What newbies may appreciate seeing, too, is the photo of Barry moving his stuff to CO from IN. Remember he buried the sofa and items in the yard. They bought all new stuff for the Puma Path home but he loaded his trailer down with stuff, his safe, his antlers, and the interior of his truck was unreal. Suzanne was so embarrassed. Maybe someone can post that photo, too.
Here you go!

Last week, shortly after SM's remains were reported recovered, IE issued two statements to the media on the same day.

In her second statement sent to MSM linked below, not only did IE double down about her innocent, persecuted, client being wrongfully re-accused, but she also went "classic IE" by intentionally putting out false, self-serving information to the public --alleging a second body was found last weekend in Saguache County, and promising authorities would be issuing details the next day.

IMO, this is a perfect example of IE manipulating the details of an investigation and not unlike what we witnessed IE pull off in Court -- especially with Judge Lama. IMO, it's also what she does in the 185-page Civil Rights Complaint BM filed against 26 defendants who are mostly from Chaffee County.

[..]

The statement released on Thursday by EyTan Law Firm on behalf of Barry Morphew :

“The first and most important focus should be that the Morphew’s just learned that they lost their beautiful mother and wife after she disappeared 3 ½ years ago.

What appears to be the overriding focus is a finger pointing right back where it started 3 ½ years ago: a movement to blindly re-accuse Barry for Suzanne’s death.

[..]

Here are the facts.

[..]

What needs to be done instead of pointing fingers at Barry Morphew, is asking the officials about the number of missing people and number of human remains that have been recovered in or from Saguache County in the recent past.

Whatever happened to Krystal Reisinger, Edna Quintana, Suzanne, the man whose remains were found by Saguache County Sheriff’s office in the foothills on July 26, 2023, or the remains of the person found in another area in Saguache County last weekend (more info to come from authorities tomorrow). What were the circumstances of their disappearances, what is cause and manner of death of the remains found in the area, what happened to them, are they looking for other remains in this area?

The public should demand answers about these five people who suspiciously went missing or were found dead in this area.

_______________________________________

To be clear, there's been no confirmation whatsoever that remains of another person were found last weekend in Saguache County, just as there was NO information the next day from authorities!

Some may recall that on the same day as IE's news releases, the Denver Gazette (Carol McKinley) first reported there was a second body before deleting the statement from their report hours later. And it wouldn't be the first time McKinley didn't fact-check IE as her source!

I dunno.... It just does my head in that this behavior goes unchecked, and that IE is not held accountable. JMO o_O

You think she was in the home until he moved her, and then proceeded to stage the scene with her bike?

jmo
Pretty much. Sometime between her last message to Jeff on Saturday afternoon and the "left turn, oh look, shiny herd of elk!" early Sunday morning is when he removed her body from the house & staged her bike and helmet. Really, it's the only time he could have done it before it all blew up and so much attention was on him and the case.

The move by 11th Judicial District Attorney Linda Stanley comes after the judge presiding in the case blocked the prosecution from using most of its expert witnesses at trial as punishment for violating discovery rules

Barry Morphew’s defense attorney, Iris Eytan, argued in court Tuesday that the case should be dismissed with prejudice so that it could not be refiled. She said Stanley was acting in bad faith and dismissing the case to avoid the steep sanctions over the discovery violations. She accused the prosecution of “judge shopping.”

“They’re going to try this case again, they’re going to evade the court’s ruling,” Eytan argued in court.

Lama rejected that argument, saying he did not find bad faith and that it was reasonable for the prosecution to reassess their case after he limited their expert witnesses.

Second, when this case was filed it was mainly premised on the Defendant’s motive to harm the victim, his sole access to the victim at the exact time she was last communicating with anyone by phone, and his consistent dishonesty with law enforcement, which came to light given the truck telematics, phone, and location data recovered. The Court functionally excluded the People’s best evidence to move forward in this case by severely limiting our expert’s testimony. Even if the Court were to partially reconsider its position on the need for such severe sanctions at this late hour, the People would still be left without several key expert witnesses initially endorsed. Without this crucial evidence, and without the victim’s body, the People cannot move forward at this time in good faith. Ethics demand that prosecutors proceed to trial only in circumstances where a reasonable likelihood of success exists, which given the Court’s current rulings and the uncertainty of any further rulings, is impossible to completely ascertain. This assessment of the remaining evidence is an additional, good faith basis for this motion to dismiss without prejudice.

c. Victim’s Rights Contact The People spoke with Melinda Moorman-Baumunk, the victim’s sister and primary representative for the Moorman family. Ms. Moorman-Maumunk relayed her agreement with the motion to dismiss, and expressed her wishes that we ultimately resolve absolutely whether or not her sister is dead, prior to further prosecution. The People also spoke with Andrew and David Moorman, the victim’s brothers, they are also in agreement with this motion. For obvious reasons, the People have not endeavored to speak with Macy or Mallory Morphew, but would be happy to hear their position in Court.

