If this case goes to trial - can CW present the SW strangled Bella and Cece scenario *WITHOUT* taking the stand? If he takes the stand, is he then subject to a cross examination for every lie and contradiction he told after he confessed to murdering SW?

1. Source revealed SW suspected CW of cheating weeks before her death. Family confirmed CW wasn’t being himself and suspects his affair with coworker had been going on for 6 - 10 months. SW had never been apart from C.W. for more than 3 weeks before last Summer when she was gone for 5 weeks.
2. Guest, Psychologist, Jeff Gardere, sees SW’s trip to NC as an escape to wellness. She had to get away from the negativity. Take care of herself. She may have been giving C.W. an ultimatum, see what it’s like without us, when I get back, I want things to be better.
3. With all their in home technology, SW could have kept an eye on C.W. the whole time she was gone.
4. Gardere says SW was hoping against hope that things would get better, hence, all the positive FB posts about C.W.
5. NUA said C.W. wasn’t being the normal, loving and touching husband toward SW or the girls, SW suspected cheating, but she didn’t want to believe it.
6. SW also told the Thayers that C.W. could possibly be cheating, but at the same time said he has no game.
7. Phone call is scheduled at 9:30 AM tomorrow to discuss probate. SW’s family, CW, and their attorneys are all expected to participate. Will be very difficult for SW’s family to speak with C.W. They will be advised by attorneys to stay calm, show no anger.
8. Defense Attorneys will prep CW for this probate phone call. CW will be advised to be sensitive to SW’s family, and not to say anything incriminating. The calls will be recorded and can be used against him. Court could limit who will be allowed to listen this phone call, but AB is going to try to get access because probate is usually public information.
9. AB showed photo of SW taken days before her death enjoying drinks with friends. May be last public photo of her.
10. AB showed another photo, of an FB post of SW wrote that last Sunday night, at 11:09 PM, at the Phoenix airport, on her way home, saying she couldn’t wait to get home to see C.W. and the girls.
11. How could SW be happy to get home to her cheating husband? Could be a message that SW loved CW and wanted to see him. Could have been a message to AP that she was back in town. Could have been conscious or unconscious. SW wanted to be happy.
12. Why get pregnant? Could be a message from SW to C.W. to settle down. We’ve got 3 kids, now! CW may not have cared. He’s not looking at consequences. Typical of psychopaths. He was living day to day. Didn’t make a difference to him if a third baby was on the way. Whatever he had planned to do was going to happen anyway.
13. SW’s videos diminished during last months of her life. Maybe she could no longer put on a brave face. Maybe she was angry and disappointed. Reality may have been settling in. All was not well.
14. If you were FB friends with SW, you knew what her life was like.
15. Why was SW’s phone wedged between the cushions on the couch in the loft area? Phone was in the couch because someone put it there. Maybe didn’t want police to find it? Couch is leather, slippery, highly unlikely that it fell down by itself and lodged in there. Guest thinks C.W. put it there, intentionally.
16. Why did SW leave purse downstairs? Maybe SW walked into kitchen, took what she needed out of it and left it there. Second scenario is she did take it upstairs with phone in it, CW took phone out, hid it in the couch, then took it back downstairs for police to find. Third scenario, SW was strangled in loft area near couch, but expert strongly believes in order for phone to be stuck between two leather cushions, someone would have to have put it there.

1. In the last photo of SW taken Friday night in Arizona at the work retreat before she died, she wasn’t wearing her Apple Watch. Because she didn’t wear it on Friday doesn’t mean she wasn’t wearing it Saturday or Sunday.
2. Couldn’t the home be considered a time sensitive matter? If it goes into default, anything left in the house could be gone forever? All the evidence is time sensitive. If they were late on their mortgage payments there is a time deadline, and they could be trying to save the house before it’s too late.
3. If all this happened because of illness and bills, then why would C.W. have talked SW into having another baby? Doesn’t make sense. It’s not black and white. Spouses can love their children but hate one another. Over and over we see SW trying to make CW happy.
4. Did CW direct police to the site where SW was buried and girls were put in oil tanks, or did police discover the bodies on their own? Police were at oil site before CW’s confession. Probably technology led them there. The drone helped. They had the coordinates, and the drone discovered the burial site. They showed drone photos to C.W., and he pointed out the 3 disposal sites.

In my opinion, what they are trying to get at is a heat of passion defense, which can reduce murder to manslaughter. If the jury buys that the girls were being strangled by SW and he went into this "rage" he claims to have had, he would obviously not be guilty of the girls' murders, and could get a manslaughter conviction for SW's, in addition to the lesser chargers regarding the body disposals. That is why I think CW (aka the defense) came up with this ridiculous story.

Here is what I found. It appears that the heat of passion defense could reduce a second degree murder from a class 2, to a class 3 felony, which are generally punishable by 4-12 years. However, since it is a violent crime it pushes it to up to 24 years.

So if he wins on heat of passion defense for the murder of SW and is not convicted for the murders of his daughters, he is looking at 4-24 years for murdering SW, from what I can tell:

"Second degree murder is a Class 2 felony generally penalized by a presumptive minimum of 8 years and maximum of 24 years, with five years parole. However, second degree murder is a violent crime which has a higher maximum of twice the usual maximum sentence, thus 48 years would be the presumed highest end of the punishment range.

Murder in the second degree is reduced to a Class 3 felony where the death was caused during a sudden heat of passion, caused by a highly provoking act of the victim, which excites the defendant sufficiently, and that a reasonable person in his or her place would also be provoked. However, if there was time to cool down from the excitement, it would be a Class 2 felony.

