Found Deceased CO - Suzanne Morphew, 49, Chaffee County, 10 May 2020 #64 *ARREST*

I looked into my chrystal ball for 7-22-21 and here’s what it said:

(WARNING -PREDICTION ONLY - this a prediction of the future - it hasn’t really happened!)

“Good morning, Your Honor. if it please the Court, we represent the Defendant, Mr. Barry Morphew. Mr. Morphew wishes to advise the Court that he, the Defendant, has freely and voluntarily entered into a plea agreement with the district attorney of Chafee County whereby Mr Morphew admits to the murder of Suzzane Morphew in the second degree.
Mr. Morphew enters this plea hoping to expiate in some small way for the unimaginable harm, pain and suffering he has caused his dear daughters and the entire Morphew and Moorman families. Thank you, Your Honor.

Note the foregoing HAS NOT ACTUALLY HAPPED. IT IS ONLY A PREDICTION.

I wish I were tech savvy about cell phones. Suzanne's is intriguing. While the content, particularly the texting with her sister, is going to be quite revealing; as will be the back and forth with the friend....what happened with Suzanne's cellphone after that on Saturday, then Sunday? Can it be determined if the phone was deactivated as opposed to the battery draining, for instance (and when)? The ping data is key, of course. How about pattern of use changing? If Suzanne were at home Saturday night, and sleeping Sunday morning, as Barry would have us believe....then there should be no unusual or changing patterns of use on Suzanne's cell phone on Saturday evening or Sunday morning, imo. I am guessing that if Barry was "smart enough" to manipulate Suzanne's cellphone in order to deflect and cover up...then that manipulation itself may be detectable. I know LE has many tricks of the trade about this (forensic data) which I am clueless about...but it is a very interesting aspect.

Don’t know if you are familiar with the Dylan Redwine case (13 yr old boy killed by father MR in 2012 ). Dylan’s phone was never found, only partial remains found 7 months after disappearing. MR was just found guilty this past Friday. Here is a former FBI Special Agent who analyzed the phone data from DR and MR phones. This was near Durango CO, similar terrain to Salida. Amazing what they can find out from phone records , even if you are not using your phone. It starts at 50:00

Thank you....very informative stuff. Will be interesting to learn if and when the daughters, and possibly others, could not reach Suzanne on her phone because of her unavailability or the phone's unavailability...or both.

Data will tell us much but when you are in rural area the arc of where the phone might be is large. In one place I spend time one tower is in our time zone and one is not so our phones flip back and forth the time zones depending on which tower is being accessed. The other time zone tower is 60 miles away as the crow flies and a significantly long drive so quite a distance. It is a pain because you cannot use your phone as a wake up alarm. I haven’t looked into where the towers are located around Maysville but that info is available.

I think we’re going to learn that Suzanne’s phone went dark at some point on Saturday, and never came back online. That in and of itself would be damning, as that would mean that Suzanne never turned her phone on after Barry left the house on Sunday.

So she doesn’t even attempt to use her phone on Mother’s Day, and then goes on a bike ride.

There is simply nothing Barry could have done in that regard. Lol, good plan Barry.

I would like to know that data from phones, cars, etc. I would like to know what hard evidence that the prosecution has that says without a doubt Suzanne is deceased and I would like to know how all the admissable evidence ties to Barry committing the murder and no one else at all. After that, I guess, all the other things that lead to opinions on the motive or history are not important to me. Sad to say, sometimes we just never know why someone does what they do. You really can't get any worse than Murder 1 other than a serial killer I suppose.

How about new evidence discovered by either side?
The defense wouldn’t have to disclose new evidence (I don’t think), but the prosecution would.

I think it’s possible the prosecution came into possession of new evidence, and has yet to turn it over to the defense.

I think it would have to be relatively new, as the defense should have everything by now (there was a ruling to that effect during the last hearing).

Anything new would have to be turned over in a timely manner, and perhaps that has not happened to the defense’s satisfaction, hence this surprise hearing.

If so, could he, have turned on the phone Sunday, used it to indicate SM was alive, and then disposed/destroyed it ???

I don't think Barry is smart enough to duplicate Suzanne's pattern of use of her phone. He either turned it off...or, turned in on at times as a ruse to give the impression she was alive, imo. But her pattern of use is her own....and he won't be able to hide the anomalie of data that is developed during the 24 hour period specified in the indictment. Barry's corresponding activities during that anomalie period will be dissected to the enth degree. jmo

The one thing I would look for from the defense is a witness like the "hippie in the floppy hat" in the Jeffrey McDonald case. i.e. a witness who claims to have seen Suzanne riding on her bicycle on Sunday. That is the one thing the defense can do to boost reasonable doubt. Obviously that witness would have a credibility hurdle to jump...but that is the one trump card I am looking for the defense to play.

I have worried that they are going to try and claim that she was having an affair, and ran off with him, and that's who disappeared her...BM's mom kind of hinted at that early on, I believe.

I hope his lawyers have enough intelligence not to pursue that line of thought as there will be zero evidence to back it up.

Feeling like a request for a postponement of the prelim is going to happen on August 8th. If there was any delay in the receiving of documents by the defense, they are going to complain that there isn’t enough time for review. They will blame it on the big bad prosecution team, focusing on their poor client while the real killer goes free. Hopefully the no nonsense judge will keep this moving and all dates remain the same. Opinions and views expressed are entirely my own.

IF they are going the point the finger at anyone else the defense will have to signal their intent to do so. That is one things that they can't "spring" -- an alternate suspect -- at trial (like you used to see in the old TV shows).

They can only do so if it is true -- if the prosecution has "held back" anything.

Have faith! I think it would have to be something major to cause a postponement. I think the judge will not allow any game playing by the defence team.

I wonder why the defense would want to delay the Prelim Hearing? (If a further delay is what they plan to ask for.)

Their client is sitting in jail during all this time, and some have said that the defense won't apply for bail until the Prelim Hearing is done. (Not that BM will necessarily get bail, but I imagine they will try for it.)
