From PF’s attorney’s response-

18. These concerns are exacerbated by the extremely small size of the potential jury pool in Teller County, where the case is currently being heard. This competing interest alone is enough justification to leave the Court’s previous orders undisturbed.
AND
19. ...There are social media groups with tens of thousands of members, including members of the named victim’s family, sharing information online. There have been nationally televised interviews of friends of Kelsey Berreth and Krystal Kenney. There have been articles in nationally distributed magazines and newspapers. Contrary to KRDO’s claim that there is no information about this case, the public is overwhelmed with information about this case, and the danger of unfair prejudice that jeopardizes Mr. Frazee’s ability to have a fair trial is extreme.

Any chance PF’s attorney will make a motion to have trial moved? Jmo

Eta BBM and first line

I absolutely think that PF's attorney will petition the court for a change of venue, and I think the trial will be moved. JMHO.

Per TOS, we can't discuss what is posted in FB groups with the exception of the approved family page, which is now inactive. The article says that CB shared it, but her post may be "friends only."
MOO

ETA: The last time I know of that CB was in CO was the first custody hearing. Maybe she's been back and it just hasn't been reported, I dunno.
I am wondering if they will be putting her condo up for sale? I need to look and see if an estate has been opened and a death certificate has been issued.

No emotional reactions allowed. Makes one wonder what's going to be said. Will it be so shocking that the audience needs to be warned to remain silent??

  • #405
So what do you all see happening to PF and his "sidekick phone exterminator" if LE is able to locate the body before the next court date?
The big difference in the case if the body is found before trial would be the defense not arguing that KB is still alive. MOO

No, I don't think we have that specific knowledge. I think the media reports said "some were remaining" or to that effect. Implying at least one was gone. Some folks speculated there were two missing based on KB and K each having one for breakfast. I was just realizing that didn't really require that they were made Thurs, in fact the scene makes a bit mose sense if they were baked earlier. But we really don't know how many were eaten and how many were left, other than that a partial pan remained. Sorry for making it sound specifically certain.

No worries :) I thought I over-looked that! I always thought that she went to Safeway after (getting the recipe from her mom) baking the rolls in order to possibly get the ingredients to make the frosting real quick (IF they were homemade and not the Pillsbury kind).

I believe so too and am thinking Denver or Pueblo.

Someone also suggested that KB could have bought the rolls - we don't know enough.

If she had made them the day before, I wouldn't think she'd leave them sitting out overnight, although obviously she could have put them away and taken them back out. I just don't see leaving cinnamon rolls sitting out on the counter for any length of time. I wouldn't - they'll get dry and stale.

IIRC, someone posted that the condo was in some sort of company name, something like Berreth LLC.

Could she have bought them on her midday trip to the store, as expecting company?
The receipt will account for them.
As perhaps, a couple were missing, someone tasted them, besides KB.

At a recent trial, the accused DNA was found on a piece of pizza, in the house.
Murderers may be hungry, as was CW.
MOO.

OK, I'll say it.

PF might have eaten one cinnamon roll.

Kelsey's brother said the rolls were for breakfast.

(I leave my rolls on the counter in a covered pan, like bread)

Looking back, it seems there was a particular point where the investigation suddenly got very real.

KB was reported missing, LE is starting to look around, they've checked out her house, PF won't talk.

Then suddenly they're back at KB's house for a second search, bringing in a ladder, taking out what looks like a piece of sheetrock (?), etc. IIRC, it was about this time that the Sheriff/local LE made an announcement to the effect that they were pretty sure KB was dead.

Something came up between the first search and the second all-out search. I have the impression that the first search was 'routine'. When they went in for the second search, they were sure they were examining the scene of a murder.

PF & "Friends" were observed making a trip to the Waste Management Facility and dumping trash bags the day before LE returned to PF's and 2 days before they went back to KB's and brought the fire department with them.

LE was able to retrieve some of the trash bags.

It's relevant, IMO.

Never underestimate PF's capacity for stupidity.

Patrick Frazee spotted at waste management facility, police return to his property

Tweeting is allowed according to Sam, however. :)

The State released a decorum order for Tuesday's hearing. No recording is allowed inside the courthouse. That said, tweeting is allowed from inside the courtroom. #KelseyBerreth #PatrickFrazee @KOAA

Blistering response from #PatrickFrazee's attorney accusing a local TV station of filing a motion that's a "complete misstatement of the facts and the truth" and suggests sanctions might be in order. Yikes. #KelseyBerreth https://www.courts.state.co.us/userfiles/file/Court_Probation/04th_Judicial_District/Teller/caseofinterest/2018CR330/001/D-10%20Objection%20to%20Non-Party%20Movants%20KOAA%20News%205%20and%20KRDO-TV%20Motions%20to%20Unseal%20Records%20in%20Court%20File.pdf …

Disclosure of these documents will certainly generate even more prejudicial pretrial
publicity than the massive amount of such publicity that already exists. This jeopardizes
Mr. Frazee’s ability to receive a fair trial by an impartial jury as guaranteed by the
Colorado and United States Constitutions.

I have to agree. As much I'd like to see the arrest affidavit, the information (not the actual document, but maybe later) in it should be come out at the prelim. Patrick Frazee's right to a fair trial is paramount.

As for the rest of it... nice job on the part of the TV stations trying to bullsh!t the court! Sheesh. Good way to get your reporters banned from future proceedings. Very unprofessional and unethical but this is the media we're talking about so par for the course.

I think she was killed on Thanksgiving because the cinnamon rolls were still on the stove. Then again. we don't know when she baked those, do we? Could have been on Friday.

I'd like to know when anyone first tried to call Kelsey, after her two calls with her mom, on Thanksgiving. Knowing the time of the first unanswered & unreturned call would narrow down when she was killed.
Was it stated if the cinnamon rolls were baked, rising, half eaten? What's up with Cinnamon Rolls?

Never mind I found the answer later, baked and cold cinnamon rolls.

My worry is also that KB's brother was rummaging, unwittingly of course, all over the crime scene before LE got there.

eta It must have been a good clean up since he didn't notice anything suspect.

BBM:

Well, nurses are literal pros at creating and maintaining sterile environments, so there's that.

I Thought perhaps she was going somewhere for the TG meal and wanted to take a side dish that was her Mom's recipe.

They suggest KB didn't leave town to see Grandma.
