For all involved, he would be best served to take a deal. But the element of publicity for the DA's office is more than likely irresistible, he may not be offered one. This is a sensational case, lots of cameras. Unlikely to occur again in Weld county. And the economic boon to the area is also a factor. Hotels, restaurants, other businesses benefit from out of town news people.

This trial will go the distance, and is unlikely to be fast tracked, they will want every opportunity to benefit from the trial. Cynical yes. And probably very realistic.

Normally I would agree with you if the death penalty was a practical option. But because it's not I can see the DA accepting a deal for LWOP.

I think SW's family will be included if there is a decision. They may want it over. But the death penalty isn't off the table yet, is it?

I don't know why, but I have a horrible gut feeling it won't go to trial. The horrible feeling is that I want the details! I could not care less about CW, he can rot in jail, but Shananns story needs to be known.

Her friends and family would speak and be interviewed if it didn't go to trial. I'm certain they have a lot of info and are chomping at the bit to defend her reputation from the nasty and prurient insinuations and accusations about her character, mental health, state of mind, treatment of her children, etc.

But they can't speak now for fear of damaging the case.

I believe her friends and family are people of deep integrity who are committed to staying quiet and witnessing the horrific skewering of a dead woman's character, without being able to defend her, all so they can ensure there is justice.

But all bets are off once trial is not going forward.

You don't have to confirm or deny that anyone is a patient, to answer a question about a person's current well being.

But if a concerned friend calls and says 'my pregnant friend has not been feeling well, she is not responding to calls or texts, not answering the door, the inside lock is set, but her car is here....is she still at her appointment perhaps? '....it is not illegal to say NO, she is not here.

Right. Isn't it okay to say, "No. No one by that name is here."? But they can't say, "Yes. She's here." I imagine it's similar to attorney client privilege. I can confirm that someone isn't in my office but I can't confirm that they are. It best just to say "I don't comment on that." (In some cases the very fact that I represent someone is confidential).

But it's not a violation to say I don't represent someone. It can be a violation to say I do represent someone, however, depending on the circumstances. Obviously this isn't the case where there are public filings and I'm now the attorney of record.

No. It's still on the table.

How did her friend know SW did not go to the doctor appt? Can people call a doctor’s office and ask about someone?
I remember reading that NAU was supposed to go with her.

Lemark showed significant signs of instability prior to the murders and her husband had already moved on and out (she did not murder her kids after a minutes long conversation regarding separating). CW had not moved out of the house. IMO SW had every reason to believe she might be able to mend things even if she felt he was her world, which i do not think he was. I think her children were her world from what she said about them. Also, Lemark drugged the children so they would not suffer. CW’s account does not allow for that. I just don’t buy what he is selling...especially when he never called 911 to save them and dumped their bodies like trash. His lack of compassion for his own parents ... by setting up a scenario where they would worry for their “missing” grandchildren for the rest of their living days...shows me he does not have the empathy of a man as innocent as he has tried to portray. And then...the lack of devastation post murders is just striking. Everything IMO lines up neatly that there was only one murderer in that house.

Yes. This is not an example of a female family annihilator who showed no signs of mental health issues or instability prior to the killings. She showed a lot:

1. Admitted to friends that she had to seek psychiatric help "for the stress of raising the children."

2. Was suffering major depression before the murders.

3. Actually had a prescription for a sedative at the time of the murders.

4. Showed public anger and unravelling over her husband's affair.

5. Had revealed to her husband that "she was afraid she might hurt the kids."

There were plenty of signs. As there typically are in such cases.

Nothing thus far fits a female family annihilator but everything fits the other way around.

Yes, I really don't see that they did anything wrong. The concern for a missing pregnant woman would surely outweigh the fear of violating the confidentiality laws. Its not as if they revealed any medical information. Jmo

Do you think, at this point, the state would take a plea deal?
I don't think CW is in a rush to do life without parole.

So imo. He will ride this out until the wheels fall off.

ok I dont want to misinterpret your opinion so do you mean your not sure if chris killed the kids before or after he killed shanann?
because if you believe that he may have strangled her in bed that takes off the table any chance of shanann killing the kids.
because its not remotely probable she would kill the kids and then go hope into bed for a good night sleep.

according to chris he killed her while she was killing cc.
so the emotional conversation and the catching her killing cc doesn't really stack together with the in bed scenario.

although I am suspicious that he did indeed strangle her in bed. purely because she would have been relaxed and easy game.
I hope this was the case and she never knew her babies had been murdered already.

he is a coward, I don't think he would have had any kind of 'showdown ' with her.
just cold blooded and silent. no explanation to her. no opportunity for her to defend herself or question what was happening.

but I will say...the apple watches data is going to be fantastic .
if shanann never climbed those stairs......his goose is provenly cooked.

jmo

I think it’s highly likely CW killed all of them, but I’m not fully convinced.

Just a couple of things I recall differently from your post
1) I don't think LE or NUA said that Shan'nan "headed upstairs", I think NUA said she say Shan'nan went in and shut the door. Which is why some speculate that he was waiting to ambush her
2) CW also said "she barely let me....." IIRC
3) I believe he also said emotional conversation was at 4 am. ie said both 4 am and 5 am
4) I don't think he said he went down to get a drink, he said he went down, but I don't remember the "drink" (I think he went down to get garbage bags, he had already killed them, IMO)
5) As I mentioned separately, he had to pass right by the girls' rooms when coming up the stairs to get to the master bedroom across the loft.
There is another timeline posted somewhere in the resources and PommyMommy has the facts very well documented.
Didnt Nua say SW couldn't get in the house at first because of the top bolt lock from the inside or something?

I don't think so. It was NUA who couldn't get in because of the latch/inside lock.

I think they would only verify if a high risk person missed an appointment.

But even then. Its confidential. Because too many crazy spouses will be seeing if their spouse is lying about a doctor's appointment.

Or they can show up if confirmed they are there.

But usually a secretary would automatically call several listed numbers if a person missed their appointment or was running late. Especially if they are still going to be billed a cancellation fee.

So I guess its just up to the nurse or whoever answers the phone. Idk

I thought Nua still said Sw at first couldn't get in the house. Idk. Maybe I confused some things.

Yeah. She described SW going inside and waving.

You’ve conflated that, with the following morning, when NUA couldn’t get into the house because of a chain on the front door.

Do you think that’s what’s going to happen Tuesday?

No. I think it's just a status conference. Probably changed courtrooms and date due to scheduling conflicts. These courtrooms have regular calendars going on but when there are high profile cases it slows the rest of the docket waaay down.

So I've seen that they sometimes move the hearing to different courtroom, or retired judge so they can deal with it while not impacting the overall calendar.

I'm not feeling a plea deal in the works in this case.

Perhaps it depends on the situation itself. If you tell the assistans that your friend felt very sick last night /in the morning hours and your weren't able to reach her since than, maybe they would give out that information even if that wasn't allowed? But maybe they had just an appointment at the praxis and Shannan didn't show up. Nicole tried to write or later called her and she didn't pick up. But how important to the case is this?

I wonder if she was going to babysit?
