Just my opinion but I think there's been plenty of incriminating evidence introduced over the past 3 days. Just what is 'real' evidence supposed to be?

Bear in mind that circumstantial evidence includes physical, digital, GPS, financial, testimony etc. It paints a pretty damning picture and can't be all explained away. BM's copious lies, misdirections and far-fetched excuses have also been exposed.

And I'm sure that there is more to come along that vein.

The defense can try to character assassinate SM all they want, since she is not here to defend herself, but it is BM's character that is on trial and being found wanting.

Well that the problem isn't it? We haven't yet seen any real evidence. There is reasonable doubt dripping from just about everything the prosecution put forth today. I hate it but I'm just calling it like I see it. There's shady stuff that barry did for sure but unless they come up with something BIG tomorrow and I mean something substantial, I fear Barry is going home. There is reasonable doubt that SM quit communicating w/people because she was having a great day/night with barry, having sex, eating a meal and hiking. Remember it doesn't have to completely make sense it just needs to raise doubt and everything that has been brought up has had a reasonable explanation. If this goes to trial, the prosecution will get obliterated with what they have IMO. Again, just calling it like I see it.

We still need some kind of evidence about the tampering/moving of a corpse and his attempts to influence public officials.

I think the police made a BIG mistake not photographing barry's cuts until a few days after SM went missing. I think not securing the hotel until two days later is a problem too. If they recovered anything from the garbage runs NOW would be the time to introduce it!
I wonder if the body cam footage will be of any use regarding the cuts? Since she was missing on a bike ride @OldCop do you think they should have photographed him immediately Sunday night ? He’s not under arrest

Mike King just said that Morgan was supposed to be picked up at 5:30 AM-different than the PM that Lauren tweeted. Either way, it’s pretty clear that Barry chose to leave Morgan in Salida so that he could do whatever he was doing-trash dumping, costume changes, paper reviewing. He also called her and let her know that she needed to find a replacement person to bring to Broomfield-before he knew he would be leaving because his wife was missing. And he didn’t rent the guy a room either-somehow he accurately predicted that he would be leaving to hightail it home.

It's exactly because of the extensive digital tracking and still no sign of a body. I would have a hard time with that, as a juror. We all know that lawyers complain about the "CSI Effect," where jurors expect to "see" everything. In this case they have all of the tracking in the world, yet nothing to show for it. That, in my opinion, is going to be a huge problem.

If BM used a tranquilizer dart, he wouldn't necessarily have had to use any gun to administer it, correct or no?

Exactly! It only takes one juror to discount what the prosecution says is true. The problem right now is there is reasonable doubt on just about everything they have entered as evidence. The prosecution needs all of it to be true, the defense just needs one thing to be untrue.


First degree was a very high bar to set. I am getting worried.

And none of that stuff has led to anything, and it all has plausible explanations. All of the data tracking hasn't led to a sign of her. Since they found nothing in the trash, maybe he was just in the habit of emptying his truck. Or scratches from work, or trees, as he said. The tranq stuff went nowhere - he admitted using it and the sheath of a needle could have been in the lint filter forever. If he had kept his pie hole shut, this would be like Michelle Parker and he'd skate.
Personally I think his pie hole will sink him.

They have to have something in that regard, and we haven’t heard it yet. I think the prosecution will close strong tomorrow.

Just a couple pieces of evidence can change everything.

When Barry left the house on Mother’s Day morning, he went left instead of right. He claimed he was following elk, but he just so happened to pass the spot where the helmet was dumped.

He explained the tranquilizer stuff, by claiming he shot deer in April and sawed their antlers off (as one does apparently). That seems more than a little illegal to me.

The very clothes he was wearing the afternoon of the alleged murder were found in the dryer (he likely washed and dried his clothes along with the syringe cap).

Photographs were taken a Barry a few days after Suzanne’s disappearance, and alleged fingernail scratches were observed on his upper arm.

A bike expert testified that the bike was “ghost ridden,” meaning it was pushed into that ravine and not ridden.

The door on the master bedroom was cracked, potentially indicating forced entry. Suzanne’s journal was missing, and may have been burned in the fireplace.

Barry made a number of incredibly bizarre and incriminating statements to investigators even asking for immunity if he “opened up his life to them.”

He spoke of Suzanne in the past tense multiple times, and (I’m crying laughing as I write this) accused a man named “CBD Tim” of involvement.

He claimed that they ate steak for dinner on Saturday night, and explained the lone plate in the dishwasher by saying that they shared it.

I’m sure I missed a lot, but that’s what I have from memory.

Having just read about a million pages of these threads to catch up (thanks for the tweets, everyone ... only took me, literally, about three hours to read it all), I would say that things to add to your great synopsis are:

  • The brown towel that Suzanne was sunbathing on has never been found ... (one of the most important things imo )

  • There was a bullet casing (staged? unstaged?) laying by Suzanne's side of the bed.

  • Suzanne's spy pen was found concealed in a box of bras.

  • One half-filled coffee cup sitting in kitchen, from who-knows-when.

The hustled off their guest who had actually been in the courtroom. Disappointing.
I tried to listen but grew impatient. I respect MK and CM for their years of experience but they irk me on some things lol. They are not at all cognizant of Colorado laws and Courts. Constantly talking about this case going to a Grand Jury, etc. when Colorado rarely uses a GJ to bring charges. They should realize that Colorado criminal cases are NOT given expanded media coverage and preliminary hearings are never broadcast. They should inform their viewers that BM is not getting special treatment in that regard. Sorry just my 2 cents.

I think it was in the dishwasher---so maybe rinsed by hand---don't know if it went through the cycle already.

Since Barry mentioned Suzanne doing drugs, did LE check out her drug connections or did LE not know this! He also said she drank, did they find empty bottles or a storage of alcohol?

I don’t think BM was saying she was buying or doing CBD. JMO
He said she was abusing drugs and alcohol and her “dealer” was a dude called CBD Tim. I’m just guessing that he meant pills, opioids probably.
PURELY my SPECULATION.
And there is always someone else with a name...too typical "CBD Tim" -- not likely.

i missed a few pages so not sure the entire context but ... did BM try to allude to a .. drug dealer..who sells CBD?
And it's legal, go figure.
