I agree that MG was in a position to verify (or not) BM's timeline for Saturday, and that was a goal of her interview.

But I believe some of the early interest in her - and the reason she was invited to undergo a lie detector interview - was based on some local gossip that she was BM's lover and a possible conspirator, accomplice, or accessory. Same for the press interest IMO. She has effectively overcome the gossip, it seems.

I agree that MG as well as some other things were based on rumor tips. I do wonder if she will actually ultimately be called as a witness.

I do think if prosecution has a name to go with the dna they have an ethical or moral obligation to the case to clear that individual. It is also a risk not to IMO despite everyone’s opinions that it is meaningless. I do wonder what specifically will be argued in the motions hearings on Tuesday.

IMO, the DA has no obligation to clear someone who is not a suspect. The Arizona offender's DNA is not present at PP, on the bike or helmet, or in the RR. There is simply no reason to suspect him, so he doesn't need to be "cleared".

The ONLY reason he is the focus of attention at all is that he is a convicted sex offender. The defense knows that they can influence people with short attention spans and distracted brains (most of us, on most issues) they can plant the idea that there might be someone connected to this case who is a convicted sex offender.

This is NOT TRUE. The sex offender is a distant relative (how distant we don't know) of someone who touched the glove box of SM's Range Rover. That's it. No significance at all for the case against BM.

I intend to respond with the facts, every time anyone supports this entirely false narrative.

Don’t know if anyone happened to catch Dateline on Friday night, Season 30, Episode 7, Horror at the Lake. It is about a FL woman who was murdered in her home. During the course of the investigation investigators obtained cell phone records from her phone. They were able to show her cell movement from the house, through the yard, and down to the lake behind her home right after her murder. There was a graphic which showed the steps taken by whoever carried the phone to the lake where it was discarded along with some security cameras, also removed from the home.
This is the same type of data being used in the SM case to show his movements on the afternoon of May 9, when it is believed he was chasing SM around the home prior to killing her. BM has stated he was chasing/killing chipmunks.
Just found it interesting to see it being used in this investigation.

Did you see that I made a fresh graphic for that and worked out where each ping was based on the home footprint available on the Chaffee County Assessors website?

Well if it was in the discovery in June isn't it moot for an action.
The D will cry "tunnel vision" maybe, but not a breach of discovery.
The partial match isn't exculpatory, the D is saying it could be.
So yeah, do the familial work up.
Add it on to the millions it's costing to bring justice here.

I think the defense can pay for that DNA testing and private investigator if they really think it's something.

If per the timeline he did the left turn/helmet toss at 3:58am, I think he could have been at MG's house by 4:10 or 4:15 without even driving too fast. I think that would be close enough for her having reported hearing it "sometime around 4am".

While there's no link to @NoSI's notes, I believe this blue shirt was found by volunteers AWAP during their sonar river search and the blue shirt was deemed not related to SM or this case. MOO

Yup, i believe that is all correct @Seattle1. Its still on my to-do list to compile the notes into one final document and post it. Finally have a working laptop again so hopefully will get that done soon. :)

Would it work with a phone with "location services" disabled? I don't mean airplane mode but "location services", different thing.

You don’t need a smartwatch, fitness band, or pedometer to track your steps. Your phone can track how many steps you take and how far you walk all by itself, assuming you just carry it with you in your pocket.

Sure, fitness trackers have a lot of useful features, but if all you want is the basic stuff, your phone allows you to track those things without actually wearing and charging another device. It’s built into the Apple Health app on iPhones and the Google Fit app on Android phones
Step Tracking Works Best on Newer Phones
This is possible thanks to the low-power movement sensors included in modern smartphones. That’s why it’s only possible with the iPhone 5s and newer — older iPhones won’t have this feature. If you carry your iPhone with you, it can track how you’re moving and identify how many steps you’re taking, how far you walk or run, and how many flights of stairs you climb.

