So, what does everyone think about the sealing of CW health records? I'm thinking HIV positive/Aids? Just a thought.
Could also be any other STD, or some kind of mental health records. I find that motion intriguing, but at this point can't guess what it might mean.

Mental health records would make sense with the defense wanting his visitor logs kept secret. Hopefully we'll hear from our legal experts soon. I see they've already been tagged, so I'm not going to tag them again.

It’s the only thing that makes sense to me. For the judge to agree to keep the information sealed, it’s the only thing I can think of.

When I saw that motion, all I could think is there is something the defense believes will bolster their defense, as I also thought when I saw how the defense is fighting to have the autopsy reports released. It may all be pre-trial strategy, and I look forward to what our attorneys have to say.

Yes! I’ve been waiting impatiently lol After I saw the judge allowed the health information to be sealed, I couldn’t wait for this to open back up. :D:)

I was thinking more an addiction, amphetamine tox screen, or steroid use. JMO, no proof of this, personal opinion based on observations available in videos and photos.


Something like that makes sense. What else could it be?

Defense is really stretching it's use of HIPAA: one part of the motion cites protecting any care provider from breaking FEDERAL LAW of nondisclosure pursuant to HIPAA, and another part to seal [CW] pre and post arrest medical treatment. I believe defense really wants to shield CW mental/psych evaluation including the location and duration. Sealing HIV, STD, etc. also possible. MOO

Upon receipt this court will determine if the motion was appropriately filed as sealed. If so, the court will determine if it would be appropriate to schedule an ex parte hearing. If the motion was inappropriately filed as a sealed document the court will consider converting the motion to a DATE FILED: October 22, 2018 “suppressed” or “public” filing”.

I think this is rather broad, and the court is not sure if it will prove to be valid or not. IOW, the judge is agreeing to see the evidence and take it from there. IMO

Because my mind went to another possibility, I looked up HIPPA. I'm no lawyer, but reading it made me wonder is this HIPPA request might be something outside CW's history. Again, I look forward to hearing from our verified attorneys who understand legalese better than myself.

Exactly. Because stds wont have visiting doctors sign in. Thats usually if a psychologist was brought in by the defense to examine you.

A std would be treated at a local facility while under watch and then meds would be prescribed after that. Jmo.

Thanks KathrynL for that information. I went back and read the whole article and so it looks like it's not definitive that it will be sealed at this point, but like you said, the judge is just agreeing to see the evidence and then decide. Thank you for explaining that.

I thought the motion to seal CWs medical records was interesting. At first I thought they wanted to keep the psych evaluation private for the possible purpose of using it at trial. Had not really considered the STD angle. Yikes.

As for the mark on CWs neck in the video, I’d kind of dismissed it as some kind of dermatographia. I get skin welts very easily and it’s worse when I’m under stress. It had the same look to me.

Perhaps STD(s). Interesting if he had one that SW didn’t have (could be cross-referenced from her STD panel, which all pregnant women have to do).

They certainly would have examined his body for evidence of a struggle.

I know that the mark on his neck appears to be sinister under the circumstances, but there’s plenty of innocent explanations for it.

He’s already admitted to strangling his wife to death anyways, so it doesn’t help the prosecution regardless of the cause.
I tend to think there can not be too much evidence massguy!
the more the better :-)
might be something small like this that pushes a jury over the line?
we all know how jurys want physical proof of EVERYTHING :-/
every nail they can get for the coffin to seal his fate shut permanently is poor gold :-)