Class 3 felonies are punished by 4-12 years, but again, as a violent crime, 24 years would be the presumed upper limit."

Then the discussion evolved from there to whether CW and SW had a joint cell phone plan that was linked as in a household family cell phone plan which would thereby hypothetically authorize CW to allow the LE access to SW cell phone without a search warrant.
I was simply offering a scenario whereby SW may have had an independent cell phone plan separate from CW, for business and or tax deduction purposes.
In no way did I intend to infer that LE did anything improper.

You're amazing.

This is why I don't trust everything on AB. It is highly unlikely that SW's family will have to talk "with" or "to" CW during any probate hearing. He will talk to the judge. They will either have an attorney who talks for them or they will talk to the judge.

Why on earth would LE presume they were on a family plan? Seems to me they would want to protect the integrity of the investigation by obtaining a search warrant. JMO

If he gave consent, and we know he did, they would not need a search warrant. The facts indicate that they asked him for it and he turned it over. I am just telling you what the law is. Unless they pinned him down and demanded the password, the consent is valid.

That will likely be the least of the prosecution's worries if the defense is successful with proving SW lied to the public about something so serious and dangerous. Pffffft will go four counts of 1st degree murder in the minds of the jurors.

I sincerely appreciate your point of view, and admire your passion. However; I would, once again, like to say that THRIVE products are not considered to be harmful by many physicians- OB's included. The one and only ingredient that I have seen mentioned on this forum to be considered potentially harmful during pregnancy is caffeine. I am a Thrive user, my daughter (who recently gave birth to a very healthy baby girl) is a Thrive promoter. We have both been using the products for about 16 months.

Let me explain how it works:
Three Steps (Pretty Simple):
1. Take supplements upon awakening. There are Male supplements, and Female Supplements. Many of the ingredients are "pure" forms of what is found in daily multi-vitamins found in most brands currently on the market, and sold in pharmacies/supermarkets. (One of our VI's-Colorado303, posted a full list of the ingredients found in Thrive products very early on). The female supplement includes folic acid- recommended during pregnancy.
2. Drink supplement shake 20 minutes later. This includes additional vitamins and minerals.
3. Apply patch at time of shake. Some of the patches (there are several levels/types) include additional caffeine that is administered through the skin- slowly administered throughout a 24-hour period. Others include a vitamin-form appetite suppressant. I have NOT seen SW brandishing either (additional caffeine/appetite suppressant) in any of the photos after announcing her pregnancy. I am very familiar with what they look like- I've used both.

Fairly easy process to follow. There are additional items that can be used throughout the day- we've seen the bars and drinks on SW's social media. These are considered healthy snacks and drinks (more like juices) that can replace a candy bar or soda.

As to a jury being told SW lied about taking something harmful (Thrive) while pregnant... this may be a hard line to sell, IMO. Any woman on the jury who drank limited amounts of products containing caffeine (coffee, soda, tea, etc.) every day while carrying a child would be guilty of the same thing. IMHO

Serious question: while they are asking a doctor this on the stand, maybe the prosecution can ask if it is medically recommended for a non-doctor like CW to proclaim 3 people who were killed within the last 15 minutes definitely dead beyond help (because who needs trained medics that come when you call 911?) and go ahead and dump them in crude oil and bury them?

It's possible this is true. However, per the law, if he is home and she isn't (which we know to have been the case), he can give consent. Under the 4th Amendment, consent for search and seizure for something like this can be given by another occupant of the home, if the owner of the item is not there to deny it. This is a concept we call apparent authority.

1. In the last photo of SW taken Friday night in Arizona at the work retreat before she died, she wasn’t wearing her Apple Watch. Because she didn’t wear it on Friday doesn’t mean she wasn’t wearing it Saturday or Sunday.
2. Couldn’t the home be considered a time sensitive matter? If it goes into default, anything left in the house could be gone forever? All the evidence is time sensitive. If they were late on their mortgage payments there is a time deadline, and they could be trying to save the house before it’s too late.
3. If all this happened because of illness and bills, then why would C.W. have talked SW into having another baby? Doesn’t make sense. It’s not black and white. Spouses can love their children but hate one another. Over and over we see SW trying to make CW happy.
4. Did CW direct police to the site where SW was buried and girls were put in oil tanks, or did police discover the bodies on their own? Police were at oil site before CW’s confession. Probably technology led them there. The drone helped. They had the coordinates, and the drone discovered the burial site. They showed drone photos to C.W., and he pointed out the 3 disposal sites.

The 6-10 month affair speculation puts a lot of pieces together for me personally. The affair, the pregnancy on both parts, the trip, the effusive SM posts when they were struggling. IMO she was still all in, and he was playing both sides checking out more & more as the affair became more serious. He had a few weeks of freedom and the ending was solidified in his mind, and divorce and custody is messy and people might criticize or not understand him (like now, maybe that's a "poor me" theme of his?).

Also the info about the leather couch and the phone probably being placed there vs being able to easily slip between the cushions is telling.

Finally I'm glad that they clarified that technology allegedly led them to the oil site before he confessed, and he had to be shown the drone pics with the burial site before coming up with his half confession.

He was truly confessing to nothing before he was cornered. Not the affair, not the burials, not the murders. This helps to confirm IMO that he killed the girls and is being consistent with only telling what little he's forced to admit.
