I think JL is lying. I'm pretty sure they had some video sexy time and when Barry texted he was on the way home, they disconnected and she headed for the shower. JL is trying to protect Suzanne's honor, I think.

I think JL knows exactly what "conversations" they had that day. "Don't think" sounds a lot like "I can't bring myself to say." Barry killed Suzanne but I'm sure JL, in addition to the damage he did to his own marriage, didn't want to acknowledge what happened just before Suzanne was murdered. And may have been the trigger.

I'm curious about his message that went unanswered. About the weather. Was it coded (to see if she was alone and could talk) or if he had actually looked up the weather, because he knew Suzanne was preparing for her bike ride. How would he know? Because Suzanne may have been in her closet on wa getting her biking clothes ready...

Between 11:42 and 2:40... they exchanged 59 communications, IMO across multiple platforms..

IMO if Suzanne hadn't been murdered, they would have continued communicating right up until her bike ride, perhaps alternating platforms all day.

I get the feeling he answered LE's questions but stopped short of volunteering anything he didn't have to.

I wonder where the mini camera was.

I'm positive it was in play.

A married mutual friend of Barry and Suzanne from Indiana.

She visited Barry in Colorado and secretly recorded him. Being the classy guy that he is, Barry proceeded to put the moves on her.
Thank you! I've been out the loop.

Thought the same as you when I read JLs how's the weather message being code, as in...is Barry around?
He knew exactly how the weather was.
They'd been texting all day and the LPOL photo shows her in a bikini.

JL did some questionable indefensible things but I don’t think he’s lying here.
FBI first spoke to him by phone on November 4
They interviewed him in person on November 13
December 18 by phone they showed him the results of LinkedIn messages and photos.
This is when they asked about WhatsApp.
FBI knew plenty by then even that they had exchanged nude photos.
They were trying to pin down her last proof of life and last communication.

2:11 SM to JL ‘ I’m on wa”
2:39 JL responded to that message on LinkedIn
2:46 JL again responded to that message on LinkedIn
2:47 JL responded again to that message on LinkedIn by saying “ your weather looks nice”

I think JL was sitting there waiting for her to get on WA.

SM never responded to him again after 2:11

And at 2:26 BM texted SM “ Done headed back “
2:31 BM texted SM “ Did you leave?”

The act of asking another person to share "their testimony" is out of line entirely. It is that person's discretion about when, where and to whom that is in order. Barry didn't even grant Suzanne the humanity or spiritual authority to exercise that act of her own accord. Selfish, and self-serving on every level.
I said something somewhat related earlier about how IF Suzanne was moving away from the church that would be her business and only her own business.
Barry commanding Suzanne to share her 'testimony' in front of his cousin and his wife was utterly demeaning. I think he was more interested in showing his authority over her much more than her sharing anything. His cousin, after all, had distanced himself from his childhood-long 'teachings' which he felt were oppressive. Barry was simply flexing his muscles, IMO.

  • #467
Maybe SM used her discretion, maybe she didn't, really have no idea.
Statements from friends and family did mention her habit of attending or streaming church services and involvement in Bible studies.
Well, that's not how Barry's cousin described it. The DB article was a sorely needed breath of fresh air.

So you think JL went on wa but Suzanne never did? In my mind, she went on wa and he either did or didn't, but that's an interesting thought -- and then, when she didn't connect, he makes his weather statement.

Hmmmm.

Then what was Suzanne doing between 2:11 and 2:45? (My impression was that she had already accessed her wa, not that she would do so.)

Wish we could figure out where she was during that half hour. Inside, outside, upstairs, downstairs, laundry room, shower, closet, bedroom, etc.

It's disconcerting to know that she believed she had her whole day/weekend/life ahead of her, when she only had minutes left...

I think the charge (M1) is spot on. When Barry jumped out of his truck, not even shutting the door, he had one end game in mind. Premeditation only requires a moment, the presence of mind and span of time to consider and continue. 2:44, 2:45, 2:46, 2:47....

IMO that alone explains why it's not a lesser charge.

The bathing suit she was wearing in the proof of life photo was hanging up. That tells me she almost certainly wasn't murdered while wearing it.

If she wasn't wearing it when she was murdered, then she must have already taken it off and hung it back up.

