"That said, Mr. Watts’ rights to a fundamentally fair proceeding and, ultimately, a fair and impartial jury at trial, have been so substantially damaged in this case, it does not seem that any prophylactic order, at least on the narrow issue of whether the autopsies should be released, can serve to salvage the wreckage of those rights which may remain."

Wow. Very strong wording here! Salvage the wreckage of those rights?!

Put in the document as a media talking point?

I wonder how his rights have been"substantially damaged" so far?

What does detected mean, That is an unusual term.

The operator saw the grave?
Somehow, it was observed that there was fresh dirt, or disturbed dirt in the area around the two towers. I don't know exactly how, I just know it could be seen from the air. I don't remember the exact wording, but I thought someone had asked if they could see evidence of a grave, or disturbed dirt, and that's why I answered the question.

Detect means to discover or identify the presence of. Edited to add, the affidavit says, "The drone search also revealed fresh movement of dirt consistent with a clandestine grave near the oil tanks." Hope that helps..

I did not realize until I watch the TV show last night that the oil tanks had a berm around them. And you had to go over a ladder to get into the berm. I agree, the dirt that was put on her perhaps was from the berm or she was buried near the berm or in the berm. On the opposite side of the Porta-Potty where if somebody drove in, they would not be able to see it. My opinion only.
This is what I've been interested in, if on ground level anyone entering the site could see a suspect mound or not? If not, and CW had time, he could arrange to move the body later that night, bury SW somewhere else with her handbag.
If NUA hadn't raised the alarm on Monday, if CW hadn't left behind a sheet and bag at the tank site and CW had 24 hrs to dispose of bed sheets, remake beds, and he was the one to report them missing Tuesday morning, how different the outcome?
I suppose it depends if he had a log book or gps recording his daily movements, he may not have been arrested but a P.O.I? I'm thinking more along the lines of this being pre-planned but he forgot about the 10 am doctor's appointment. jmo

It seems quite evident that the ground was disturbed and would have been easily detected with a drone, whether there was a sheet left there or not. MOO

That's the question isn't it? He seems to have been treated well, kept safe, and given legal counsel. He was allowed to greatly disparage his wife to protect himself. He's received fair and open hearings. How have his rights been damaged, much less substantially?

@Seattle1

“Also, given the circumstances, i.e., children allegedly killed in their beds, I believe smothering with pillow would be more likely than manual strangulation”.

That’s always been my belief and it’s supported by the fact that the defence specifically asked for DNA to be taken from the children’s necks. You wouldn’t ask for that unless you knew it wouldn’t be found, or the likelihood of any trace DNA was virtually nil.

Not that this matters but out of curiosity, does anyone know if this is typical behavior of previous family annihilators; to have the bible and a family photo in the cell? I'm thinking the bible, yes but a family photo, no.

I think that Casey Anthony used to have a picture of Caylee in her cell...am I imagining that? Anyone else remember that?

Maybe, these past lovers coming forward has damaged his reputation? One affair might be considered okay but more than one is OTT? Idk.

"Ultimately then, because counsel can see no reasonable way in which the contents of the reports will not be explored in court by the parties, Mr. Watts leaves the decision about releasing the reports to the discretion of the court. However, if the court finds the government’s first proffered reason of not tainting witnesses to be compelling, Mr. Watts requests a hearing on that suspect claim."

Love the defense snark. Lol. Sounds like the defense feels the state's motion is the pot calling the kettle black. Per the defense the state either enabled or don't care about leaks that make the defendant look bad but they care about the autopsy report hurting their client?

They have a point.

And they're fishing for info on state witnesses that may be tainted by release of the autopsy.

In any event, all of this lines up with that sweet bit of what I feel is pure PR leaked yesterday about poor CW in his cell, staring longingly at his dead children and the woman he claims murdered them.

Defense is on fire.

I'm a little confused, was SW buried in the grassy area? Was it disturbed further by LE vehicles because the area looks quite large, just too obvious.

I have a query for a lot of posters here as I see this mentioned a lot.

what difference does it make whether chris discarded the girls easily into the oil tanks or with difficulty?

for me it its a moot point.
him disposing of his dead children in those tanks to hide it is equally despicable whether he had trouble getting them in there or not.

I'm not seeing the relevance.
the decision to do it is the important part for me.
once he committed to doing it how much trouble it was to get them in there isn't a factor of guilt premed or meanness.
they were dead now and he was simply eliminating their presence.

jmo

To me, it reveals a lot about how he felt about his 'loved ones.' Thank the Lord that I have never had a deceased child to discuss here. But I do remember clearly, how it felt when my Father died at home, in hospice care. We knew it was coming and we were relieved for him. It was time.

But we all treated his body with love and respect. I could NEVER have twisted or contorted him as we were moving him out. It was quite the opposite. Candles were lit for him, and we all held hands in a circle and said our last words to him, and cried softly, and gave him a last hug and kiss.

So when I hear about how this supposedly loving father disposed of his girls, it makes me sick. I treated my dead cat better than he treated his daughters.

I think the difference is one was verified by LE and the others were not. Jmo

oh yes, and also all of her interviews she pointed it out.

Good point, surely they cannot be suggesting that the state is responsible for the other AP's claim.

And @NuttMegg , I might guess one would not notice it from ground level, and looks like sagebrush/saltbush around it, and dead grass like the other poster mentioned too.

You guys are forgetting his rights have been "wrecked" because people just don't get him. He's not a monster, he's just misunderstood.

I agree about the PR. We've been told more than once CW is on suicide watch. He's allowed nothing in his cell. Not even books. And then, all of a sudden, he has a photo and a bible? PR!

I'm being snarky, but he deserves a photo of the oil tanks to look at, not his family!
