Because it came out in Suzanne’s texts that he would get mad and leave for days. So I am trying to think of possible alternative counter arguments for why Sunday instead of Monday as planned originally.
What part of there was no job don't you understand? He PLANNED it and asked MG to get another player in this farce.
THERE WAS NO WORK ORDER FOR SUNDAY OR MONDAY OR TUESDAY ETC.
All of it was a lame attempt to provide himself with an alibi. End of.
Why do you insist on saying the same thing over and over when it isn't true? There was no job. The GP did not issue a work order. The materials were never ordered. The bobcat was not brought to the work site.
Seriously, I'm utterly confused by your logic.

At this point, I feel we need a pep talk.

The defense is like BM: they are busy. Old saying of my late MIL: could create bother in an empty room.

The prosecution has held much close. They've got it to court. They seem disorganized, but we have no way of knowing if that is how they intend to appear. They aren't giving away the farm.

Everything is there to prove that this is no one but BM.

I hear ya! Me, myself and I, are without even a minuscule of doubt, absolutely convinced that BM killed beautiful Suzanne. Now, whether or not the prosecution can knock this out of the park….I don’t know. What I do think is, that if @MassGuy and @Megnut were prosecuting this case, it would be a “slam dunk.” Especially if they had ALL the information the DA has. The prosecution would do well to retain them as consultants! :p:D So many times when I read posts here I think, gee, I wish the DA and his prosecutors were reading these threads. :). Many threads back Megnut laid out how she would present the evidence to ensure jurors could put all the pieces together. I hope they have the same methodical plan to present before the court. JMHO.

Dateline IMO has always been pablum.
The show is simplistic and meant to be sensational and entertaining
Last night’s episode was no different.

I did love the glimpse into BM’s enabling sister and marvel that she thinks her interview was a good look. TS, BM’s staunch defender /friend has been defending BM like it’s his job all over the internet. Not defending effectively but I have to admire his loyalty.

I actually feel sympathy for both of them

I did have to let out a cynical little chuckle when TS said
“ BM couldn’t sleep in their bed, he slept on a couch outside their bedroom. I don’t think he ever slept in that bed again “.

I know what MY thoughts are about why BM couldn’t bring himself to go in that room.

And then I guess we have an old buddy who’s seeing that as the action of an innocent grieving person.

He left out the part about BM not being allowed in the house for 10 days because it was being searched.

Yes! He asked if they found “ the “ phone when they called him to tell him they found the bike.
I remember it vividly. Not, "Did you find my wife? Where is she? We need to find her!". Nope. Mountain lion, bike, phone and that's it. Then he goes and touches the bike with his buddy GD.

When you think of one, don't forget to factor in that he lied to the Ritters about where he was when he got that phone call, and lied to everyone about what he did that day (back and forth from the hotel to the worksite, when he really went there once).

I agree. All in all, it’s going pretty well. For all the talk of withholding evidence from the defense, the judge has issued no sanctions. The defense continues to ask for dismissal of charges at each hearing, but the judge never dismisses the charges. And the best part is that Barry is still charged with first degree murder!

Don’t you think these are all good things?

Yes, what a LOAD of carp! Had he actually believed she went missing from where they found the bike, one would think he would want to sleep in the bed they shared. No, no. He knows what he did to her and where. What little conscience he has wouldn’t allow him to sleep in there.

Okay, I'll play. If BM broke her phone and then left SM home alone but otherwise uninjured on the day that:

1) her girls are traveling home from a long distance away,

and

2) her BFF's daughter is getting married and SM had plans to participate virtually --

There is no way SM would just shrug and go about her day, including her daily bike ride. None. If SM has a laptop or tablet, she's emailing people (maybe not JL but SO and others) to explain her lack of phone/text replies. If she doesn't, she's driving to a friend's house to borrow a phone or computer to watch the wedding. I don't know if any stores in Salida or even Gunnison would be open on Sundays (esp. early in the pandemic) but if they were she'd be driving there to buy a new phone.

