JUST IN: Patrick Frazee’s motion to suppress evidence related to his conversation with a Teller County DHS employee has been denied. The conversation focused on parenting & upbringing for the couple’s daughter.

Patrick Frazee’s allegations that Kelsey Berreth abused daughter to be allowed in court – Canon City Daily Record

Frazee’s lawyers wanted to block their client’s statements from the interview because the caseworker asked “incriminating questions” about dates related to the criminal case. The caseworker, Mary Longmire, was tasked with learning more about Frazee and where the couple’s child was during Berreth’s disappearance so she could recommend to a judge who should have custody of the child until the end of trial.

Judge denies Patrick Frazee’s bid to exclude statements in murder trial

Frazee’s defense attorneys asked the court last week to exclude incriminating statements Frazee made Dec. 26 at the Teller County Jail while he was being quizzed about his toddler by DHS employee Mary Longmire. In that conversation, Frazee claimed that he’d had repeated contact with Berreth after Thanksgiving.

Yeah, it seems as if he simply repeated the lies that he told law enforcement.

The meeting was between 60 and 90 minutes, so they would have been able to cover a lot of ground.

He could have told a lot of lies in that span of time.

Reading through her testimony, it looks as if he gave a complete timeline, one that is directly refuted by cell phone evidence.

Literally everything he said can probably be discredited and proven to be outright lies.

It doesn’t get much better than this.

I’m actually pretty optimistic that it will.

Not going for the death penalty probably sped this up a great deal.

Yes, Yes and YES!! I think all of us here long for justice for Kelsey, her sweet daughter and her family. This case haunts me, thinking of how they plotted and schemed for months and others knew and did nothing to save this young mother. Despite the sadness, I feel the joy knowing that their evil deeds will be brought to the light. I relish in how uncomfortable KK will feel being exposed while getting such a sweet deal. Others will come to despise her as much as we do. I only wish DA May could have convinced the AG of the "lying in wait." But, life without parole will suffice!

He’s already losing, and trial hasn’t started yet. It’s a beautiful thing.

He killed to have her.

He felt he had to cooperate with social services in order to keep her.

Now his words will come back to bite him in the 🤬🤬🤬.

Don't you just love the irony?? :) I'm not one to wish time away, but I can't wait for this trial to begin. I hope the October 28th date sticks!

I cringe the day that she finds out that her father killed her mother while she was in the condo.

Love Love LOVE Judge Sells for not throwing out the interview where PF clearly lied his 🤬🤬🤬 off. Here's to this among what will be many victories for the prosecution as well as torturously sleepless nights for PF along the way toward life in prison without parole!

I was going to say PF better get used to having only his thoughts and the cockroaches in his cell to keep him company every night for the rest of his life...but then I felt bad for the cockroaches. :p

"Investigators from the Colorado Bureau of Investigation later found traces of blood in the bathroom, according to the affidavit. It was found on the base of the toilet, bathtub, towel rack, door handle, ceiling and other areas of the bathroom, the affidavit says. The blood matched the DNA profile for Berreth, according to the affidavit. One unknown male and one unknown female profile were also located, the affidavit says. It notes that the male is unlikely to be Frazee, based on lab reports."

The affidavit says that he “wanted Berreth’s firearm to appear to be missing in an attempt to lead investigators to believe that Berreth might have committed suicide.” Frazee told investigators that Frazee told her she had to dispose of the gun if she wouldn’t take Berreth’s body."
