I do not think evidence from one trial can be brought over to a different trial but we need legal counsel on that issue.
There are various ways a witness's testimony in one trial can be introduced as evidence in another trial, assuming that it's relevant in that second trial. If the witness's testimony in the second trial is different from the first, the transcript can be used to impeach credibility. If the witness can't remember in the second trial, the transcript can be used to refresh his recollection. There are other ways as well.

To what testimony in what trial do you refer?

Yup. I guess I have more important issues to be morally outraged about than her picking up his misdelievered package.
Trespassing is trespassing. You should be morally outraged because if it happened to you it would probably be a different story and you might actually be outraged.

Different degrees of trespassing and different degrees of outrage....depends on who it is being trespassed upon.

30 years ago I collected seeds from trees and bushes and I planted those seeds on my 12 acres in a climate much like Colorado. In fact many of those seeds were from Colorado. We lived there too once upon a time. Those seeds grew into a forest and a beautiful understory with small trees and bushes that buffered us from the road and gave us wonderful privacy in the lovely log home we also built.

Years later a new neighbor moved in across the street and he felt that my 12, tree dense acres in a high desert location where trees don't grow without a lot of love and care and also backed up to a river were a PARK for his enjoyment despite the no hunting and no trespassing signs posted at the top of the driveway. He couldn't understand why we felt differently and he did not understand why we had to press charges when he would walk up to our pool when we were in it relaxing and enjoying what we created.

A year or so later he had to press charges against train hobos that hopped off of trains that parked on the rails at the back of HIS bare 12 acres across the street. The train hoppers felt they had the right to set up tents and move into his stored 5th wheel on the back of his acreage because they thought it must be a PARK for their immediate needs. Didn't work out well for the hobos either.

What goes around comes around. I would sue that woman for trespassing on my property and the puppet master that sent her too. Especially since the puppet master sold that property and his wife is missing. It's one thing to be understanding and another to be completely dense. MOO

Politely, I've stayed away from the package grabbing episode but I've become a bit cranky today so I'll give my two cents on the matter since porch grabbing behavior seems to be excused. Thank you, @sassyblue for sharing your fascinating story.

Stay away from my home unless you have permission to be here. Do not approach my porch unless you are an invited guest. By all means, if you take something or remove anything from my property without permission, you'll be considered a thief and treated as such. If you feel a package is on my property that may belong to someone you know, contact me so the proper action can be negotiated.

I cannot and do not believe that residents in Salida are gushing with glee over the fact that a fellow man who was arrested for murdering his wife is free to roam the area nor that his alleged GF is willing to steal packages from the porches of residents. Do these two peas in a pod not possess a moral compass? Furthermore, well, I'll not go there because I rather enjoy being a member of this mighty fine site. :D

ShoSho will always have an arrest record for her actions of illegal trespassing. Wonder how that makes her feel. In my state, it is a costly affair that involves the Governor in order to expunge or seal eligible arrest records.

I wouldn’t dare trespass knowingly on anyone else’s property. No trespass sign or not. Times are tough and the crime rate is high. I value my life and safety too much. Many states have castle doctrines to be certain. I don’t discriminate between states or properties who have no trespassing signs posted. My late Grandmother lived next door to us in a city having moved there following a burglary at her own home in a rural area where she never felt safe again. She always told us don’t come knocking on my door after dark because I am an old woman and will shoot first and ask questions later. She was a tiny woman who slept with a loaded 357 in her nightstand drawer and she meant it. Enough said IMO

eta IMO in most states in the US if you don’t have castle doctrine or no trespassing signs you would be hard pressed to find a jury convicting someone for defending their property and safety. Especially rural areas where most people have protection. Also IMO

Did Ms. Darke lose her nursing license because of fraud? And there was some legal issue with her ex boyfriend? I don’t recall if she was charged with a crime for that. Then, there was the trespassing charge at Puma Path?

She does seem to have a difficult time with lawful behavior.

It's a hell of a long time since I studied trespass, but in general there is an implied license to enter on to private property for legit purposes.

You can withdraw the license e.g. a locked gate and sign "private property - no entry"

But in general these cases will have evidential challenges - e.g where a local, delivery person etc claims legitimate business, such as they believed that any signage did not apply to them (if they even saw it).

Probably why it's not worth pursuing.

But she did trespass and stole a delivered package not intended for her!
Normally I suppose one could say they realized the package got delivered to one's old address by mistake and went to retrieve it. But being this was Barry's old house where his wife went missing and he recently got out of jail pending trial on a murder charge, makes things look a little more cagey!

I can’t begin to think like a killer. But for some reason, he does seem “proud” of what he has done. That would make me think he had a steak after working up an appetite, like a prize for his accomplishments.
I tend to agree with you. With his ego it does seem he would reward himself. Really sick.

I just wonder if the whole trespassing case was a giant pain in the neck and fraught with all sorts of implications that could prove problematic for the BM trial.
As for SD, I don’t think she cares what is on her permanent record.

Selling a house with a history is a consideration on price, and finding a buyer willing to buy a house with an uresolved missing wife case adds a few steps.
But no way would that buyer expect to become involved by the ex owners girlfriend trespassing on them for a package.

Calling new owners or the realtor to explain a package was mis-addressed and he would like to send someone to get it was the way to respect the new owners property rights. Anyone would know that.
So, maybe it was all a clever ploy by E&N to get rid of the current judge.

Barry should have called the authorities to ask the how he gets his package. Surely someone could have gotten it for him.

Just an FYI that Denver Courts are suspending jury trials for January -- it should come as no surprise if Chaffey County Courts follow the same and only virtual hearings held:

I saw this yesterday and thought the same thing ( that Chaffee County might do the same). JMO

In addition to Denver, the 18th Judicial District
( Arapahoe, Elbert, Douglas and Lincoln counties)
and the 20th Judicial District ( Boulder County) have suspended trials until January 28th.

Judge Lama was appointed to the district court bench in January, 2016. Judge Lama currently hears criminal, civil, domestic relations and juvenile cases.

Prior to his appointment, Judge Lama was a solo practitioner at the Law Office of Ramsey Lama, LLC. His practice focuses on criminal defense. Prior to forming his own firm, Lama worked for the Office of the Colorado State Public Defender in its Salida and Grand Junction Offices. Lama earned his undergraduate degree from Aquinas College in 2004 and his Juris Doctor from Cleveland-Marshall College of Law in 2008.
