Found Deceased CO - Suzanne Morphew, 49, Chaffee Co, 10 May 2020 *Case dismissed w/o prejudice* #109

Hi All, a few pics of site Suzanne was supposedly found at. I didn't feel i should drive in. This was Saturday. Did not see any signs of LE activity.
Thanks for the pics @NoSI. It was very thoughtful for you to take those to give us a closer 'eye' to the location. I hate to think of Suzanne having been out there all alone these years, but am so thankful she was found.

Ole' BM is probably sweating bullets and looking over his shoulder right now. Iris E. is probably seeing her dream of a multi million dollar law suite circle the crapper like the tidy bowl man. Ahhhh, good times.

It's good to see you back posting here on this case, you did so much for us last time. :)
 
Actually, the job was scheduled at the customer’s insistence the prior mid-week to start on Monday. Barry moved the travel to Sunday (paraphrased) “so the team could get an early start on Monday and so I could take measurements and order materials Sunday.”

Of course, we all know the REAL reason he moved it to Monday.
I recall that BM was forced to redo the wall but I don't know that it was scheduled for that Monday. Did I miss that somewhere? Thanks
 
All MOO .... there was nothing wrong with the jacket. He had to get rid of the camouflage jacket because he was probs wearing it whilst digging on Saturday night.
On alibi day he had lots of showers because he had to get rid of any trace of soil on him.
Here’s hoping plant and soil particles from the gravesite were/will be recovered on the camo jacket. IMO
 
Another question, could IE file a motion to dismiss at this time or would she (BM) be made to pay all attorneys fees?

A plaintiff can withdraw a suit at any time (with or without prejudice) but for the defendants to receive attorney's fees, they would have to file a counterclaim for damages.

However, civil rights violation cases filed in federal court are complicated -- you can sue for anything alleging your civil rights violated but unlike prevailing at trial where the law provides for damages which include reasonable attorney fees, I think it's probably spending good dollars after bad to chase fees at this stage.

Also, except for the defendants who are also being sued both as agents and individually such as the Sheriff and DA, I think most of the defendants are being represented at the cost of the state/feds. JMO

Does anyone recall the location BM drove to in order to lie down at when he seperated from the search teams in the first days after SM’s disappearance? He had someone with him that took the picture of BM doing this because that person found it so odd.
I’m just curious to have that location mapped to see if he was able to overlook the valley where SM was found.

I have to go to work so can’t work on this, so TIA to whomever does.

IIRC it was White Pine, overlooking a cemetery.

Lauren S. did a video on-air cover and at the time did not know about the customer involvement and Monday. Everyone was led to believe the entire job was invented.

Yeah, no.

Dumping evidence, cleaning tools, staging tools, showering, waiting for the bike to be found...

Barry's first biggest mistake -- revealing his awareness of a crime before anyone else knew there was one.

Glaring.
