On Judge Lama's very first day on the Morphew case, he fell hook, line, and sinker for what became an obvious ploy by the defense to shut down information being timely transmitted to the public from the hearings. (The defense preferred leaking motions and controlling what, when, and where, information was being reported).

On Jan 24, 2022, the defense alleged in open court that a named, innocent, individual -- nowhere near the Fremont County Court-- was broadcasting the hearing live on YT.

And even after the defense's egregious allegation was proven patently false, and the Court confirmed that WebEx was NOT hacked, reporters were still prohibited from using the tools of their trade to timely keep us (the public) informed of what was happening during the hearings -- a practice that would have likely continue throughout the trial.

Just one more example of why Judge Lama needed to step down from the bench. MOO

So it was hacked then? That's what the article you posted said.

The accusation was that it was hacked.

The OP's post makes clear the judge determined it was NOT hacked. Without evidence, Judge L banned all devices on the assumption that any device could be used to livestream proceedings, which he wanted to prevent.

Nevermind that shutting all proceedings to all but those in person and making the taxpayers rely on 2nd hand notes from reporters is grossly unfair IMO - that unfairness is allowed in Colorado criminal courts.

In the 11th District Courts in CO we can expect the same in the future. And that leaves all not present at a major disadvantage when it comes to knowing and understanding both the evidence and the rulings on it.

Vigorous opinions are appreciated but twisting what was stated by citing only part of a post is not fair.

Thanks for the explanation, now I understand.

I think it was well within the Judge's authority to ban cell phones after having a private hearing broadcasted on YouTube.

This judge is not the only judge in Colorado to issue this type of decorum. I was frustrated also by the decorum order but it is not unique to this judge or this case.

I wonder if Barry and his team have any leads on finding out what happened to Suzanme. He said he went to bed at 8 on Sat night may 9 2020. Who stole his keys to his truck and drove by the bike and helmet locations? Are they searching for the partial incomplete DNA non-match that might match a crazy nomadic sex offender? Is he getting resources ready to search the mines in the area when snow melts? What a relief that he has the financial resources from selling all of Suzannes assets to help search for her?

After two years? My guess is Barry won’t be living in Chaffee County so probably wishful thinking that he will stay in the area and keep searching. If LE’s claim they might know where she is doesn’t pan out in the coming months my guess is LE will wind down expenses associated with searches but the case will remain open for awhile I think. It is also possible someday some hiker or explorer will find remains. I hope so for the families.

Yes. Even after 2 years. If a sexual predator abducted my wife, time would not impeded my determination for answers.

No, that is not what my post stated.

To be clear, on January 24, the defense was untruthful when they alleged that the hearing was being broadcast live.

After it was proven that the individual the defense falsely accused of broadcasting the hearing live did no such thing, the defense then tried to blame it on WebEx-- saying that it must have been hacked.

In response to the second allegation by the defense, Judge Lama requested the WebEx system be examined. About a week later, or Feb 1, Lama announced that the examination of the WebEx system confirmed that WebEx was NOT hacked on January 24, or any other date.

Both allegations by the defense proved to be untrue.

And Judge Lama exercised poor judgment to accept the defense's allegations as the gospel truth.

Which clearly became a pattern-- beginning with January 24 -- his first day on the case.

Then why didn't the judge reverse the ban?

Many of the motions in this case were not available for public view, so one had to discern what those motions asserted as fact from the judge's eventual order on the motions, after he'd received the prosecution's response and/or heard witnesses on the matter. Do you know if it was the same throughout the Fallis trial?
The DA would need a full time person assigned to manage the emails from from IE.
But still it's an unforced error to miss an extension on a deadline where a pattern they were warned of is emerging. Excuses don't do it after two warnings.
MOO a no body, no bio evidence case needed tighter control by the prosecution to proceed. Many noted this along the way. I hoped there was more depth of skill behind the scenes which would come out at trial.

SALIDA, Colo. (CBS4) – It was a long day of mainly confusion during motions hearing for the murder case against Barry Morphew. He awaits trial for the disappearance and murder of his wife, Suzanne.

Barry’s defense team filed numerous motions ahead of next year’s trial date in an effort to have the case thrown out.


On Tuesday, a number of those motions were expected to be addressed by Judge Patrick Murphy, but discussions from prosecutors on relevancy of some of the arguments presented, followed by long-winded explanations from the defense, ate up more time than the judge anticipated.


Judge Murphy said the motions hearing would have to continue another day.

The judge wanted to address the motion regarding discovery violations, violations of a court order to limit pre-trial publicity, a second case involving a lawsuit filed by Barry Morphew’s attorneys against nearly everyone involved in the investigation, in addition to other items, but was only found time to address one motion.

“I’d like to have something productive come out of this hearing,” Murphy told the court at one point.


The judge, going just past his 5 p.m. cut off time Tuesday, asked the defense for a specific list of missing items and ordered both sides to meet for clarification on the issues that need to be addressed.

Murphy was briefly able to comment on the issue of pre-trial publicity. While the defense alleges the prosecution crossed a line, the judge said it would have to wait for Dec. 14 at 1 p.m.
Wasting the other sides time is a primary tactic and not surprising.
The DA barely complained at the first day of PH when the balance of time was overrun by the defense.

That’s a good question since IT WAS NEVER HACKED BY ANYONE AT ANYTIME.

Terminology hacked or broadcast doesn’t really matter. If it was broadcast in any form by any means it was contempt of court and the judge decided to stop that activity from occurring going forward.

Yes and it would be very interesting to know what the PI uncovered that BM stated he hired and then what the PI uncovered that was hired by the defense. I know the prosecution has no right to this information. But if any info was uncovered that pointed away from BM surely it would have been “leaked”. Maybe Iris will share that info on GMA. IMO

You are correct @rainbowshummingbird there was no hacking or broadcasting from the court ever found. A site that claimed to have it live streamed was posted here and deleted. The site was some bogus clickbait - it did not have the proceeding. IIRC

Thank you. I’m not sure why all of this “misinformation/disinformation” is being posted here about the disproven hack.

It was “too soon” and now it’s “too late”. BM had no need to look for her he already knew where she was. His only concern right now is that the mountain may give up his secret.