The only way she is passively doing NOTHING to communicate with others that day is because she is dead or at a minimum incapacitated.

The reality is that most criminal defendants in the U.S. are represented by court appointed attorneys. Many of those attorneys do not make a lot of money. The really good and experienced public defenders do their job because they believe in the system and understand their role. They are not usually in it for the money.

I am not sure how you would operate a system wherein only the "innocent" people get attorneys. Who gets to determine when the state charges someone with a crime if they are innocent?

Sometimes the state gets it wrong and an innocent person is charged with a crime they did not commit. Our system relies on the counsel of criminal defendant's protecting their clients from such injustices.

It is a huge task for criminal defense attorneys. However, it is hard to do if the person accussed does not have an attorney representing them.

IMO our adverserial system is the best out there and it relies on quality representation for criminal defendants to actually work.

My father was a very well respected defense attorney and he had a lot of integrity.

I remember asking him , when I was young, about WHY he defended some of his criminal clients. He told me several times over the years, that our Justice System is one of the finest in the world because we have certain ethical precepts----like Presumed Innocence and other things.

He would tell me that in order for our system to work, EVERY defendant needs to have access to a competent and aggressive defense counsel. Otherwise our system would eventually collapse.

Except there is a huge difference between pontificating about a criminal cases on an internet BBS or Reddit and actually trying a criminal case to a jury. Things like the rules of evidence, jury instructions and only being able to argue facts which are in evidence apply in jury trials....not so much on the internet....IMO.

Without certain evidence, this has always been a tough case for the state....IMO.

If you read my post accurately you would see I said the prosecution should hire them as consultants, not try the case. It was somewhat in jest. Can’t you play along and have a little chuckle once in awhile??

Impossible. They had a "perfect night," and didn't touch their phones or look at the clock. Then they ate two steaks off two plates, one steak off two plates, and one steak off one plate.

Then they made love and went to sleep, and Barry awoke to his alarm clock, then didn't awake to his alarm clock.

Then Barry left the house and drove straight to Broomfield, then left the house and turned left, in the opposite direction.

Or something.

The only reasonable argument I can think of is they were fighting that night and Barry took off like he had before. I do think he planned to go to Broomfield and work on the wall just not Sunday. He would never admit they were fighting and now he really can’t admit that.
So they were fighting that night, and so he took off. And then , coincidentally, she went bike riding the next day and a sexual predator kidnapped her? And he dumped her bike and then somehow found her RR and went into her glove box?

So Barry didn't want to admit they were fighting, so he told a big long story about them eating a steak dinner on one plate and having sex, and she had an orgasm, like always, then she sent to sleep, like a lump on a log?

Exactly. After my Father passed away, my Mom didn't want to sell their big house because she couldn't bare to sleep anywhere else. She loved being in the room they had shared for so many years. She was 87 and couldn't take care of that house all by herself, but it was very hard for her to leave.

Then we hear that Barry couldn't bring himself to sleep in the room he and his wife used to share together. Why not?

If the state in this case hired consultants who were true crime fans and internet posters for help in a no-body, 1st degree murder case I would actually probably cry.

IMO the victim and her family deserve to have top-notch advocates who know how to try murder cases and get justice for vicitms. That is a very serious and important endeavor in this case...IMO.

This goes to his monstrous ego, and lack of self awareness. Just bizarre.

Barry was told that Suzanne confided in friends that sex with him was not pleasurable, then reminded that he put "Sex" as the top reasori on his victimology questionnaire for someone's motive for her disappearance. Barry refuted that by saying, "She had an orgasm every time, so I don't understand that."

Exactly. IF BM had broken Suzanne’s phone and she needed a new one she could’ve easily driven her RR to the Salida Walmart on Sunday morning, which was open 7-days a week through the entire pandemic, purchased and activated a new phone. But sadly she didn’t because she was already dead.
