Wow.

Ya’ll, I honestly don’t think BM is a flight risk. He strongly believes in his defense team. He will be a squared away citizen on bail while he waits for his trial. This is wild IMO
I agree. I think he has through all the speculation been portrayed as something he isn’t. He is just a guy smart enough to know now he was foolish not getting a lawyer the day his wife went missing and he should now be smart enough to listen to counsel

I thought he bought a condo? where was he living when arrested?

He was staying in a condo in a development he was apparently doing work in. We never figured out if he was paying rent, bartering, or how it was being paid for.

I respectfully disagree. The findings are all specified by the judge to be under the applicable standard for probable cause. The judge anticipates a Rule 50 appeal of his decision and is leaving as little room for misrepresentation of his opinion as possible.

I suspect that the defense anticipates a decision denying bail, and sees an opportunity to argue that BM should be eligible for bond because Colorado abolished the death penalty - therefore there are no longer "capital offenses" under the state constitution and all defendants are eligible for bail. This would be the first case to offer an opportunity for the Supreme Court to provide guidance on that issue, and they may well want to take it up.

I believe the presence of distinguished appellate specialist Sean Connelly at this early stage can only mean that BM has committed all his resources in a "balls to the wall" effort to get out of jail early and stay out, and that he will appeal the judge's probable cause determination as well.

Anyone interested in how Rule 50 works may be interested in this Colorado Lawyer article, Certiorari Before Judgment, an Examination of C.A.R. 50.
Thanks for this and the reading material. I am fascinated by how each state is different in the way they determine issues. Just fascinating (and very confusing!)

Barry isn't stable. If he gets out on bail he'll go out in his own "blaze of glory" before he shows up for his own trial. Who knows who he'll take with him? This is scary!

Agreed. I really do think he believes he did the right thing in killing Suzanne to keep her from "sin" (so he "saved" her). Who knows who else he'll suddenly decide to "save" before they backslide into hell?

Hoping the state is pointing out all of the reasons why they need that high number. Plenty of em.

@LaurenScharfTV

The state believes #BarryMorphew doesn't have ties to the community anymore in Colorado. Fears for witnesses' safety. Also, believe he has $3 million since the sale of the home and business.

turn in the passport...

Could still get over the border if he knows anything at all about border crossings to Mexico. From there, he'd need to get to a place with no extradition. And which has hunting.

How much money do we think BM actually has? Is there anyway that he has access to Suzanne's could be inheritance forthcoming from her father's estate?
Was there any inheritance due to Suzanne?

Honestly, one of my biggest issues with the bond is his ability to hands on brain wash his daughters some more. I was hoping his time away behind bars would maybe help that situation. Sigh.

Wow

The prosecution is now saying that Barry has received books in jail about how to live off the land, that he’s spent time in Mexico, and they think he’s a “significant danger to flee.”

Judge says the prosecution did not meet the burden of proof evident, presumption great so the court is obliged to set a bond under Colorado Constitution. State is asking for a $10 million cash-only bond for #BarryMorphew.

Which, IMO, would fit neatly into his recent vacation to Mexico.

I’m going to guess $1 million so he only needs $100k unless he does a cash bond- even Frazee had no bond
Sigh
I sure hope the judge knows that along with the PP sale, BM sold many IN properties not to mention the CASH deals he's squirreled away the last 30 years. I guarantee he has at LEAST 1 mil cash at hand.

Bail needs to be ridiculously high to make sure Barry sticks around for trial.
