Judge Lama says the defense makes a good argument. "In my years on the bench, and my practices as a lawyer, he's never seen this lengthy affidavit either." The court finds the draft by Agent Graham must be disclosed today.

CBI says they only have 1 draft of the AA. They will provide it to the DA today. Defense says Agent Cahill testified that revisions were made to the AA.

Judge says DA will get the revision of AA - they have time to look over it and make necessary motions before giving to defense.

Eytan clarified that there are two agents that revised the affidavit. CBI attorney said they know about Agent Graham but not Cahill. The judge is only ordering Graham's revision and is giving the prosecution 7 days to hand it over to the defense.

Judge says these materials in question should have been provided to defense this summer and they haven't. He says prosecutors have a duty to make sure the flow of information to the defense office is working. #BarryMorphew

Judge Lama says emails should have been provided this past summer, it's a big burden. He denies the prosecution's motion to quash. Discovery needs to be handed over to the defense no later than Jan. 31.

Now we will turn to motions for pre-trial publicity violations. The defense wanted to call former ADA Jeff Lindsey to the stand but is searching for him in the courthouse. Mr. Lindsey is not here. The prosecution is texting him to see if he is on his way.

True, but trial is imminent....at this point this is "old" stuff they claim they are missing and they have a right to be upset. Every legal expert will say that prosecutors cannot withhold information except for some things related to informants and some research or work product and thank you to the person who posted Rule 16. I am not surprised in the least that the crazy long strange affidavit was going to come back and haunt the DAs office. Ball starts rolling for trial with an arrest warrant and that timing was totally under the control of the prosecutors office.

The prosecution asks to continue the pre-trial publicity issue to another day and says they didn't know this motion was scheduled today. Judge says that he had scheduled it for today and said it at last hearing. Defense says they want to discuss today. #BarryMorphew

The prosecution is wanting the pre-trial publicity violations to be heard on Feb. 1. Eytan wants it today. District Attorney Linda Stanley is not here. At the previous status conference, the judge did alert both parties about discussing the pre-trial publicity violations.

It's been that way since day one. It's a mess and it just gets worse :-( I would guess that no way does Barry's defense team want this trial delayed and they probably don't want a dismissal and give prosecution time to organize but that is just a wild 🤬🤬🤬 guess on my part.

Defense says prosecutors continue to make statements to the press and even after the motion was filed DA Stanley continued to talk to members of the media. For the record
