Just the fact that IE is NOT a member of the 10th Circuit (UNITED STATES COURT OF APPEALS FOR THE TENTH CIRCUIT) and had to be placed on notice to make application or be struck from BM's case, is sufficient proof for me that she's all smoke and mirrors. And IE's been blind to Suzanne from day one. It's not about justice for IE, it's about winning. JMO
I wouldn't make too much of the registration issue. IE is primarily a criminal defense attorney. In recent civil case filings she is no longer identified as attorney of record. My guess is that IE's extensive knowledge of events made her invaluable in the early stage of the civil proceedings but she never intended to remain in the case. She was left on the notice of appeal by clerical mistake.

B&F is continuing as sole civil litigation counsel. It would be quite easy for IE to register in the 10th Circuit if she wanted to, but I doubt that she will. It seems obvious to me by the nature of her practice that she does not often represent clients in the 10th Circuit COA.
 
This is really getting old. Maybe it's time for the commissioners to take a look at Judge Turner's action here!
Judge Turner's action is well supported by her judicial colleagues. The commissioners are mad as heck at Stanley, who has lived down to the worst stereotype of the incompetent candidate for office who misrepresents her credentials. Voters in the 11th District are right to feel deceived and abused.

By dismissing the original civil complaint without prejudice, Domenico was expressly granting Morphew the right to file a proper complaint. As you pointed out earlier a new complaint filed at this point would face a very difficult challenge based on the statute of limitations. BM seeks to avoid that by amending his original complaint in the trial court.

The problem he faces is that by filing a notice of appeal, he has deprived Domenico of the jurisdiction (authority) to grant motions of this kind.

There are other issues he would face even if Domenico had jurisdiction, which Morphew anticipates in his motion and brief, but my guess is that Domenico won't even address these. I could be wrong, of course - JMO.
 
Don't know what they hope to achieve other than an attempt to delay another arrest.
Judge Domenico found that Chaffee Sheriffs office, FBI and prosecution had met the legal standard to make the arrest of Barry. He also found that despite Barry's claims of what he and Iris felt were misleading/not included there was still  more than enough to meet probable cause. Even a simple person like myself can see that ffs. I'm beginning to think Iris is making this a personal mission, this is no longer a professional duty, it's bordering on career suicide for her.

Morphew would much rather be proceeding with expensive and time consuming discovery than briefing the 10th Circuit to persuade them - against all likellihood - that decades of Supreme Court precedent should be overturned.

He would have some chance - not much iMO - to negotiate a cost-of-defense based settlement if he could run up the cost of multiple defendants in the discovery process.

I think that's what's going on here. I think DA Kelly will wait to see if the discovery process continues and if she can get the benefit of the depositions of Morphew that will be taken.

I remain optimistic that Kelly will file charges but she will want the best case she can have, and testimony from Morphew under oath would be a huge asset.

I think you are correct and your last couple posts thoughtful. Kelly has no need to rush into another trial attempt. BM is not a risk to society at large and can be found if the moment arrives. There were weaknesses in that first attempt at trial that she is well aware of and we the public have little knowledge of what evidence turned up at the site she was found so the stronger the case that can be built without strong challenges the better for success.

Linda Stanley, the prosecutor who oversaw Barry Morphew’s arrest in May 2021, was disbarred after a two-week disciplinary hearing.

In an 83-page ruling, the state office that regulates attorney behavior said that Stanley "did not adequately supervise prosecution of the case," made multiple extrajudicial statements to the media about the murder, which threatened to prejudice Morphew, and investigated the district judge presiding over the case without credible evidence to do so.

Three of the four counties in the 11th Judicial District — Fremont, Chaffee and Custer — filed a lawsuit against Stanley earlier this month, asking a judge to force her to return nearly $112,000 of taxpayers' money that she used to pay her legal fees.
 
Whether it is the Morphew case or the Dulos case, as mentioned above, it seems justice is slow. Sometimes it drags on so long people lose interest and so do the prosecutors. Defense lawyers know this and drag things out purposely. All the while, the perp thinks he will stay free and never be held accountable. I wonder if we will see true justice in these cases.

Yes @MassGuy ….. this does seem on brand. And I had a little jolt, as it (unfortunately) reminds me of another infamous Boulder, CO case that occurred around this time in 1996. MOO

Also, don't ever change, Carol:

Butorphanol, azaperone and medetomidine — the chemicals found in Morphew's femur, according to the report — are used by biologists, wildlife officers and hunters to anesthetize large-sized animals, such as deer, bear, moose and horses.

I am waiting.
Oh it's coming @Love Never Fails. We may feel impatient and somewhat defeated at the amount of time it's taking, but BM IS going to be rearrested and he IS going to be found guilty this time. I have no doubt about it. Just need to remind myself to be patient and let the State's Prosecution get their case air tight.

There's only one bite at the apple, and even if I don't like it one bit, I will 'not so patiently wait' until the day comes that they slap the handcuffs on ole' BM again. This time he won't be waltzing out so jovial and carefree flanked by his daughters and his lip smacking defense attorney IE.
