I'm just hoping that his replacement is not somebody moved by E & N's grandstanding as they like to do inside the courtroom. We know that Murphy didn't budge on the defense team's thought-out displays of drama. And E & N have been very effective in other courtrooms using this -- it's why they continue to do it! MOO

Exactly! I'm sure I saw Murphy 'eye roll' their drawn-out drivel at least three times which I very much enjoyed as my eyes nearly rolled right out of my head!

Been watching this all afternoon and it’s just heartbreaking to see. Boulder County Sheriff said it started at 11:00 a.m. when 100 mph winds downed power lines and started a grass fire that quickly spread to the towns of Louisville and Superior. They can’t use airplanes to fight it because of the winds.
Having lived in Colorado Springs during the Waldo Canyon fire of 2012, my heart really sank when I heard a Fire official say that this is like Waldo Canyon on steroids.
Praying for all involved.

I think from the defense point of view, it's more likely a replacement judge will rule in their favor on suppression motions involving the warrants that were issued by Judge Murphy.

I don't think this was the reason the motion was filed, but it's a very slim benefit that might result from recusal. I don't think BM can expect a fairer judge, and his attorneys know that.

I think the motion was filed because attorneys, as officers of the court, are obliged to bring such matters to the court's attention. MOO.

I doubt this was the reason, personally. If it was a glaring, obvious conflict of interest then sure. But this was pretty tangential. Even in his decision to withdraw, the judge says this is a novel legal question in CO. Which means no one has ever raised this type of conflict before, even though I'm sure it has occurred before (judges tend to be friends with lawyers, and witnesses in cases often have their own lawyers).

The judge and the prosecutor were clearly aware of his relationship with McDermott since he disqualified himself from the other case because of it. It didn't occur to either of them that it was a conflict in BM's case, even though the appearance of bias would have been towards the defense.

None of which is to say that BM's lawyers were wrong to raise the issue, just that they could have easily decided not to and no one would have questioned their ethics. And that makes me think that it was a strategic decision. Though I'm a little baffled by the strategic reasons for it. Maybe they have a decent idea who the replacement is likely to be? Or maybe BM was so pissed at not having the charges dismissed that he demanded they find a reason to get a new judge?

Darke’s first appearance was on October 13 and Judge Murphy recused himself upon hearing the firm that represented her on the trespassing charge.
The day before BM’s scheduled hearing on December 14, his Defense raises the issue.
Even the Judge questioned the timing. It was absolutely strategic. JMO

Lies about deer - pants unzipped. The way I interpret this is: BM coming into house with his pants unzipped and using looking for deer as an excuse , sounds familiar doesn't it? Using animals as excuses for everything under the sun including reasons his pants are unzipped! His IQ must be SUPER LOW....As if looking/hunting for deer would entail unzipping your pants unless you are one sick puppy if you catch my drift..What an insult to Suzanne's intelligence, I mean come on Barry...Poor Suzanne, amazed at how long she lasted with BM. He has the maturity and conversational level of an 8 year old!! JMO as always.

I wouldn't put it past BM to hide cameras in the house, but I do think that animal mounted above her in the photo looks like a pronghorn antelope, and they do have a white swath on their lower face/neck:

Thank you Cindizzi, I remember this now about SM thinking cameras were mounted in deer's eyes. That unzipped pants part has me wondering why SM would pair those 2 grievances together.