Barry, arriving on scene that Sunday, I've been up in Denver, big job, all day....

Yeah, no.

Dumping evidence, cleaning tools, staging tools, showering, waiting for the bike to be found...

Barry's first biggest mistake -- revealing his awareness of a crime before anyone else knew there was one.

Glaring.
I agree Megnut! When Barry lied on the phone during his stay at HIE about his whereabouts BEFORE Suzanne was actually known to be “missing“, to me, this was one of the clearest indicators of his guilt.

Arrest Affidavit (p.5) states that BM introduced SM to mountain biking about "a month ago." So, it would seem logical that her bike might have been fairly new - hence possibly explaining some of the unknown DNA (of the merchant or its employees). Their DNA should be checked. 1

The civil complaint states:

684. The result of the K-9 search of Barry’s truck at the impound lot corroborates the lack of Suzanne’s DNA found in Barry’s truck. 2

But, according to this timeline:

"Thursday, May 7: Suzanne and Libler texted a lot that day. Barry and Suzanne have pizza 3 and look at houses around town 4. She described the evening to Libler later as “a fine quiet night.”

So, maybe I'm not fully understanding but the timeline seems to indicate that they went out - they drove. So, who drove? 5 Because if he drove, isn't it just as strange that her DNA was not found in his truck? 6

^ f.n. vr intro'd to help organize my thinking(!)... ^
1
IIRC, did not SM mention to JL that she'd "just broken her first chain"?
Hence, the bike's right back into the shop for repair, adjustments, and servicing mechanic's DNA.

2
No shocker here, as BM would have bleached-out every reachable portion of his truck well before impound.
Plenty of opportunity during his alibi-odyssey... to include that secluded, protracted rest stop behind the males' wear-all house.

3

IIRC again, did not our own compatriots suggest that the pizza banquet was catered - read take-out - and enjoyed in Barry's livery? (Now, why am I unable to shake the imagery of spaghetti, lady and a tramp from my thinking ??)

4

Yes. This was part of husband's "civility" breaking through, deluding wifee into the fiction that their residences would soon be separate. Evidential 'malice aforethought', should one require more...

5

Now a Candor/Veracity check-up for each & all:
Focusing on exclusively local travel, apart from dropping-off your husband from your own car, and apart from him having multiple limbs encased in plaster, (or perhaps wearing that "Hike Safe" rig you may have read about earlier)...
...now apart from these or like circumstances:
How often does your husband ride shotgun beside you?

Now move along; nothing sexist to see here...
6
Kindly refer to 2, above.

All the above replete w/hypothesis, opinion and recollection.

Thank you. Dropping opinions here.

The wall redo has a long history that didn't end when Barry visited the site that fateful Sunday. His company didn't fix the aesthetics so the original Project Manager, a friend of Barry's, had to hire another company to complete the wall properly. There is no shame in BM.

It is a relief to have documented evidence suggesting premeditation. I've always held that Barry hoped the move to CO would kill Suzanne due to the sheer loneliness factor when coupled with her illness that flared just prior to the move. I don't mind being the only one who feels Barry wanted her dead for a while. Study the background of dates of her inheritance and their moves, how and when he sold homes and bought property, etal.

Barry and Suzanne were barely speaking for a year and a half before the week leading to her death. This is critical to understanding how distant the couple had become.
Agree!

The question is how why did the prosecution blow off three warnings on discovery?
Barry is a lucky guy.

Thank you for this post! I hope the next judge can see through her.

Hi All, a few pics of site Suzanne was supposedly found at. I didn't feel i should drive in. This was Saturday. Did not see any signs of LE activity.

I can see why he dumped her body here. The sheer size of nothing but scrub and sky is awesome, humbling and oppressive, like looking for a needle in 10,000 haystacks. Unbelievable Suzanne was found.

Yep. Unused, unfenced, plain ole plain as my dad would have said. When I think about what hunters know about the land and how long it takes for a body to be disappeared by wildlife, it's chilling but starts to make sense. Regular deer and elk hunters in particular.
