And if his brother was there at 2:30, I would assume he would certainly be there at 4:30 when PF called his mother. I would assume that would have been a topic of conversation also. And especially on Thanksgiving Day, conversations I would think would be remembered. Any other day is just a day and you can forget stuff, but I think for Thanksgiving, you remember a situation such as that. In my opinion.
ETA, actually, I am surprised that the arrest affidavit did not mention any such information from the family as to whether he was expected that day, and at what time. The only mention of such was his very very weak brother's explanation of that he *arrived after me.*
That would at least lead me to believe that his brother was there.
ETA the more I think about this case, the more I think it was planned out so that there are so many characters involved, tangentially, that it will be confusing to the jurors and it was done on purpose.
" Involve the whole bunch of different people, and a whole bunch of different areas, so that the jury might be confused and that the defense can point at other people for anything."
For those of us that it followed trials, the most complex cases are the ones where they keep bringing in other people that are involved, and pointing Reasonable Doubt for each and every single person. And this case has more than I have ever seen.
The affidavit has the phone call to his mother at around 3:36, paragraph 13, military time of 1536.
I too think this is somewhat one big convoluted mess. The prosecution may sort it out and simplify it, which they actually have already pretty much probably, but I suspect the defense will use the mess and number of players to muddy it right back up. imo.