I think she changed during that time.

Well, that's not how Barry's cousin described it. The DB article was a sorely needed breath of fresh air.

I watched an interview of her stepbrother TO and he mentioned her faith being important to her and there was a sense of an authenticity in her life reflecting her beliefs.

Barry's cousin's beliefs are admittedly not those of Suzanne's so his description is coming from his worldview, too.

Opinions can vary even when two people experience the same set of events.

ETA
The testimony BMs cousin referenced is one many who knew SM said she spoke of
often...

A question that has seen nagging me is, what would have happened if Barry had caught Suzanne with JL?
RSBM
He would have killed both of them.

SM sent her sunbathing pic at 2:03
Then “ I’m on wa” at 2:11
BM texted her “ headed home” at 2:26 - just 15 minutes later.
If she wasn’t already in the bedroom or bathroom about to video chat, I think she hurried inside with news of BM coming home. She had to switch gears. Maybe jump in the shower to avoid seeing or talking to BM. Or at least charge clothes.
Swimsuit was in the closet, but brown towel missing.
Maybe she thought she could change clothes and take a drive and she would get back to JL then. Her purse was already in the car .
I just don’t think she had time to get on WA.

I agree with you and don’t think JL is lying here either. However, the timeline you outline brings into play (once again for me), the possibility of an accomplice.

I wonder what was happening with SM in the home after 2:11pm. SM stopped all communication with JL and BM after 2:11pm. As you pointed out, seems JL was waiting around for a response, just as BM was.

Now, at first I thought SM could have been showering from 2:11p until BM got home and that is why she didn’t respond, but JL’s text messages in particular, lead one to believe that was not the case because he was reaching out to her and getting no response. If she had gotten into the shower, or had been doing anything else, you would think she would have let JL know, or she would have responded to his texts after a few minutes (especially because they had been texting heavily up to that point that day). He even resorted to using what appears to be their coded text message relating to the weather and got no response from her.

I feel something happened as of 2:11pm and before BM got home. That’s about a 30 minute window.

MOO…per BM’s somewhat sloppy planning, I wonder if there wasn’t an accomplice that had breached the house before BM got there and refrained SM. This same accomplice could have been the one to crack the MB door frame and tranq her, thus doing the dirty work for BM.

I could see part of BM’s plan including being away from the house while his accomplice begins their plan against SM. Then BM would send out a string of texts to SM to normalize his alibi while he was away from the home. This way LE could see he was trying to reach her.

This removes BM from the scene occurring at the home between 2:11p and the time he got home.

However, it doesn’t entirely sync with BM’s actions in the minutes after he got home, but for me, there is that slight possibility he could have had an accomplice at the house during this timeframe. Then they both went about the rest of the plan once BM got home of cleaning up, staging, transporting and discarding the body. Just MOO.

Also, I strongly feel that BM’s text ‘Did you leave?’ was in reference to her afternoon bike ride. Even though he told LE she would bike in the morning, in actuality, I feel he knew (just as almost everyone else interviewed did as well) she rides in the afternoons. Therefore, I feel he was referring to her afternoon bike ride with that particular text message and it was a slip up. At no point in the AA did BM say he was expecting SM to go out Saturday afternoon, so why would he be asking if she left to go somewhere? The only known outing she did in the afternoons apparently, were her bike rides. All IMO.

I have been bothered by the text messages and assigned times also not only on the 9th but starting around the 6th. I am bothered by her purse left in the car. I wonder if she took her bike off her vehicle and put it back on everyday. Lotsa questions.

Right. But, "I'm on WA" is the end of that conversation.

Big chunk of text:

Q Lindsey: The question was the string of LinkedIn messages at 2:05, 2:04 into 2:05.

A Harris: Yes. Yeah, there’s a couple more, “Fine with me,” at 14:05:01, “Thank you, babe,” at 14:05:13. “I’m just in love with you,” at 14:05:20.

THE COURT: Can you — I don’t know who these texts are coming from and going to.

THE WITNESS: These are all from Suzanne to Jeff.

THE COURT: Okay, you said there was one that said, “Thank you, babe,” and then the next one —

THE WITNESS: Yes, sorry. “I’m just in love with you.” That one is at 14:05:20. Then one last one that’s in the 14:05:46 is “Whatcha up to?”

