I’m wondering if Judge Murphy is going to give a bit of a scolding to the prosecution. I don’t know why but I feel it coming. Do you all think it will be Eytan doing the close, or will it be Nielsen? Not sure which style is better for closing argument, or if it even matters at this stage.

I left Judicial Building and went to fairgrounds. Court clerk came out and said that we only have a "very, very slim" chance of getting in today as a lot of his family is expected and they will get priority. I thought i better head over to get seat at fairgrounds. Everybody else stayed. Hope i made right decision...:confused:
I think that was wise.

I don't expect it will last very long but who knows?

Judge Murphy signed off on the arrest on the basis of an AA he has criticized openly. I think any failure to bind BM over lies at the judge's feet. Don't sign an arrest warrant with serious flaws, put a man (however guilty he may be perceived to be) in jail for months then deny justice to Suzanne.

At this point, any excuse the judge gives that reduces the charge or frees BM would be grounds for judicial review IMO. To me, it will all look like a game and not a pursuit for justice if that happens.

OC....Outstanding yeoman's work on the timelines. Thank you for that.

Three broad questions I have:

What happened to the clothes Barry changed into and out of? Were they discarded, or did they find their way back home with him?

Why did BM call CC twice?....and did he connect? What did they talk about? (I suspect CC was figured into Barry's alibi...and am curious how he planned to use him.)

The concrete that was poured in Salida....how involved was Barry in that particular part of the job...and did the date and time of the pouring change; like the date to start the Broomfield job was changed?

BM’s “Saturday clothes” were retrieved from the dryer during the LE warrant search. The “Sunday clothes” I know that LE could realistically have taken were the ones he wore home, but I have not heard that they were seized that day. Neither have I heard about what he may have brought home with him. LE did seize his truck so perhaps there was an overnight bag of some sort. LE has only said that BM’s truck was messy and dirty, (despite 5 trips to empty trash that day.). They have not, to my knowledge, yet revealed what was in his truck when he returned from Broomfield.
CC has remained tight lipped about BM. He has refused all requests for interviews. We had previous knowledge that CC went to work on the Broomfield job with MG and JP. The phone calls to CC from BM was new information received in the prelim. He may be a surprise witness when the case comes to trial, but will he be a witness for the prosecution or the defense?
As far as the concrete pour, BM was hired to do the prep work. He had to flatten, level, and smooth the area to receive the concrete. This was one of the reasons there was so much attention paid to this location. Was he the person who was running the machinery on Saturday at midnight that the neighbor next to the property heard? Was something hidden there that he knew would be covered by concrete on Monday? He also worked at the “beach” area on this property on Friday night according to MG and she was supposed the rake out that area on Saturday morning. Did LE also search that beach area when they searched around and under the concrete slab?

By that time, Barry was antsy. Why hadn't she been discovered missing yet? He's been futzing around Broomfield for hours. So he calls MM1 to push her to call Suzanne and wish her a Happy Mother's Day so she can discover that her mother is missing.

This is one of those ISTG moments, you know. It was bad enough that he set it up that the girls would come home from camping and discover mom missing, but since MM1 didn't act according to his timeline he PROMPTED her. It still took them a couple of hours to call after his prompt.

If the call had come earlier in the day as he was apparently expecting, I wonder what would have happened to all that trash that got tossed at the multiple stops. Maybe there would have been just one stop along the way with the crucial items discarded, and maybe some or all of the other stops were truly unrelated stuff, just decluttering the truck, while he futzed around and waited for the call to send him back home.

Hmm... Maybe that's why he didn't call MG until the last minute -- maybe he initially thought he'd be back to pick her up at 5:30 that evening as planned, to head up to the Broomfield job to do the work on Monday like planned.

As if LE would say "gee BearBear, you go on with your life and schedule, we'll just look around for her here and let you know when we find clues where the mountain lion dragged her."

I think if the judge finds the proof is evident for Murder 1, no bond under 16-4-101. Otherwise it appears it is up to the judge.

So naturally, I wondered what he did with the clothes he changed....like a snake shedding his skin. The phone calls were interesting. Barry spoke with Neighbor Ritter at 5:45. A minute later, Chaffee Co received a call about a missing person, but not from Barry? Then, 12 minutes later, at 5:58 LE calls Barry and he doesn't answer. 12 minutes after that, Barry calls MG to say he is leaving due to a family emergency and is returning home. He then ignores another LE call an hour later at 7:10pm. His avoidance of LE is already established before they ever talk to him at the bike scene; which apparently was his "first stop" after he returned....not the police station, not the neighbors house...not his house.

His first stop was at the bike scene.
So how did he know where the bike scene was?
He put it there himself.

If BM had planned to return at 5:30 to pick up MG...he would then need to decide whether or not to hook up the ole Bobcat, since I am quite certain MG would have asked why he didn't need it. He certainly would not have returned home before getting the bad news about Suzanne...he wanted to get that news in Broomfield. So then, he would have had to make a third trip on Monday to get the Bobcat...3 trips to Broomfield...1 Bobcat? Nah...If he couldn't afford breakfast....he couldn't afford to gas up 3 times for one Bobcat.

It's going to be a great day, inmate BM will be spending the next 1 - 2 years (guesstimate) in his cement prison awaiting trial unless he thinks about a plea after he realizes this today.

I have faith.

Just curious why you think the Judge will scold the Prosecution?

I think BM's defense team were more unprepared the last 2 day PH than the Prosecutors.

He didn't have the bobcat with him in Broomfield, but yet when he arrived home after SM was reported missing, didn't he have it with him at that time, when he stopped at the bike location? (which, @Love Never Fails , was on the road into his neighborhood, so he would have seen the LE vehicles etc even if he hadn't known already where it was)

I'm wondering if maybe the Bobcat had been parked at the Salida worksite (beach property) and he stopped and loaded it up on his way home? but why? Or am I remembering wrong that he was hauling it when he arrived at the bike site? MOO

Some people are pretty positive he will get bail today.... I can't imagine! :(

From the bottom of my heart, I genuinely hope they all go home in tears; especially his friends from Indiana.

I haven’t heard anything about him having it with him when he arrived home that night. I think we all believed in the relevance of the bobcat so long, that we just pictured that scenario.

I imagine it was located in the driveway.
