Can’t wait to hear what “the issue” is. Hope someone takes shorthand.

So she goes on a bike ride in an area she would never go, forgets items that she always take, and never turns her phone on that Mother's Day?

Some predator then kidnaps Suzanne, enters her car, leaves her purse, stages her bicycle, dumps her helmet, forces Barry to lie about when he woke up, puts Barry outside when he should have been sleeping, puts Barry in the vicinity of the bike, shuts down Suzanne’s phone at the precise moment Barry needed it to, forces Barry to chase elk towards the helmet location, forces him to dump 5 bags of trash, forces him to lie about working, forces him to lie about where he was when he got that call, forces him to lie about the state of their marriage, and Suzanne wanting a divorce?

He causes Suzanne’s footprint to cease to exist on that afternoon, puts Barry’s phone on airplane mode, disappears her journal, and scratches Barry’s arms?

And this is all based on a DNA sample with "limited genetic material" found in a vehicle unrelated to this?

"Limited genetic material." Can you point me to where that is in the testimony? Or who said it. Thanks

well this is just gunna suck reminds me of court PF style

I think that at worst, the Trial will be like that. Today however, the judge has banned phones and computers from the courtroom completely. In the Frazee trial reporters could compose all their tweets, but were not allowed to transmit them from the courtroom.

Makes you wonder if someone sets out to do this on purpose? Or are they just that stupid?

Judge orders prosecution to release documents in Barry Morphew murder case

The new judge presiding over Barry Morphew's murder case on Monday ordered the prosecution to turn over all police reports and videos from the 20-month-long investigation to the defense.

Morphew's attorneys argued during the first day of a two-day hearing that the prosecution has not handed over evidence in a timely manner.

11th Judicial District Judge Ramsey Lama also said prosecutors must turn over any internal affairs and resignation materials involving a Colorado Bureau of Investigation agent who stepped down after a dicey evidence hearing in August.

According to information divulged in court hearings, the glove box DNA was a mixed partial profile of three people, including Suzanne Morphew, one of the Morphew daughters and a third profile, which has markers similar to three profiles found in three sex assault cases in Arizona and Chicago through the Combined DNA Index System.

It's unclear to whom the profiles belong, whether there is enough of a profile to identify a close match or whether the profiles have been thoroughly investigated. The defense team said Barry Morphew's DNA has been excluded from the glove box sample; however, the touch profile was not found anywhere else but on the glove box.
If should say "limited genetic data."

Cahill says a forensic scientist told him in December that the glove box sample had "limited genetic data." Cahill says he didn't clarify with the scientist what that means.

Not clarifying what that means is negligent for sure.
But in the end its a random touch sample in one unrelated place.

So they do not know the identity of the RR dash (forensic) sample.
And even though it was degraded sample they were able to run it in CODIS.
The sample turned up no identity for the dash sample contributor, but a "partial match" came up. An unidentified male who is a relative, to the dash contributor and left DNA evidence at 3 sex assaults in Arizona.

If you are religious person you better say alittle prayer that this thing even gets to trial :-(
None of the discovery problems are incurable and there is no evidence of willful misconduct by any investigative agency or the DA's office. None of the issues we know of will result in dismissal of the case before trial.

For those wondering the Webex was hacked in the #BarryMorphew case and was being broadcasted on YouTube which is against the court orders… no electronics are allowed inside the courtroom now.

I'm recalling Patrick Murphy banning public WebEx from his court except for advisements and arraignments (i.e., per statute) and where he personally controlled Webex in his courtroom --who was in/out. He would not entertain any exception here so he could concentrate on the hearing. There's something to be said about his order.

And that's the issue, and something the defense can capitalize on to a degree.

A sample with a limited amount of genetic data, that can never be matched to one particular person, so they can't be alibied.

I hope this was not done in order to create even more distractions in this case.
That is the point. Its one of the prongs of the defense attack, destroy police credibility.
And that's the issue, and something the defense can capitalize on to a degree.

A sample with a limited amount of genetic data, that can never be matched to one particular person, so they can't be alibied.

Wow. All these detectives needed to do is actually work together and sort their cse properly, letting the defense extract the whole truth from them is a bad look.
