Interesting read about Apple watches, being able to track movements and possibly exonerate SW from that ridiculous story about her killing the children.

A cynical side of me, just can't believe that this family took out bankruptcy, less than 3 years ago (2015?), and yet they are living pretty well, Apple watches, private nursery school, new cars, fancy house.

CW made $65,000 a year. That covers the basics, without a lot left over...SW was earning more, based on sales, but this can fluctuate. And the HOA fees, were being ignored. Interesting.

I don't understand folks who live in debt, it is tremendous pressure to maintain that facade. At some point, everything crashes.
Imo I have had neighbors with a $600,000 home and some rooms are only furnished with the basics because they are trying to buy all the extra showy cars, clothes etc. SW did a beautiful job it seems on her home. Imo it was her decorating bc I remember seeing that she had a passion for design and once had a closet organizer business. It is definitely a beautiful lifestyle dream they presented outwardly. I wonder if money will be part of the case? Not implying anyone deserves death over finances. I simply mean, if it was a means of both parties knowing a separation was looming.

I don't recall any evidence that they were planning on filing bankruptcy.
They would be unable to file again since they already filed chapter 7. If they were in dept again, the house would go into foreclosure and they could not file chapter 13 in order to keep it. Jmo

If it was 60,000 at the time of the bankrupcy, I don't see how it would be much more, unless he got promoted or something. Jmo

Usually, major companies/corporates like Anadarko allow for yearly compensation reviews. Depending on several factors, including performance, cost-of-living pay increases/discretionary bonus may be awarded.

All I can say is, I talked at great lengths to SW about bankruptcy, and how to rebuild their credit afterwards.

I was wondering to myself earlier if the defense will come up with any wacky stuff like blaming altitude or being around gas/oil fumes for what CW did..any thoughts?

I'm sure it will come into play if they want to prove that he killed his whole family, as it is one of the biggest factors in a case like this. Jmo

I thought government healthcare eligibility was determined by current income and assets. I don’t think being single with children automatically qualifies as a priority. IMO there are many single parents that have incomes and assets that are above the government guidelines. Without knowing what SW’s current income was or what the guidelines are it’s hard to say one way or another.

Imo if he provided health insurance for them through work and it was a job benefit would he just be ordered to keep that as to interest of both parties financially ? Or if not covered at work I would think the judge would attribute some distribution of funding to keep current plan in place. Moo

I stand by what I said, single people with children, and most other people have placed healthcare at the top of their concerns list, in nearly all the polls for a couple of years. And she, too, would have been concerned about that. Of course income is taken into account when applying for ObamaCare. With pre-existing conditions on the chopping block now, ANY parent is going to be concerned. Unfortunately he murdered the whole family before they had to think about health insurance.

CW’s use of a PD & the various GoFundMe’s the family has used to pay for headstones, etc. would lead me to believe you are correct. MOO

@MerryB- Your post made me wonder if any assets the couple had would be frozen until resolution of the case? Maybe one of our attorneys can answer?

Agreed. This whole conversation started with the concern by posters that she would not have health insurance if she had left him before he murdered her. I'm saying that she would have, for all the reasons in my various posts, and that she, like most other citizens would be concerned with the health of health insurance itself.

I think the mortgage only has to be behind by 3 months. Maybe it was getting close and that's why CW was talking so much about selling the house. Maybe he wanted to sell before it went into foreclosure. Jmo[

It’s not uncommon for people to spend money they don’t have to fill a void. That along with “keeping up with the Jones” plays a role in many marital breakdowns. Sadly, I think this might play a part in all of this.

If they were in a financial crisis it would reflect on their credit scores. Many decent rentals require a credit check. We’re not sure if they were having financial difficulties or not. Many are speculating due to a prior bankruptcy, unsure of current wages, marital breakdown, upcoming HOA lawsuit and what appears to be frivolous and unwarranted expenses.

@Tippy Lynn You bring up a good point about credit scores and how it could relate to mortgage applications. Could SW's credit score rating have anything to do with the fact that CW was the only registered person on the mortgage of the CO home? Albeit, SW was added to the deed shortly after the mortgage finalized but aren't mortgages and deeds two separate things?

MKZoo,We don’t really know why he took out the home loan in Colorado though, do we? It was an FHA loan, as I recall, so I’m wondering if he qualified as a first time home buyer. Perhaps she would not have qualified due her previous home purchase. I guess my point is that there could be any number of reasons that was
done and it may have had nothing to do with her finances. If there is some information I’ve missed that indicates she was unable to get a home loan, I’m happy to be corrected. I just don’t recall that. Jmo.

I have several friends, who were able to use a First Home Loan.
The partner, who had a home in the past, was not added into the purchase.
Their name, could be added at a future date.

By adding her name to the deed, he would have to split the sale of the house with her in a divorce. Otherwise all he would owe her is what ever money she contributed to the mortgage payment after they got married. Plus child support, of course.

You rebuild credit by showing you’re credit-worthy. One way to do this would be to get credit cards (which would have incredibly high interest rates due to their creditworthiness after a Ch 7) and use them. Of course you’d be expected to make regular monthly payments to establish good credit.

Not sure if that’s what you’re implying.

I teach people how to rebuild their credit, among other things. They got secured credit after their bankruptcy, which is IMO better than a grossly high interest card.

The body adjusts to altitude, it's easy to measure in RBCs, etc, after a few months, and after a few days one usually feels fine up to reasonable elevations like 10,000' unless high blood pressure is present, best to get back down. Of course there is a limit to this, miners in Bolivia can work at about 15,000' or even more, but they have larger lung capacity. I doubt altitude would be a defense ever, but given how long he had lived at those relatively low elevations compared to so much of the rest of the world, I would wonder how that would be woven into a mass murder defense.

Not that I know of, I'm just basing the assumption on the fact that he talked about selling, and her statements about wanting to avoid more dept. It was something I saw mentioned many threads ago, something about a vision board and her goals to pay off dept. I have no idea when it occurred or if anyone has a source for it. That's all I remember. I don't know anything about the mortgage payments at all, just what common sense and experience tells me about living beyond one's means. Jmo

Yes a deed and mortgage are completely separate and not the same. There are many reasons why CW was the only registered person on the mortgage of the CO home. We don’t know what the reason was.
