I believe the you are correct that the defense intends to refute the conclusions of LE about the cell phone evidence, but "PEOPLE’S NOTICE OF INTENT TO INTRODUCE SELF-AUTHENTICATING DOCUMENTS (P-12)" dated 8-19-2019 was agreed upon by both legal teams in the hearing, and verbally approved by the judge. It states that the cell phone records will be introduced as self-authenticating documents, not requiring expert testimony to verify. IMO

I thought that just meant that the records were obtained from the provider through a court order. I'm betting there is an expert on that witness list who can explain them with a degree of accuracy to a jury.

#KrystalKenney may be a pivotal player in the state's case against #PatrickFrazee, who's accused of murdering #KelseyBerreth, but others fear her role in the crime + previous behavior will make her an easy target for the defense. More from @SamKraemerTV:

I have thoroughly examined all of the cell data and every ping diagram in the various affidavits. My personal opinion is that they are not very sophisticated and require only basic skills in math, very basic knowledge of geometry, and the ability to use Google Earth. To put it very clearly, it's not rocket science. I think that either one of the detectives named as endorsed witnesses by the defense is more than capable of presenting the facts to the jury.
This is an opinion, NOT a prediction. I have no better guess what's going to happen than anyone else. JMO

In examining the cell data, I do have to say that there is a world of difference in quality between the cell information of Nov. 22-24 and the same type of information for Nov. 25. There are more pings showing on the final diagram than are shown in all of the other state presented, enabling LE to pinpoint where KK was sitting when she sent the message to Doss. My personal opinion is that the cellular evidence alone was sufficient to convict KK of the charge of Tampering With Evidence. IMO

+1 to that d@mn straight

So I wanted to say something last night but I fell asleep on the couch instead.
As usual, PF did a poor job trying to accomplish something.

He wanted to erase KB from this world...but instead, he has made her famous.
He thought he could throw her away because he didn't care, instead more people care for her and her family that he could ever know.
He thought he could kill her spirit, but instead she lives on in the hearts of thousands of people across the world.
He thought she didn't matter...but she does.

And he has accomplished the opposite for himself.
I really don't think he's capable of any thought beyond himself. His own selfish desires ...

Nice post though...

Only 2 witnesses.
I'm imagining the defense envisioning who they can call as a witness. Hmmm, got no one.
Wait that'll look really bad. We'd better call someone....
It certainly looks that way, doesn't it ? It also explains Judge Sells denial of more time for the defence. It's not like they have to prep any witnesses. They have two of their own investigators and that's pretty much it. Their defence is to attack the prosecution's witnesses. No doubt, KK is top on their list and it will be interesting what "evidence" they present in an attempt to discredit her. They'd be utterly crazy to try and discredit CB in any way. The woman is a saint.

sadly, they will still try to discredit CB, by saying she is mistaken, and that her daughter may not have told her the total truth about things. JMO

And it may be true, that Kelsey didn't want to burden her Mom with every rotten detail about her relationship. The defense may be able to get somewhere with that tactic. But they have to be careful because they can't go after the mother of the victim aggressively.

No.............I've never seen a witness list published before a trial. JMO

They do indeed publish them in Florida. And they also classify the witnesses as "A", "B" or "C", depending on what type of information the prosecution believes they will offer to the court. That gives the defense attorney an opportunity to know which ones might be most important to depose. ( and the subpoenas and the resulting notice of depositions are also publicly available and published in the state of Florida, without waiting for the media to get)

Yes, Florida has the Sunshine Law where the public has access to a lot, apparently unlike CO. I was unaware of the ABC thing. I have also seen witness lists prior to trials in other states.

Sometimes the defense witness list will include some if not all the names on the prosecution list, then adding their own.

Jury selection is expected to wrap up today and opening statements should get underway in the #PatrickFrazee murder trial. The judge has barred all live reporting from the courtroom and property, so updates will be intermittent.

Patrick Frazee: Murder trial for man accused of killing his fiancee will rest on testimony from his alleged accomplice - CNN
The murder trial for the Colorado man who allegedly killed his fiancee last Thanksgiving is set to begin Friday, and the focus will be on the testimony of his girlfriend from Idaho -- who says he confessed to the crime.

[...]

Prosecutors have two hurdles in getting a guilty verdict. For one, Berreth's body has not been found since she vanished Thanksgiving Day near Woodland Park, a city between Denver and Colorado Springs.

Second, the main witness in his trial is an Idaho nurse named Krystal Lee Kenney, who was romantically involved with Frazee and is herself implicated in the case. After initially lying to FBI agents, she told investigators Frazee killed Berreth and that she helped clean up the crime scene and get rid of the body, according to a criminal affidavit.

[...]

Testimony at a preliminary hearing in February laid out the importance of Kenney's account.

Frazee trial expected to begin Friday, what we know so far
Opening statements in the Patrick Frazee murder trial could get underway Friday.

The judge is not allowing any cameras, live reporting or sketch artists in the courtroom. FOX21 Daniela Leon will be giving updates when available.

The trial is expected to last at least three weeks. Frazee’s former girlfriend is expected to testify against him. If convicted, he faces life in prison without the possibility of parole.

Patrick Frazee, the man accused of beating his fiancé Kelsey Berreth to death with a baseball bat on Thanksgiving, will not be subject to the death penalty. Police believe Frazee was the last person to see Berreth alive.

Interesting article....

There were extra port-a-pottys brought in for anyone curious! LOL

SBM

The courtroom where the trial is taking place seems like a relic from another era. The wooden floors squeak with every footstep, and a sign in the clerk’s office forbids claim jumping and mandates people “respect women – mules – the law.” Trial spectators will sit in the rows of stationary wooden folding chairs, the courthouse’s originals. Each chair still has a wire rack on the bottom of its seat designed to hold cowboy hats.

Kelsey Berreth murder case: Small town braces for Patrick Frazee trial
For the past five months, staff at the 115-year-old Teller County courthouse have prepared for chaos and unprecedented crowds that a high-profile trial would bring to the historic building in this small casino mountain town.

The trial of Patrick Frazee — deemed the “trial of the century” by the local Mountain Jackpot newspaper — has drawn national media attention. Reporters from CNN, NBC News as well as staff from shows like 20/20 and Dr. Phil are expected to attend...

[...]

The storms that caused courthouses and government offices across a large swath of Colorado to close earlier this week did not prompt any change to the Teller County courthouse schedule. Court clerk’s office workers stayed in hotels in town Sunday night to make sure they’d be able to get to work Monday morning, Griffin said. Every night since, courthouse employees have held a nightly debriefing to talk about how they handled the crowds and what they can do better the following day, said Connie Telfer, a Teller County sheriff’s deputy who works the courthouse security.

[...]

Court staff hauled in extra porta-potties to accommodate crowds and called in volunteers from the sheriff’s posse to help run security. Renovations to the 1904 courthouse’s electrical system, internet connection and the courtroom’s sound system were all sped up to be ready in time for Frazee’s trial, Griffin said. And while Teller Court District Court Judge Scott Sells is busy for the next weeks with trial, the court’s normal docket had to be moved to the only other courtroom in the building and retired judges will be called to handle the caseload.
