Defense won’t get their way with bond changes and releasing him BUT does seem some small victories with the Judge ruling the State committed multiple discovery violations.
He very carefully highlighted what WAS handed over in time, but also what was not, and what was only days late and what was over 5 weeks late.
He stresses the intricate process of discovery especially in such large cases such as this. he hopes going forward will be better. I hope the State will be, because this makes it crystal clear that his defense will be making sure every box is checked like this (as good Defense should but still)
he says “if this does appear to be a pattern, my response may be different going forward”. And “I hope this is a result of the enormous amount of information that needs to be disclosed in a matter of weeks” (not verbatim, sorry)
he is deciding now what the sanctions should be for the violations committed by the State
