I noticed in the AA that Macy or Mallory (Name redacted) told the officer she last spoke with her mother the night of May 9.
Yet LE puts her time of death (or last sign of life) around the 2 PM hour.
How did they reconcile that with the daughter speaking to her Saturday night?
Testimony during the PH was that SM's final communication was around 2:11 pm on 5/9. I recall SM texting a photo to daughters on Friday eve, 5/8, re. pizza in Salida but not recalling any communication on 5/9 cited by OP. o_O

ETA: Also recalling MM texted that "she got the job" but don't believe that was Saturday night.

It's a bit of a tricky area.

In general the law does not allow "similar fact evidence" or "propensity reasoning" at trial. The general idea is you are not allowed to try to paint the accused as the "kind of bad person who would do a crime like this". (There are exceptions which don't really apply in this case).

All that said, the prosecution will be trying to prove the relationship was bad (from SM's point of view) and that she was trying to leave BM. That goes to motive.

It will be the defence trying to convince the jury that BM could never have done such a thing. I have seen that approach work. When Pistorius was initially found not guilty of murder, I think the judge was convinced they had a normal loving relationship, so this must have been an accident.

I think in this case it is much harder for BM, because all the evidence is this was not a good relationship.

I mean, there's irrefutable proof that the marriage was deteriorating.

Despite Barry using the word "perfect" over and over, there are recordings, text messages, that grievance list, deleted texts, and witness accounts.

The prosecution doesn't merely have an edge in this regard, they are dominating from the start.

Just one of many lies from Barry, but still very important.

That's the whole case, right there.

It's just a shame those two can't put the pieces together. Not at all unusual, but disappointing nonetheless.

Okay. On page 4 of 129, it says:
“Sgt Hysgulien next contacted REDACTED,
Who stated that she had last talked to Suzanne on the night of May 9th of 2020.”
Don’t know is this is a daughter but I assumed it was.

If it's a daughter, it's weird because the next sentence says "she had last seen Suzanne at the end of April, 2020." Thinking about it though, I can't think of who else it would be.

It's also an error, as Suzanne was dead by that night. It's gotta be the 8th.

Thanks @Love Never Fails for the AA pg reference. I think the footnote to the statement makes it clear that authorities believe this recollection by the redacted party was in error. JMO

Yeah that’s what confused me. I didn’t pick that up before. It does sound like a daughter. I thought of MM1 but I thought she got to see her mom before the road trip. I guess it’s possible she last saw MM1 in person in April. That was only a few days before.

I have to go back and read it but I understood the daughter made the call and not Suzanne. LE has the cell records and the daughters will be witnesses. I just wondered if the call had been brought up here. I haven’t seen it discussed. Made me wonder about the time of death. That’s all.

Just so happened to have @sk716 website for Suzanne in another tab. This info is during the PH when they're discussing the daughters. Suzanne does not ever communicate with anyone after Saturday, May 9, 2020 at 14:11. But, there seems to be a slight discrepancy...

Before the trial, they just have to put it all together. How could they not? And one of them must be curious as to where Mom is. They have to see through Barry’s bs.

It's also GROSS that, according to Barry's answer to LE in the AA, when he told his daughters about JL and the affair (the hardest thing he ever had to do -- hardest? Really? Didn't do anything hard on 5/9?) -- he explained to them that they needed to forgive their mother.

'Scuse me? Aren't they entitled to their own feelings? Why does he persist in entitling himself to deciding for women what they're feeling? How many times did he dismiss Suzanne's very real, very normal feelings -- in one of her moods. Drunk, drugged, sharing little things with women because that's what they do. Withholding affection. Sheesh. Her chemo must've been a real inconvenience for him. Can't help but to notice that when describing Suzanne's two bouts of cancer he managed literally to put himself first. He battled cancer with her twice.

He seems to have the singular ability to put himself always first, impact on others be damned.

I can think of several cases off the top of my head where the children sided with their father.

This happens even with overwhelming evidence.

It's pretty disheartening, but I've come to expect it.

I agree and it’s sad that we have come to expect it. Are most of the cases ones where money is involved? Are they more concerned with getting a payout than seeing justice? I can understand not wanting to take sides in your parents fights and divorce. I can understand trying to love the surviving parent that killed the other, for a time that is. I cannot understand closing your mind and heart to the FACTS. And these two have the facts right in front of them. MM2 actually knew the divorce was coming.
All I can think of in this case, is that BM manipulated the girls to a point where they now hate their mother.

Parental alienation is a real thing. Barry said himself, he needed someone on his side.

My guess is LE knows if there was a phone call...but one thing is we do not know "how" Suzanne died or "time of death". It is being established by prosecution based on the cessation of her phone and internet activity so if there was a disparity I have to believe it is known.

Yes we likely can conclude LE has reconstructed the crime until every minute is accounted for. I like cases where there are no loose ends.
I’m ready for trial and justice for Suzanne.

MM1, yes. If we ever get the full document dump we're waiting on, I'll be able to un-redact the AA. There are only a couple of spots where I haven't worked out who is redacted.
