I've seen the picture, I'm not positive of the details other than it was Suzanne who took the photo on Friday night and sent it to the girls.

@Cindizzi - Since you're the expert on digging up info. on this (and all cases, lol) do you remember this?

I don’t recall ever seeing the actual photo and I’m pretty sure it’s not documented in the arrest affidavit. I think we heard it mentioned at the preliminary hearing.

They drove separate vehicles on Friday night. Suzanne supposedly met Barry at his job site then they stopped to pick up pizza IIRC

It was a pic Suzanne took of BM standing in line at their favorite pizza place that she then sent to the girls who were gone on their trip.

I am going to be the odd one out on this one. I must have just missed that picture. I remember talk about it - was SM the one who took it of BM or was it a selfie of both at the pizza place or eating in the car.
I want to say it was taken by SM of BM out front of the restaurant. Then sent to girls.
Since they never found Suzanne’s phone would anyone be able to confirm it was indeed taken that Fri evening?

Yes, Suzanne supposedly took it with her phone and sent it to the girls because it wasn't a selfie. I think it was her way of showing the girls that everything was okay. I think that is something Suzanne would do, ease the girls minds, especially the daughter who was still at home and seeing some conflict.

Well, well, well....are we not surprised ? Barry's goose would be cooked if this goes forward and they know it. BM would not be able to make it through all the questioning and keep his lies straight. Tick tock Barry!

Even worse, all of the people in that lawsuit know the entire case. They have information and details that have been kept under wraps. However, since they would be entitled to defend themselves in any way their own lawyers advise, they would definitely spend a *lot* of time in depositions addressing why Barry remained a suspect and why there was no violation of his civil rights.

They would get on record, in sworn statements, everything each of them knows about the case - and it might make it very hard to avoid an almost immediate set of charges against Barry, when those sworn statements wound their way over to the DA's office. In my opinion, it would likely be worse than having had the experts at trial (in terms of what the various civil defendants might say they knew or noticed). I assume they would be asked about both their official observations and capacity (in the course of their employment, dutifully doing what LEO's are supposed to do) and their personal knowledge, which could include all manner of things not allowable as evidence in the criminal case. It's not against the law for LEO's to talk to various people (and basically obtain hearsay evidence), they just can't use it in criminal court. But in civil court, it's very different.

This is why i think IE really blew it and her overweening pride got the best of her. Now she has to backtrack and subtract those incriminating witnesses from the civil trial. Not a good look for the civil judgment. To put it another way, she knows only enough civil procedure to get her and her client thoroughly in trouble. Especially if new evidence turned up - which it has. I suppose IE thought that BM was a criminal mastermind and had hidden the body where no one would ever find her. I don't believe for a second that IE thinks or thought that BM didn't do it. She could not flat out ask him "Where'd you put the body?" because she's not stupid and knows that a good criminal defense attorney would never ask that question. But a civil plaintiff's attorney very well might ask that question - right away, and expect an answer.

I'm going out on a limb here and saying I specifically remember seeing a pic of Barry standing in line at that pizza place, he was wearing a black jacket. If I'm wrong, I'll eat a whole pepperoni pizza by myself. Hah

The reason I remember it so distinctly is because at the time I thought it was strange for Suzanne to be with Barry on that Friday night. But that was when he had been working on that job where he poured the concrete (LE later dug up) and he wanted to show it Suzanne for some reason (maybe he was planning on cementing her then?) but they ended up in separate cars because I think Suzanne was afraid of being alone with Barry out there because of all his crazy texts earlier.

I think quite a few pictures may have been scrubbed from the internet, perhaps by court order. They were trying to keep the facts under wrap while they talked to a widening circle of people to see if there was independent corroboration of the timelines given by the phone(s).

It was probably difficult enough for an investigator to get the timeline clear in his mind. Since LE definitely shifted from "last proof of life" on Friday, to Saturday/chipmunk hunting time (because JL provided a new time parameter when they finally talked to him), they wanted to remove pictures that might have allowed weirdos (and others) to insert themselves in the case and say they saw either Suzanne or Barry at such and such a place. Real witnesses needed and in every case, there are people who will try and become "insiders" using even the slightest information.

The weird thing is that at the prelim, IE insisted that Suzanne took the picture of Barry at Moonlight Pizza and sent it to the girls. But it's possible that Barry had control of Suzanne's phone at that point. OTOH, there was no reason for the State to dispute that Suzanne was still alive that evening.

Lauren Scharf reported that Suzanne was at home, on LinkedIn, communicating with JL during the time of the alleged pizza run, and that Suzanne told JL, "He's gone for a bit."

She likely would have been on her laptop for that LinkenIn wifi-based communication. It's possible that Barry grabbed her phone (which would have had to be unlocked or bearing a password that he knew). I think that's farfetched too. I wonder if Suzanne's actual phone records (from their carrier) show her going to Moonlight Pizza or not. Indeed, I don't think IE said whose phone was used to send the Moonlight Pizza snapshot. She says "Suzanne sent it," but I don't recall that Suzanne's phone records were produced at the PH - were they? At any rate, Suzanne could have sent the picture via What'sApp (which would leave no trace, is my understanding). And were the girls' phone records ever presented to corroborate this? I believe one of the girls (MM1) said she received the picture - but I don't know what platform was used.

(BTW, I did find the picture, I believe, of Barry standing in line to pay for the pizza; he's looking at his phone, not at the picture taker - Moonlight Pizza was doing only delivery and pick-up outside, no cash payments, so there should be a record of him being there - but I do not personally believe Suzanne was there. Maybe they were all using What'sApp to communicate, who knows. It is not posted on an approved source, though).

Why did SM send a message "Get Hot Tub stuff" and later the Hot Tub stuff was discovered in her own RR? Doesn't make sense to me.
