What are your thoughts so far about the hearing? Do you think the judge will put BM on trial?

I think BM will be held over for trial however, if those 3 witnesses were the "meat and potatoes", I don't think he'll be convicted. I'm disappointed but not surprised. JMO.

In research related to my last post, I learned that the cap for the tranquilizer dart stays ON the needle of the dart and is expelled with the dart from the gun. Then, when the dart hits its target, the needle penetrates the cap before it penetrates the target.

LE found the cap from the tranquilizer dart in the dryer. Is there any way DNA from the target (presumably, SM) would survive on that cap if it ran through a dryer cycle? What if it remained in the pocket of someone's pants for most of that cycle?

Also what about bringing their own Cellubrite analysis.
Grusing hasn't used Cellubrite so the whole cross is meaningless until it's correlated to the program the FBI IS using.

I'll be looking forward to that at the trial! The F.B.I. brings their receipts!

“I’m done”: Texts between Suzanne and Barry Morphew reveal troubled marriage | FOX21 News Colorado

Aug 10, 2021

Suzanne’s selfie was shown to the courtroom. The Morphew’s two daughters, Mallory and Macy, cried as they looked on.

Grusing also said, during a search of the Morphew family home, he found the cap of a tranquilizer dart in the dryer.

Morphew has said he left Chaffee County for a job in Broomfield during Mother’s Day weekend of 2020. In court on Tuesday, the State said Morphew made several “trash runs” while he was away.

[..]

Morphew apparently made another trash run after he arrived at his hotel in Broomfield. Morphew has confirmed doing so but has said he doesn’t remember what he threw away.

Surveillance video at a Broomfield McDonald’s showed Morphy making a third trash drop just before 9:15 a.m. The video shows him pushing trash down into the can with both hands.

Later, Morphew spent 40 minutes at a dump behind the Men’s Warehouse, also in Broomfield. The FBI said they also captured a video of Morphew making a fifth visit to a dumpster. They said he mentioned he had thrown away tranquilizer material

Can this get any worse? Does anyone think there is more?
I've had a strong suspicion from the get go that he utilized the river in their backyard and also that he mutilated/dismembered her, and who knows what else he did before, during and after all of this.

I don't. I think he was planning to do what he's done for the past years and gaslight, guilt, and threaten Suzanne to convince her to stay married. I think he came home and saw her sending pictures of herself in a bikini to her boyfriend and lost it. It can still be premeditated and Murder 1, I just don't think it was planned. He may have dreamed about it but I don't think there was a date on the calendar.

If it was planned, I would have thought someone with access to numerous construction sites would have had a plan for disposing of whatever he threw away in ** 5 ** garbage cans in public places with surveillance. There's no normal answer for why you visit 5 different garbage cans.

I think after it happened he decided he would pretend to be working that day and go out to the worksite and hotel.

If he booked the hotel earlier, then you have evidence of planning. But I think they would have said that already if it were true.

But what about putting his phone in airplane mode? The truck reset? Why would he put his phone in airplane mode immediately after he got home? That makes no sense, he's home - she knows it, she's with him.

So you think not enough for trial?

Since more evidence will be released at the trial than here at PH and it will be a jury, MOO there no way to peredict that outcome.
Personally, I hope justice prevails.

After learning more details from the prelim. I'd like to hear whether everyone feels Barry planned in advance to kill Suzanne that day?

I don’t think so. Seems to be triggered on Saturday by Suzanne wanting out, him possibly trying to see who she was texting with etc. I’m being careful not to say crime of passion because I realize there’s a legal context to that term. And this is Murder 1 so maybe prosecution has more about a pre-plan.

So what is the defense play here?

Suzanne was home Saturday sending selfies.
Barry came home, she was drunk.
He starting shooting chipmunks around the house.
Hot tub evening with Suzanne.
Suzanne friends older men on FB til midnight.
Barry rides around in the middle of the night.
Goes on to work on a Sunday where he can’t legally work.
Watches Fox News and basketball in a hotel.
Cleans out his car in 6 different trash cans.
While Suzanne rides her bike and gets abducted by a mountain lion who takes her to Ecuador.

Is this the gist of it?

:D

Without a doubt. He moved around way too smoothly, and took measures to cover his tracks. It was as if he was following a script.

The problem he faced though, is you can’t think of everything, and he’s not as smart as he thinks he is:

The trash dumps, the lie about working when he was in his room for 5 hours, the tranquilizer cap, and the avoidable mistake of actually putting himself in the vicinity of the bike location.

The chipmunk story took him a staggering 9 months to come up with, and he’d have been better served by being quiet.

I am very intrigued by one thing though:

Barry’s admission that he was throwing away tranquilizer materials. Something compelling must have forced him to come clean there, especially when he couldn’t remember what else he threw away (other than the boots).

I think it was more than explaining the cap, as he could have said he didn’t know where the wrappers or whatever it was, was disposed of.
All those trash dumps and a visit to a car wash, and the first witness yesterday said:

Back on the record, Commander Andrew Walker is still on the stand. Now speaking about Barry Morphew's truck. His truck was messy both in the cab and in the bed. A search warrant was issued on May 12, 2020.

Grusing also testified that Suzanne Morphew sent the last known photo of her alive to Jeff Libler, the man with whom she was having an affair, at 2:03 p.m. on Saturday, May 9. When investigators talked to Barry Morphew about the photo, he told them his wife appeared to be drunk in the photo.

Grusing said Suzanne was sending sunbathing photos of herself to Libler right when Barry Morphew got home around 2:44 p.m. on May 9. His phone pings appear to show him running around the house, Grusing said, and he told investigators in February of this year he was shooting chipmunks at that time, though his phone went into airplane mode about 3 minutes after his arrival, while Suzanne’s phone was still receiving messages from Libler.

So Suzanne was sending the sunbathing photos from 2:03 to 2:44?
That's what I thought that I read; that she was sending a photo to JL at 2:44 p.m. just as Barry was arriving home and he came around back.

I think that he snuck up on her. Something happened very quickly; and I think that it was planned.

JMO.

I still don't think Suzanne's murder was about BM losing it over JL or bikini photos.
I still think it was about financial control of ALL of their money. And may be related to communications between Suzanne's sister and Suzanne on the Friday, or some other way of him knowing that Suzanne would soon be leaving if she could.

Yes I think he formulated his plan after the May 6 “it’s over” text and his response - we may find some computer searches that helped him:
@Ovideo I see what you're saying about the computer searches but I hope ultimately,
;)BM's computer searches help jury (more than BM) ;) to guilty verdicts on all counts.

What are your thoughts so far about the hearing? Do you think the judge will put BM on trial?

My gut opinion is yes:
-the odds of the electronic system in your vehicle resetting the same night your wife goes missing
-tranquilizer cap
-trash dumps at multiple locations
-being in the vicinity of the bike
-changing out boots or laces that specific day

I don’t know that I am fully on the premeditated side of the fence yet. I think that will depend on search history results or proof of purchases. I most wish there was some way to determine where he planned to take her hiking that day.

My opinion is as someone who has not followed this case closely or read all the previous threads, but chose to listen in on the hearing.

It was clear she was eyeing a divorce, and things were coming to a head. I don’t think her murder was based on his discovery of an affair, but a realization that she was serious this time.

So control, and money.

Hopefully, the defense will have this laid out using bullet points for the jury to follow along in their summation... ;)

MOO Even his jealousy is at core, about someone else getting her resources.

Agree. I think he had thought about murdering her for quite some time, but on May 6 he knew the time had come and went with his best plan. How convenient was that camping trip of the girls?
