reason to keep it sealed (implying the Defense might want whatever kept sealed). It might be PF's arrest warrant, not sure. Did you catch that part?

Should PF move forward to trial, we can bet that the defense will allege that KK was very involved, and PF innocent. IMO, KK has a scorned woman look about her, and man oh man defense will play it up!

Anything KK testifies to will be challenged (including her PA) to plant the seed of reasonable doubt. It doesn't have to be true -- just alleged (a la C Anthony).

I think PF won’t have much opportunity to do what you suggest. Here is why.

At some point on the 22nd, KB’s normal activities stopped, because her life ended. So the normal electronic fingerprints of a living person using her phone, data, etc stopped.

Meanwhile KKL is likely still in Idaho on the 22nd, doing normal things and leaving electronic fingerprints, as well as people seeing her and interacting.

PF will have his own electronic fingerprints that, unless he is smarter than I think, he was unable to erase.

Remember, the police chief or the DA once said that the story of this case was going to come down to the phones. All three of them. And I predict they will prove that KKL could not have killed KB, thus eliminating PF from trying that defense.

Yes it was the arrest warrant and something else. I didn't think he wanted it unsealed per se. I think he was just being very clear it wouldn't happen on its own, so if you want it, here's how you get it and we won't object, but maybe defense will.

Not sure it is needed since it will have limited evidence vs everything they have collected since which should be release at the prelim on Feb 19

I don’t see them going for the death penalty here.

Death penalty cases are rare in Colorado, and a no-body death penalty case is rare (if not unprecedented) across the United States.

Even if this was in Texas, I couldn’t see them going that route.
Ha! I could. I was born and raised in Texas. Don’t mess with them.

Don’t live there now but still proud of them. Off topic so....

I definitely could see them going for the DP if the Berreths want it. I do think some families just don’t want that drain on them. They prefer to move forward. CO is a more liberal State but it will all depend on the evidence. You could be right (a lot of times you are.:D).
We will see.

I am just beyond flabbergasted that KK didn’t go to the police immediately. She’s a grown woman who willingly disposed of evidence related to a murder. KK knew KB was dead and helped cover it up. She knowingly let KB’s family stay in the dark like a textbook home wrecker who wanted KB out of the picture so she could have PF to herself. This is someone with very low self esteem and weak, almost nonexistent boundaries with men. She’s so repulsive.

Even so, she’s free to do what she wants, including taking the time to touch up her cooked blonde hair color and curl it and do her makeup before her court appearance, and go back home to her kids and other family, and guzzle down Sonic whenever she wishes. Meanwhile, KB lies cold in her unknown resting place, her little daughter now motherless.

It makes me so angry.

Let's hope she can turn her anger into helping the prosecution get justice for Kelsey's family. She did not have to say "I learned PF committed a homicide" this morning in order to admit what she did. I think she is going to help them out a lot. MOO

I take that with a grain of salt. To me, that statement is more likely to be a precursor to, “I didn’t report anything for 3 months because I didn’t think he was actually serious about wanting her dead, until he actually killed her”.

Then of course she follows up with the claim that she only disposed of the phone because he threatened her kids, and of course she had no choice but to help him and keep quiet. After all, he just killed KB.

Self-preservation is her MO in my opinion, not being of any help to anyone else.

Absolutely. Any tears that crocodile sheds are only for herself and what SHE has lost. No compassion for KB or baby K and the B family. And if she thinks today was tough, she's in for the "ride" of her life (pun intended).

I am sure if she has to testify the defense will destroy her. And I don’t think the DA cares one bit as long as they have PF. If they have good evidence on PF, they won’t care.

Which makes me believe the DA is going to ask for the death penalty. Yes I know no one there has been put to death in CO in years. But PF isn’t going to give up anything so why shouldn’t the DA ask for death row? If the jury says yes, he spends his days on death row, if they say no, he will spend his life in prison anyway. I see this as a win win for the DA.

And they don’t need PF’s assistance anymore. If he wants to be hard nosed and not tell them where Kelsey is, so be it. I wouldn’t waste my time on him.

Former Colorado Gov. John Hickenlooper previously imposed a moratorium on executions, and it's more than likely that his replacement, Gov Jared Polis will soon sign a bill to abolish DP in Colorado. (i.e., Dems control the house now).

(Knowledge of this pending action for 2019 is said to have driven Weld County DA's agreement with CW. Had they waited or delayed, DA would have lost his leverage for agreeing to no DP for his guilty plea).

I am no fan of KK, but take a mugshot of the vast majority of us and people could come up that same interpretation. She has a resting face where her mouth is down-turned, so it doesn't appear happy. That's genes...

Lol, when I worked for drug court, during group sessions, we’d ask “what has been the most devastating aspect of your arrest?” Without fail, every female tearfully said “my mugshot”, despite having 10-15 year sentences for non compliance. Now the men would comment about potentially losing their job, visitation with their kids & less vain things. Go figure.

Hmmmm.... Ok. Well, I hope they go for the death penalty and hey, a governor isn’t governor forever. Just sitting on death row for awhile could be worth it. But you are likely correct.

Her entire criminal history includes only:

Driving with expired vehicle insurance -- November of 2018
Expired vehicle registration -- June of 2017
Exceeding the speed limit -- June of 2002
interesting. so she was stopped in nov 2018. i would imagine that was an interesting/scary stop if around the time of her adventures in CO.

I'm hoping PF starts talking and pins her butt for exactly what her involvement is. I'm thinking he still hasn't talked and if he does her charges could change. Wishful thinking?
I am also of the opinion that PF has the ability and the mindset to sink her ship and plea. If he couldn’t allow KB to be a mother, he certainly isn’t going to tolerate KKL’s testimony putting him in lock up for life. He’s going to make sure she gets the same. He knows, or will soon know that all hope is lost and he will soon enter the gates of hell, but he’s taking her with him.
