I'm struck by the very careful wording of her statement.

Not "PF told me...." but "I learned that PF...".

As Julia966 noted, she "moved the phone" to "impair its availability".

Perhaps moving evidence to hide it from the investigation is a lesser crime than destroying evidence.

This is confusing to me. To impair the phone's availability, all one would have to do is power it down and toss it in the nearest river. What was her plan in taking the phone home with her? And where is Kelsey's purse?

No one is happy that KK is going to get off light here.

That being said, I definitely get the impression that we will have a different perspective, come the 19th.

Those who are outraged may find that tempered a bit, especially as we get a clearer picture as to how this all went down.

It’s quite possible that she wasn’t involved to the extent that we think she may be, and her contributions to this investigation may have been profound.

It won’t make her any worse a person, but maybe less of a criminal.

Knowing someone was murdered and maybe you could have prevented it by reporting that you were solicited is criminal to me. The laws just don’t reflect that apparently.

That occurred between Nov. 24 and Nov. 25, 2018 in Teller County."
Per KK's statement, she moved the phone from the Colorado County that KB and PF each resided.

Since there's evidence the phone pinged in Idaho (where KK known to reside), I'd say that KK took and/or moved the phone to Idaho. MOO

I think it's a convoluted way of saying that with the phone pinging in Idaho, it mislead the investigation.

Dare I say it's a general "the government isn't gonna tell me what to do" mentality. If you do any sleuthing on her you'll understand that.
How do you sleuth someone? Seriously? I don’t know how.

Being a vile human being isn’t always a crime, even in instances where most of us think it should be.

Yeah its going to be very interesting the more we learn.

I keep going back to the landfill and how that knowledge was obtained. I am guessing a big part of the reason the deal was made was maybe something said like this.

"Tell us what he did with her body and we can go easy on you"

I wouldn't put much stock into the words you heard today. They were carefully crafted by the state not to divulge to much prior to Feb 19. Feb 19 is the really important date as of now. Stay tuned.

I get that KKL looked so hard and defiant in her mug shot, (no one ever looks good in them), but I cannot believe how she showed up rocking the Femme Fatale look in court and in front of the judge. Yikes.

Every photo we see of Kelsey is young, fresh-faced, and earthy. How could her counsel let her come in with all that hair and make-up? Neither did her any favors, by the way. Her hair was flat and dragging down her back and her face looked so pinched and hard with that severe eyeliner.

Anyone else notice how the two women are close in age, but the victim looks like a sweet young thing and the defendant looks like a bitter divorcée. That contrast is not going to help her at sentencing at all.

I have to agree with MassGuy. I don’t like KK, nor do I think she is a good human being (tears were for herself today and over what she’s lost IMO). BUT as Rio has said multiple times KK can’t be convicted over doing the wrong thing morally.

I trust that DA May would not make a deal for someone who actually played a substantial role in the murder. The fact the Berreth family seem to support this move just reinforces this belief. The blame right now seems to be completely on PF’s shoulders. MOO

Maybe but it isn't defined or laid out in the law (as far as the research I referenced on another post). And that is what i wanted to know- what in the law constitutes aggravating factors for tampering with evidence?

I want to know what could result in her getting the longer sentence...

Would aggravating factors include something like sending the texts? I get the feeling we'll know more once a trial is underway (assuming PF doesn't plead). I think today's information was the bare minimum - deliberately ambiguous - and I think it was that way for a reason.

Sorry if that's a dumb question.

Here comes my catty moment. Just look at the example we are seeing from the Berreths.....pure class and grace. Could they have raised Kelsey with anything less? My guess is Kelsey was classy and sweet. KK - imho presents as straight up TRASH. Nuff said. And for the guy who thinks I'm judging her.....damn skippy I am!

No I don't ever remember reading that. Not saying you did not see it but I haven't.

I think that was on one of the gossip mill sites, but I'm pretty sure it wasn't reported here.

That’s all contingent upon the strength of the case against him.

If his attorney were to suggest a plea, I don’t think PF would be amenable to that.

It's a legal statement, written by prosecutors and signed by her, after her attorney had thoroughly reviewed it and advised her. My advice is to avoid looking for any hidden meaning or agenda. Think of it as what the judge had to hear, to pronounce the sentence that he did.
It is what it is. IMO
