Scott Reisch is livestreaming now and saying in his experience dismissals like this are not very lengthy and usually involve the State saying they dont think they can meet their burden to prove this case beyond a reasonable doubt - he then explains how her Motion was 10 pages and very lengthy. He also points out Suzanne's sister agreed with this Motion, as DA Stanley stated in the filing.

he also says that "dismissal without prejudice" is more a "civil" thing and not really "a thing" in criminal side of things. (Though, I will add, he also just stated that he doesn't know the outcome of this and if the Defense was fighting this Motion and demanding to proceed to trial)

Nevertheless he says DA Stanley screwed all of this up "big time"
Scott Reisch is the same guy who concluded after the prelim in the Berreth case, that the prosecution had made a deal with the wrong person, and that things went well for the defendant.

Whenever I want a good laugh, I go back and watch that video.

How is this appropriate?

If she is smart she will dump this client while the going is good.

I see the defense attorney throwing out a lot of words and accusations, but just a reminder to us all:

That doesn't make them true.

So much depends on whether they really have a lead on the body.

If they find the body, then Barry is done for and Stanley will bask in the glory of turning the case around.

She makes one good point - a lot of people who are represented by the public defenders office aren't provided with the same resources as someone with Barry's Suzanne's money.

That's about it - still rambling about the CODIS matches that we know is complete BS at this point, how is she allowed to still go with this false narrative?

Ha! Right....?!

I thought it was odd because even before the live video started multiple media outlets already reported that the Motion was granted....so it wasn't as if that was still happening/being decided while he was talking.
And just for the records, I was merely sharing some of what he was saying, I don't at all have similar opinions and I actually make a point to rarely watch his videos. I just happened to be curious for this because of what he had said about DA Stanley in the past and how "weak" their case was from the very start. I was curious to see what type of plain language he'd use to describe this Motion today.

That was her big gloating moment to try to set the news narrative, which will look very stupid if they do find the body.

It will be interesting to project when snow will disappear sufficient enough for searches to be done. It appears that May will bring mostly rain to the Salida area....off and on over the course of the month. How high up the specific location is would be a factor. Weather experts can fix my amateur description. Wonder what the time horizon actually looks like for searching?

I find the US strange in this regard.

In the McStay trial the defense attorneys were flat out lying about stuff.

Where I come from the language is more measured.

Dismissal - of course. The DA’s case was weak and they repeatedly blew deadlines and withheld information. They shot themselves in the foot.

Unless they come up with brand new evidence that can prove beyond a reasonable doubt Barry did it, they can’t refile. Considering this office’s poor performance, I’m not holding my breath on new admissible evidence coming to light.

That’s it.