On the Android side, it’s a bit more complicated. Google Fit will attempt to work even on older Android phones, but it will work most accurately — and with the least battery drain — on newer phones that include these low-power sensors. As a Google Fit engineer explained on StackOverFlow:

So if these step trackers can be accessed by the phone owner, I imagine that they are available from the phone providers when obtained by a warrant. I can see how the motion sensor would count the steps, but there must be some type of location service/gps to see where these counted steps occurred.

I saw that episode and had the same thoughts. And was amazed at the accuracy of the tracking. (Although I recall that it was the son's phone that traced his steps. He was talking to the 911 dispatcher on his phone as he was flinging his mom's phone into the lake.)

Specific to Friday, May 8 and AA citation (pg 47/129), I don't recall authorities claiming BM's account was consistent or not since it only covers a few hours on Friday:

Morgan stated on May 8, 2020, Barry picked her up from Anytime Fitness, 9985 HWY 50, Poncha Springs, CO. They traveled to a jobsite at 6962 County Road (CR) 105, Salida. They arrived at around 8:00 AM, completed a "rock beach" project and left. At around 11 :00 AM, Barry took her back to her
vehicle by Anytime Fitness, paid her in cash for the job, and left. Morgan stated that Barry mentioned he was going to go hiking or biking.

In comparison, citing MG, this is what MSM reported:

“Barry had worked on the beach site Friday evening,” Gentile said. “Saturday, he had asked me to clean it up and rake it out, because we were going to bring it out to level – so it would be a beach sand and not muck.”

That area, a construction site off County Road 105, east of Salida, is the same area where investigators spent three days searching for Suzanne, just a week later, on May 21-23.

“He was acting really weird about [the beach area], I was like Barry what’s up,” Gentile said. “He seemed stressed. He definitely seemed weird on Saturday.”

And, although Gentile had agreed to work in that area for the day, she said Barry dismissed her from the job early – at 11 a.m.

“He said that he had to go make the wife happy – do some hiking or biking,” she said. “And I found out, like, later that day that he was in town all day.”

Gentile said she heard Barry was out shopping by himself.

The original plan for the Broomfield job – a retaining wall – included only Gentile and Barry, she said.

“We were originally supposed to go out there at the end of April,” Gentile explained.

She said, the plans changed, pushing the project to the first of May, then changed again to the weekend of May 10. Gentile said she was surprised when Barry called her asking her to assemble a crew for the job.

“Last minute he changed everything. In fact, he called me that Sunday – Mother’s Day – and was really frantic, really didn’t sound like himself,” Gentile said. “I hung up the phone and I thought he just had the worst night of his life.”

Technically there is only one Verizon tower in Poncha Springs. The ping locations are based on GPS coordinates. Location services really only shuts down your apps ability to record your location. By the nature of the phone, to be able to make and receive calls it must be able to connect to a tower. So, either "airplane mode" or just turn it off. Either way it looks suspicious.

I forgot all about those step trackers! They got pretty accurate during the Pokemon Go craze, too. Some of them use a combo of physical movement and GPS to see how far you go and how fast you get there, to use Pokemon Go as an example again, in the early days you could drive under 25 mph and the game would record it as walking. The last time I logged in (it's been a really long time) you couldn't move any faster than a light jog before it stopped recording steps.

Allowing for bad connections accuracy is within a couple of yards.

This is very useful for me to know, thank you.

I normally keep location services OFF on my ipad, and I don't have a smartphone, just a flip phone. I figure since I don't use the apps like "find a restaurant near me" etc and I don't want any customized ads, I should keep it off. Maybe when I have a smartphone and find some location-based app I do want to interact with, I'll turn it on, but until then I don't plan to.

At the same time if I were to go missing I would certainly want LE to be able to see where my phone went. But until you posted this I had not seen anything suggesting the internal GPS that LE could access, would still work while Location Services are off. So thank you for elaborating!

And it shows someone in the cab of the black truck. Never noticed that before...

And, maybe he picked up her phone, unlocked it, saw the texts and pic between JL and SM ...
I think that is exactly what happened. BM picked up SM's phone and saw enough to cause him to search the porches, the garage, and break down the bedroom door.
