Would it have been better to blame the judge’s ruling on expert testimony, rather than being close to finding Suzanne, in the request? I am worried about a future trial if they don’t find Suzanne.

I don't know. If it were me prosecuting the case I'd be out there myself if I had to with a shovel getting to the bottom of this.
Right? Call out SAR and produce the body. Time for ACTION.

There have been a few posters here who have said all along that they believed she was behind the house buried on the mountain somewhere. Hat tip to those folks if this proves to be correct.

I go back and forth to he somehow got her moved further away to a mine or a predug/preplanned place and to he put her somewhere closer to home. I think sometimes the simplest thing is what happens. Even though he had hours and hours, I think for him safer would be closer to the house because if she was dead, then decomp would be more likely to be left/easier for a dog to smell the longer she was in a vehicle being taken somewhere (unless she was only unconscious and not dead when he moved her, then he killed her wherever he left her). I don't think Barry is the smartest and he likely stuck to what he knows.. hunting/landscaping skills, but we also know he had an interest in true crime things and listened to podcasts and likely picked up on things others did wrong and things that hindered people getting caught. I think he got lucky in some ways and was really dumb with other decisions. Unfortunately where he put her seems to be a way he has gotten lucky because she hasn't been found.

If they have only a general location it would not be possible to clear snow

I guess this gave the Judge the off ramp he was looking for, and the defence team can declare victory and go home.

I really hope they have a strong lead on the body

Morphew's defense attorney, Iris Eytan, argued in court that the case should be dismissed with prejudice, meaning it could not be refiled. She said DA was acting in bad faith to avoid sanctions over discovery violations. Judge did not go for that.

Why let Barry know they are close to finding her- if they are- with this filing? He now plans his suicide (improbable) or getaway for when/if she is found.

I think it gave them a good leverage against the judge.

He'd look stupid if he dismissed the case out of hand then police find the body and Barry's tranq dart a few weeks later ...

Incredible. Just gutted by this. He's getting away with murder. Even if they charge him again it's gonna be how many years before it can go to trial??? The prosecution are clowns and they blew this.

To be honest, I'm thrilled by this. Provided of course that the case is dismissed without prejudice, they can fix all the damn mistakes they've made and nail the 🤬🤬🤬🤬🤬🤬🤬.

I'm not sure law enforcement is truly close to finding the body, but I respect the move.
So what are your thoughts if case is dismissed without prejudice but body isn’t found? Won’t that look worse?

Or, could it get any worse?o_O

Barry retains all of the rights previously granted by the court in previous filings.

The weather is keeping them from being able to follow the lead and they don't think they'll get it done before the trial starts.
I wonder what the lead is? A person, technology finally pointing to a location, or ?? I wonder when this lead came into play? We are 9 days away from the start of the trial and so was this a lead they had for a while and they were hoping weather would break so they could get to it and now it just hasn't so they are left doing this?

No Stone Unturned made me realise how bumbling killers just get lucky - especially with bodies dumped in the great outdoors. The body may not even be well hidden.

How long might it be before he is rearrested? Will they wait until they are able to search for Suzanne's body?
