For me I need a tighter connection from the sheath to the function....what did they find in the garage? Did they find additional syringes with the same sheath? Did they find any vehicle for loading chemicals into the dart? What did Barry say he threw away....if he said the chemicals that still leaves a question of what the sheath actually covered and where's the remainder of what the sheath covered and why does the sheath not have his dna and what role does it play. It's a pretty unique thing but prosecution still needs to connect it somehow. I don't think the vet was important without being able to explain what part the needle sheath actually plays. I think most jurors can understand that tranquillizers chemicals used for large animals could have the same affect or even death on a small woman.
As a circumstantial case...the prosecution dare not paint itself into a corner...i.e finding a piece of evidence "hill to die on", such as the syringe. They should focus on the pattern and volume of evidence which separates and isolates Barry Morphew from all other possibilities. No one piece of evidence in this case is the absolute game changer, imo. Some pieces are the key ingredients to be sure, such as the telematics, the trash runs, the verified lies, etc....Maybe the syringe falls into that category...but, to me, it is value-added. The patterns and volumes of evidence point to one specific suspect in a tangible way. That is the foundation of the case which I believe the prosecution should stick with.

I agree for the most part....I hope prosecution has gone back and looked at their vulnerabilities and the context of any Barry mentions in context of the entire conversation....in my mind defense is looking for those vulnerabilities...so prosecution should be also.

I hope the judge holds the defense to playing all 4 40 hours of Barry's conversations with LE.

And I'd hope the judge would give the defense full credit. And by credit, I mean blame. For the tedium.

The jury would grow weary of him, but they'd get to judge his credibility for themselves. (Which is precisely why IMO the defense will never play those tapes. Nothing is more damaging to the defense than the defendant's own mouth.)

Mountain liar.

What's that court instruction? -- false in one thing, false in everything.

Why lie? Because the truth hurts.

I pray that the trial stays grounded in truth. Suzanne deserves that.

I don't know if that will be good for prosecution honestly but I think it's going to happen.

I assumed defense has a team that has listened to every audio interview with BM and LE. IMO

But his quavering whimper needs some work.

:D It was truly pathetic that quivering whimper and pretend crying. When I watch it I cannot help but laugh and this is no laughing matter! BM is such a dufus!! JMOO

Great find @MassGuy!

It seems to me that BM's sister's recent attack on LS corresponds with chatter going on that a plethora of defense motions of the same caliber filed this week (recall my recent prediction defense would be turning up the volume for dismissal and to strike more witnesses).

However, what's most unfortunate for us is that the defense continues to prevent the public from seeing this information by including motions to Limit Public Access in their recent filings.

Typically, the public court site (Cases of Interest) includes the "Register of Actions" (ROA) for each case of interest -- usually generated and uploaded at least once a month, but since BM's arrest, there has only been one ROA (dated 3/1/22) uploaded to the public site (see link below).

Fortunately, a citizen can still request a ROA from the district court clerk in person. (A local warrior for Suzzane confirmed via Twitter) another defense motion to Limit Public Access was also filed on 4/5/22 . All MOO.

(Just, for example, in the El Paso County, Gannon Stauch case where L Stauch was arrested in 3/2020, there have been more than 45 ROA's uploaded to the public court site, versus one filed for this case). And ROA is not even the document -- just Motion number & description!

I don't.

It's that kind of voluntary blindness that builds guys like BM.

We love Colorado cases for their transparency, and the accessibility of court records.

We had the entire discovery file in Watts.

We had prompt uploads in Berreth and Stauch, to include search warrants themselves in the former.

What's happening here is infuriating.

IMO, he has fooled many people, and I believe, that is why he was talkative with agent Grusing and thought the agent was 'on his side'. BM thinks he is more persuasive than I believe he really is.

I'm not shocked that he has his entire family hoodwinked. They've spent his entire life telling him how wonderful he is.

I am a bit shocked that his sister decided to have a go at Lauren S on Twitter and I'm completely shocked everyone replying has just basically ignored the sister's comments. At this moment at least. A rare burst of decorum for Twitter.

Is this the same sister who said something to Lauren outside court? I'm guessing it is.

So the defense is busy filing all these motions, but they aren't willing to make them easily available for public viewing, unless you show up in person, do I have that right, @Seattle1?

If they had some big bombshell, something that in any way exonerates BM, it's be easily obtained online. The defense would want that information out in the public domain ASAP, imo.

A witness literally said just that, and it's clear from the AA that Barry thinks he's the smartest man in the room.

I mean, he would be, if that room was full of small children.

Totally agree but Shirley the Mom is the one I have disdain for. She perpetuated the cycle that created Barry and the sister.
This sister posting on Twitter it appears has other issues as well besides her blind loyalty.
Total hot mess and I wonder why she still has any social media accounts? It’s not helping the Defense IMO.

Same sister that approached LS at the Chaffee County Courthouse.

Yes -- just as we discussed how the defense wanted their Motion [D-17-e] Motion for Discover Sanctions & Exhibits made public!

(Reporter Ashley Franco reported on this motion day before uploaded to the public site, and where astute viewers noticed she was holding a copy of the Motion that was not obtained from the court (i.e., no court filing stamp)). See the link below.

Confirming the public can obtain the ROA in person at the Court. ROA only lists the Motion numbers, description, and date filed. Not to be confused with the actual documents.
