Well, I am still holding my breath because I don't know yet how capable these defense attorneys are. And I don't know who is on the jury...o_O

They will likely say things like ' just because we never saw images of Kelsey leaving the apartment doesn't mean she didn't leave on her own, safe and sound.' Hence the problems with the camera and the images missed, etc.

They do have very large seemingly insurmountable problems...but I remember watching videos of Casey Anthony dancing in a wet t-shirt contest, hours after her baby went missing. And weeks later the jury let her walk in an inexplicable decision. :eek:


All of this! CA trial was a nightmare. I keep thinking that I hope these jurors are taking meticulous notes here. This is week one, day 2 1/2 of testimony. The prosecution still has to bring in the cell phone experts to explain pings and tower dumps which is long, tedious, dry testimony. KK is going to take days IMO, the defense is going to cross hard and the prosecution will most likely go again after cross. All of the searches have to be discussed. Forensics experts, DNA experts, etc.

I guess I’m just saying that I hope the jury remembers these details that we believe are bombshells by the time they get to the jury room.

Nov. 22, 2018: What Patrick Frazee, Kelsey Berreth were doing on the last day she was seen alive
Prosecutors spent Tuesday morning building a nearly minute-by-minute timeline of what surveillance video shows Kelsey Berreth and the man suspected in her murder were doing on the last day she was seen alive.

Footage from the camera attached to the ATM at the ENT Credit Union shows Frazee pulling up at 12:42 p.m., according to Courtney. He spent eight minutes at the ATM. At 12:46 p.m., it snapped a photo of him looking at the machine with his baby daughter visible in the front seat.

Courtney said Frazee is next seen going into Walmart at 12:52 p.m. He left the parking lot at 1:13 p.m. Surveillance video from the furniture store shows Frazee’s truck headed toward Berreth’s condo at roughly 1:18 p.m.

At 4:20 p.m., Frazee is seen at the house once again holding the child. He’s also seen in surveillance footage at 4:24 p.m., 4:26 p.m., 4:27 p.m., 4:28 p.m., 4:29 p.m., and 4:30 p.m. During cross-examination, the defense attorneys pointed out that in the surveillance photos shown in court, Frazee isn’t seen with a black tote box. This piece of evidence is significant, since it is the container that prosecutors allege that Frazee used to store Berreth’s body after the murder occurred.

Courtney said Frazee was last seen in surveillance images at the furniture store headed toward Florissant from Berreth’s apartment at 4:34 p.m. She claimed that the tote box appeared to have moved in the bed of the truck, something the defense disputed during cross-examination.

The next piece of evidence about Frazee’s whereabouts came from his brother, Sean Frazee. He said that he had gone to his and Patrick Frazee’s mother’s home in Florissant for Thanksgiving, arriving at around 2:30 p.m. He said Patrick Frazee wasn’t there, and the family ate without him.

During her testimony, Cheryl Berreth — Kelsey Berreth’s mom — said she had never heard that the two had broken up. She said during one of her last conversations with her daughter on Thanksgiving morning, Kelsey Berreth claimed she had been with Patrick Frazee at his ranch in Florissant and gone to buy him medicine at Walmart. Cheryl Berreth said her daughter didn’t get home until around 4 a.m. on Nov. 22.

At the end of Tuesday's testimony, Slater said Patrick Frazee was paying Kelsey Berreth $700 a month in child support, but hadn't made a payment since July. This was not formalized with the courts, Slater said.

In addition, Slater claimed he found custody paperwork dated in August 2018 in Frazee's home that had not been filed.

Didn't we go through this loan last year and learned it was for a bunch of feeder calves he'd
bought but hadn't sold them yet so thus he hadn't paid off the loan?

Default is failing to fulfill the financial obligation according to terms of the agreement -- not the same as restructuring the debt to avoid default.

That would be like saying on 4th of July I'm going to list my house for sale at Christmas and stop paying the mortgage beginning in August. :eek:

So PaF's name was still on the Franch and sister
and Sean wanted to sell it and push MaF and PF
out on the street and this is what the family fight is about? Sound about right?
I don't think they wanted them out on the street, but they wanted their share of their father's inheritance. Obviously, Patrick and his mother couldn't afford to buy them out, so I am thinking they were trying to force them to sell the ranch to get their portions of the inheritance. It doesn't appear that the mother is included in the inheritance, so the siblings splitting it three ways would have put Patrick out of their father's ranch and looking for another home, and who knows who would take MaF.

