Yes, it was HER pen. My first random thought on this... there was a divorce on the horizon and she was collecting evidence on protecting her assets OR proof of infidelity (maybe). IMO

Omg. 18 witnesses at the prelim. I thought maybe 3 or 4.
Prosecutor clarified that maybe 3 of 18 will actually be called. Also, the advance witness list was a courtesy and not a requirement.

Judge Murphy doing a great job. Fair and reasonable. Great temperment as well.

Defense won’t get their way with bond changes and releasing him BUT does seem some small victories with the Judge ruling the State committed multiple discovery violations.
He very carefully highlighted what WAS handed over in time, but also what was not, and what was only days late and what was over 5 weeks late.

He stresses the intricate process of discovery especially in such large cases such as this. he hopes going forward will be better. I hope the State will be, because this makes it crystal clear that his defense will be making sure every box is checked like this (as good Defense should but still)

he says “if this does appear to be a pattern, my response may be different going forward”. And “I hope this is a result of the enormous amount of information that needs to be disclosed in a matter of weeks” (not verbatim, sorry)

he is deciding now what the sanctions should be for the violations committed by the State

Maybe he should just plea to 2nd degree and be done with it.

I can't believe his defense made the suggestion to decrease his charge as a bargain over alleged late discovery! However, I took note the defense didn't suggest to dismiss the charges...

Judge seemed to agree that prosecution needs to do better with providing discovery to defense, but he does not believe he even has the authority to grant bail. I am sure that the defense will go back and work on that now.

Yes, it opened my eyes to the fact that there were real problems going on and Suzanne needed 'proof' of something. I truly hope it wasn't physical abuse, but I have concerns of that also.

Things are making more sense now as to why LE was on to Barry from the jump.

(i.e., capital case defendants are not released on bail).

Judge will not allow WebEx for the prelim. A bit of a surprise, but standard in normal situations in Colorado cases.

It is actually a good thing that Judge Murphy sanctions the State here and now. Because it takes the wind out of the sails of the defense and they cannot claim he was biased and unfair. And they can't go to appeal on it later...

I wonder if someone connected to a DV support group suggested to Suzanne that she should use a spy pen to record episodes of abuse.

Judge confirms PRELIMINARY HEARING will NOT be on WebEx or EMC.

The preliminary will be the typical, Colorado trial by Twitter (as we expected).
