Seems the defense attempted many of the same arguments we're hearing today on November 9 and Judge Murphy finally shut them down! Please see the link for fresher:

I remember that. He told the to pull it together in a motion and resubmit. So they did. I agree it was abit disjointed originally. Seems more pulled together and specific today.

From the link above: Judge says "I think I need to shut this down." He says it is no one's fault but some of the motions filed were old and a bit broad. New motions that should be filed should include what exactly the Defense is asking for and what exactly they are missing.

I still can't figure out the bike! Since she was home alone and bored, maybe she took a short bike ride and was abducted, possibly by two guys, and her helmet torn off and thrown out the window. We see women getting abducted alot. This, I believe, was never looked into. If that happened, she's long gone and IMO, only a deathbed confession would reveal this.

So she goes on a bike ride in an area she would never go, forgets items that she always take, and never turns her phone on that Mother's Day?

Some predator then kidnaps Suzanne, enters her car, leaves her purse, stages her bicycle, dumps her helmet, forces Barry to lie about when he woke up, puts Barry outside when he should have been sleeping, puts Barry in the vicinity of the bike, shuts down Suzanne’s phone at the precise moment Barry needed it to, forces Barry to chase elk towards the helmet location, forces him to dump 5 bags of trash, forces him to lie about working, forces him to lie about where he was when he got that call, forces him to lie about the state of their marriage, and Suzanne wanting a divorce?

He causes Suzanne’s footprint to cease to exist on that afternoon, puts Barry’s phone on airplane mode, disappears her journal, and scratches Barry’s arms?

And this is all based on a DNA sample with "limited genetic material" found in a vehicle unrelated to this?

It has been determined that she was a fairly new novice rider although she had a very high quality and expensive trail bike. It is also said that she loaded her bike and drove to trails as opposed to riding out from their home so the theory by prosecution is that the bike was tossed. Also apparently she rode in the afternoons, but I'm not sure that is entirely true....it was mentioned by someone being interviewed but if so then we don't even know when she went for her last ride prior to Friday when Investigators started documenting her texts and social media activity or really just how often she road but it is also reported that she had her bike at a repair shop on Thursday.

Problem is, there was complete radio silence from Suzanne from about 2.30pm ish on the Saturday - no further contact with ANYONE she knew and loved. That's a huge RED FLAG that something was seriously wrong.

They are trying to find documents or testimony to support their theory that police deliberately buried glove box guy as a real suspect because they were all in on Barry.

A few things it looks like:

Obtain as much information as they can to discredit Cahill at trial.

Ultimately obtain some sort of sanctions for allegations that the DA's office hasn't been forthcoming (Lindsey should be on the stand shortly).

Generate news that is favorable to them.

Since May in Colorado can still command a chill -- I'm thinking the dark glasses, black sweater-wearing Ninja's -- like the ones alleged to roam the cornfields of Iowa.

At minimum I assume sanctions against prosecution. Maybe secretly behind closed doors they hope the judge dismisses the case, but that would be a huge shocker in my opinion if they are thinking that unless they figure a dismissal means they got the job done. Plus I'm not convinced that a dismissal is what they really want...I think they are after an acquittal so he is free. A dismissal means he could be arrest again and a new trial.

This won't impact potential jurors in my opinion and there is still that change of venue motion so even if locals are glued to twitter today people outstate are probably not glued to twitter should the venue change.

Judge orders prosecution to release documents in Barry Morphew murder case

The new judge presiding over Barry Morphew's murder case on Monday ordered the prosecution to turn over all police reports and videos from the 20-month-long investigation to the defense.

Morphew's attorneys argued during the first day of a two-day hearing that the prosecution has not handed over evidence in a timely manner.

11th Judicial District Judge Ramsey Lama also said prosecutors must turn over any internal affairs and resignation materials involving a Colorado Bureau of Investigation agent who stepped down after a dicey evidence hearing in August.


According to information divulged in court hearings, the glove box DNA was a mixed partial profile of three people, including Suzanne Morphew, one of the Morphew daughters and a third profile, which has markers similar to three profiles found in three sex assault cases in Arizona and Chicago through the Combined DNA Index System.

It's unclear to whom the profiles belong, whether there is enough of a profile to identify a close match or whether the profiles have been thoroughly investigated. The defense team said Barry Morphew's DNA has been excluded from the glove box sample; however, the touch profile was not found anywhere else but on the glove box.

In my opinion, only a hitman could have done it, if at all. And in case of a hitman, Barry was the client and benefited from it, namely 100%. He had to send the girls away on a trip, he had to care for his stupid alibi (Broomfield) and he had to clean out his home/garage of all the criminal stuff. Maybe, $70.000 were enough for the service? Maybe it was more expensive and he had to dig for his buried cash somewhere in IN or CO or where ever.
I don't think so now, that a hitman is involved. In May 2020 I wasn't sure, what to think about it.