This does explain a lot of things. Kelsey's parents were going to help them purchase a ranch, but I wonder if they wanted it in Kelsey's name only with one of her parents, seeing that they weren't married yet. With whatever was going on with this inheritance, it appears that the Berreth's were trying to help both Kelsey and Patrick out by helping them purchase their own ranch, but then it was said that Patrick got irritated and just told Kelsey to rent a place. I think that is when the Berreth's helped Kelsey get that condo- they probably didn't want her wasting money on rent and having to constantly move to a new place with a baby.

Amazing, though, how fast they were already in a battle over the father's inheritance- he had only passed away two months before Kelsey was murdered. Holy cow, they really wanted MaF and Patrick out of there, or to buy out their portion pretty quickly, eh?

Just my thoughts and opinions, and I could be wrong.

So does this mean that the Prosecution has more witnesses still? Did they just not have them ready in the courtroom today when they got through the ones they thought would take the whole day?
I noticed that there was no cross examination of the forensics image guy. That surprised me and probably surprised the DA too. Maybe that's why they got caught short on witnesses today.

It is hard to schedule witnesses perfectly. You try to avoid them coming to court and sitting all day if it can be avoided.

Prosecutors have also talked about finances between Berreth and #PatrickFrazee. Frazee was late on payments on a $72k loan and had been paying Berreth $700/month in child support for many months. His brother earlier said the family had clashed over deceased dad’s $400k estate.

At this stage of the game, even if he had half-considered giving in and saying it was a turble ax-dent, he might think it was worth playing it out in court just to get to give his nemesis the evil eye.

Yeah, he is probably still counting on the jury not finding the star witness credible but so far the evidence against him is overwhelming.

After all, he alone would know if she's lying about something or not, but in the end it may not depend so much on her testimony after all.
Especially if that partial tooth found in the burn pile belonged to Kelsey.

Yes I remember very well - I believe this case is so well prosecuted we will have our guilty verdict - KK just ties it all up in a bow IMO

Sean Frazee said Patrick Frazee called their mother at 4:30 p.m. and said he was heading over. This is corroborated by cellphone records testified about by CBI Agent Gregg Slater — who said minutes later, Patrick Frazee also called a phone number in Idaho that was attached to a nurse named Krystal Lee Kenney.

About 30 minutes later — at 5 p.m. — Sean Frazee said Patrick Frazee arrived with his daughter in tow and started making dinner for them both. Later that evening, Sean Frazee said Patrick Frazee went outside to do chores, and then he and his family went home at around 7:30 p.m. that night.

I'm sure all of us can easily envision PF schlepping around in the kitchen after 5 pm, throwing together a little Thanksgiving feast for himself and Baby K, hours after the rest of the family has eaten.

Totally normal.

Toting around a dead body IS hard work, after all.

August 2018 - half completed custody paperwork, he knew he’d never get custody. When did he start “trying” to paint KB as a bad mom again?

Defense is really pushing that "no blood on his clothes" line- how many times have we heard that same line now in the last three days? Is that all they got?

If Patrick didn't have her body in the black tote, which is clearly shown in a different position when he drove by on his way home to the ranch, just where did they think Kelsey was? Still inside the condo, taking a nap?

Are they really going to try and spin this into Krystal showing up two days later, to do the deed and clean up by herself?
I think they are going to say that he broke up with Kelsey, she was upset and told him to take the baby so she could rest. Then she got drunk and passed out. He called his girlfriend to tell her he had broken up with KB, and then his girlfriend traveled from Idaho, snuck into the condo and killed the drunk ex girlfriend.

And PF told those lies to try and cover for his girlfriend. The End.

That would make sense. They’ll call her to explain how this all went down, and follow her testimony with experts who can back her claims with an explanation of the evidence.

We might see KK tomorrow!!!

ETA: The sad fact that we won’t actually “see” KK, notwithstanding.
