New information in Kelsey Berreth wrongful death lawsuit
Cheryl and Darrell Berreth, Kelsey’s parents, filed an amended complaint with new details on their belief of what happened to their daughter.

Per the complaint, they believe Patrick Frazee wanted full custody of their 1-year-old daughter Kaylee, but Kelsey wouldn’t consent to that.

“Upon information and belief, Frazee had motive to kill Kelsey in that he wanted full custody of KB and/or Kelsey to leave KB with him and Kelsey would not agree ,” the complaint read.

The Berreths also accuse Frazee of lying to them about his last contact with Kelsey, saying he’s been spreading false information throughout the investigation.

On Dec. 2, when Cheryl called Frazee with questions about Kelsey, the Berreths claim Frazee said he “had had enough and wasn’t going to deal with things anymore,” per the complaint. They also said Frazee suggested Kelsey had possibly “flown somewhere with a friend or co-worker.”

Kelsey’s parents believe she was also at risk, alleging Frazee had access to her townhome and her gun. “Upon information and belief, Frazee had an opportunity to kill Kelsey or have Kelsey killed in that he had her keys and, because he had her gun, she was vulnerable to an attack,” they said.

Mostly because it was Thanksgiving, supposedly, and it's about the only place open on that day (and every day). Not that I believe him anyhow.

I think he told KB that's where they were going for Thanksgiving dinner. I've never been to a Cracker Barrel, so I had to Google. Pretty generic menu. Breakfast all day.

As a mother myself I can guarantee that CB knows exactly what PF said, on which day and at what time. I bet she has notes too. She will be a great witness...heartbreaking but great.

Very odd. It’s pretty clear that it set off alarm bells.

I wouldn’t be surprised if she recorded some of these phone calls.

It’s simply a matter of downloading an app.

I agree. I’ve said custody was likely the motive all along too. (One post of mine was deleted by mods as O/t when I explained similar dynamics between me and my late abusive husband who threatened to have me killed multiple times in large part because I’d filed for divorce and he wanted full custody too).

Glad you are okay! Men often want full custody so they can avoid paying child support. It has nothing to do with love for the child, that's for sure.

I think PF took her gun as another way to control and intimidate her in the days, weeks, or months before - perhaps that was part of the emotional abuse before he murdered her. He could have used some lame excuse about needing the gun to protect himself from wildlife bc he forgot his or something. Who knows really but he clearly knows how to spin some tall tales so..... JMO.

You know he had his own guns so there's no reason for him to have hers. It couldn't have been Kelsey being worried about having a weapon with baby K in the house because there would guns at the ranchette, too.

Some people really love it, though, so that's not meant as a criticism of the place or the people who do love it.

They have candy at the storefront part before you go into the restaurant. The candy part is good!

17. Also, on or about December 2, 2018, Cheryl-Lee Berreth asked Frazee to go to Kelsey’s home to check on her. Frazee said he was in Westcliffe but promised that he would do so. Cheryl-Lee Berreth also sent a text message to Frazee on or about this same date, asking him to pick up a package if it was on Kelsey’s doorstep. Upon information and belief, Frazee did neither.

The link claims he met Kelsey on Thanksgiving Day at a Cracker Barrel Resturant. That would leave a trail. Cracker Barrel is cooperating in the investigation. Very interesting to find out what time he meet her. PF had no idea of the timed Safeway video. I don’t believe he shot her but have no idea why he made a point he gave her gun unless for alabi purposes.

And if he was meeting her there at CB, why was his truck at her house that day?

I feel for cb I can't imagine her pain but yet not to be able to get closure not being able to give her daughter a proper goodbye, and then have to deal with all the frazee bull crap . Pf needs to plea but he won't he ain't man enough to fess up his family needs to drop there family court case ,they need to give the barreths peace so they can move on and give baby girl the life she deserves but that's just my opinion

I’m confused about this. If they were engaged why would he need full custody and why would he claim she refused? The affidavit says he lied about them not being engaged. I still don’t think this was about custody of little K.

He claimed that they split on Thanksgiving day and that Kelsey agreed on 50/50 custody. At the same time he told other people that Kelsey had "issues" that would make him entitled to full custody. It's Kelsey's parents who claim that the she would refuse that, which to them, established a motive.