BY MR. LINDSEY:

Q Lindsey: I’m sorry, you talked a little bit down into the —

A Harris: Sorry.

Q Lindsey: I didn’t hear what you said that last one was.

A Harris: “Whatcha up to?” is at 14:05:46. Whatcha is spelled w-h-a-t-c-h-a.

Q Lindsey: Okay. Is there more messages in between Suzanne and Mr. Libler in that afternoon?

A Harris: Yes, Jeff responds at 14:06:03.

Q Lindsey: Okay, what’s his response?

A Harris: That he was — I don’t know if this is a quote — that he was cleaning up outside and that his wife just went to Costco and his daughter went running. He — that’s supposed to be a summary. He then asked, “Want to strip down and get naked? LOL??”

Q Lindsey: And that’s a message from Mr. Libler —

A Harris: From Jeff to Suzanne —

Q Lindsey: — to Suzanne —

A Harris: — at 14:06:03.

Q Lindsey: Communication continue on?

A Harris: It does Suzanne responds, “Oh man!!”, with two exclamation points at 14:07:30. And then Suzanne responds again “Can you talk??”, with two question marks at 14:07:38. Then Suzanne has two more responses “Or video?”, at 14:07:44. Then she says “I can load up WA!”, at 14:08:02.

Q Lindsey: And what do you understand WA to mean from your investigation in this case?

A Harris: The application WhatsApp.

Q Lindsey: What time was that message on LinkedIn?

A Harris: 14:08:02.

Q Lindsey: Okay. Are there any more messages from Suzanne —

A Harris: Yes.

Q Lindsey: — to Mr. Libler, or vice versa?

A Harris: Yes. Jeff responds — I don’t have the specific time for this but he’s got to check on his kids and see whether he’s able to. Then Suzanne responds with just the word written out, “Okay!”, o-k-a-y at 14:11:21. Then Suzanne also responds, “I’m on WA,” at 14:11:25.

So, you see where I came to the conclusion that they did have video sex before Barry got home.

This meshes with my impression.

I think Suzanne was ready on wa but JL may not have joined her. She probably waited a bit, then figured he was busy with his kids.

2:10ish. Where was Barry? Perhaps Suzanne was underdressed for a wa conversation that never happened and moved into the range of the mini camera...

Where was that camera???? Was it in the bonus room like she thought?

And what device did Suzanne use for wa? The proof of life photo was with her phone, right? "Loading up wa" -- doesn't that sound like "on another device"?

I really think she was away from her phone beyond 2:11...

Did Barry think he was going to catch Suzanne at home with someone? Or was he "seeing" her setting up a device and he wasn't happy with what she wasn't wearing?

After 2:11... how long would she wait for JL, before hanging up her bikini, perhaps showering?

Was her bedroom door locked, just as a modesty/privacy habit or was it locked in panic? Was she in the shower when he barreled through the door? Or in the closet?

It's the stuff of nightmares. Only scarier.

JMO
I think the spy camera was most likely in SM's closet where she retreated for privacy including nude selfies. I've long believed he took down the trail cams on Saturday prior to greeting SM and leaving again -- probably even taunted SM that he took them down, well knowing he had spy camera in place. IMO, BM broke down that bedroom door to confront SM about what he saw on the spy camera. BM was in a rage when he arrived PP. JMO

Oh okay, gotcha.
I was just looking at the timing of the messages in the AA.
SM says “ I’m on WA” at 2:11
Then it says that JL sent “ 3 response messages “ at 2:39, 2:47 and 2:48 which went unanswered by SM.
So that sounded like he never heard from her after 2:11.

I don’t know much about WhatsApp except your messages and videos automatically delete unless you set them to not delete.
I’m sure SM and JL made sure theirs deleted, otherwise LE would have been able to retrieve them.

So from the 2:11 “ I’m on wa” message until the first of JL’s responses at 2:39 is 28 minutes.

And BM got home by 2:43.

Do you think BM walked in on something?

JMO

She may have been in the shower.
She'd been out in the sun and might have wanted a shower for w/a or to freshen up before changing into biking clothes.
One thing for sure, his phone has him at the master bedroom door for two long minutes then airplane mode.
