Perhaps the murder was set up in a way where fate would at least partially come into play. He created a situation where she might live, she might not. She died, so now BM justifies his actions by saying, ‘I didn’t kill her; God took her life.’

I don't think I would try that idea on the judge or jury. I doubt even Murder 2 supports it and he is charged with 1st degree murder. Injuring her brings him no benefits. Killing her does.

Possible, but that would be second degree murder. Which defense has alluded to back in July.

2. What is second-degree murder?
Second-degree murder under 18-3-103 C.R.S. is knowingly causing another’s death. The defendant may not have planned for the victim to die. But the defendant knew that death would likely result.

Defense Attorney Iris Eytan is asking for two sanctions: 1. BOND for Barry Morphew 2. Amend/Reducing first-degree murder charge to second-degree murder charge. She says the evidence that they've seen doesn't support first-degree murder charge.

Agree, nobody at this point knows when it happened. Perhaps, she told someone about it in the days prior to her missing. It could have happened days earlier. The only reason why I think it may have happened on May 9th is that the damaged doorframe is to the room that has a spent shell casing in it. I doubt Suzanne would have had that on the floor rolling around by her bed. It would have been picked up. I understand that the two could be unrelated, but difficult to separate because she is missing and presumed dead.

I think it is probable that detectives asked both Mallory and Macy if there were fights. They said no. Then they were asked about damages in the home (I.e. door frame) and they said no again. This would mean it happened while they were gone on their camping trip.

Good morning! I'm at Day 4 of the Barry Morphew preliminary hearing in Salida. It's expected to start after 9 a.m. I'll be Tweeting updates as we go along.
This is the last day of the hearing. We left off yesterday as the defense was cross-examining FBI Agent John Grusing. Here's my story from what happened on Day 3:

I have no doubt he killed her, but how? And maybe it doesn’t matter. I’ve heard everything from choking, to shooting, to smothering, to woodchipping. It could have been an overdose administered through a tranquilizer with the thoughts that she might die, she might not.

I think they were still holding out hope they would find SM for an even stronger case perhaps
But when it looked like he might flee, they moved in quickly to get him
