thank you for taking the time to explain this - I am recalling the Judge telling the defense they took too much time day 1 and 2 - or something to that effect. It feels like today's testimony is just rehashing everything that already has been testified to but if that is what the defense is allowed so be it. and thank you for being here for Suzanne @Alethea

I have a bit of a problem with the Judge, really. It's his Court. He can bang the gavel and demand everyone stop talking. He can have a clerk use a timer to time the exact amount of time and give a one-minute warning. He can tell the defense, in the moment, they have one question left and time is up.

I think it's a little rich for him to complain about it after the fact when he's the only person who can stop it when it's happening!

And lawyers are used to timed examinations. In depositions you negotiate the exact amount of time you get and the Court can even order the schedule. So it is not crazy to have to stick to your 15 minutes or 30 minutes, etc.

Was there any evidence that #BarryMorphew tracked Suzanne? Agent Grusing said, "Yes." When he was asked about the affair, Barry said "this is a surprise to me." He had never seen it on her phone... "How was he communicating?"

I have never been so disappointed in a judge before Judge Murphy.
1) He has been unfair in allowing the defense to take up time that should have been allotted to prosecution in this hearing.
2) The unreasonable sealing of AA.
MOO !

and also, did he really sign off a 126 page AA - or was this another judge. If it was another judge, then I suspect that Judge Murphy was handed a poisoned chalice.

Guys I hate to say this but when I put my lawyer hat on I am just not seeing the kind of evidence I thought they would have. My only hope is that they are intentionally withholding evidence and only trying to get over the bare minimum PH threshold. Because it’s not great right now. The defense can poke holes in a lot of things I have seen thus far.

I see it as a puzzle with all of the pieces, along with Barry's lying. If he were not involved, he wouldn't have the need to lie about so many things.

The prosecution will have to carefully lay out each bit of evidence--along with Barry's ridiculous explanations and lies--to lead to the logical conclusion.

Some cases just do not have a smoking gun, so to speak.

Grusing testifies that Barry Morphew had monitored his wife's phone. This was in response to the defense question earlier about Suzanne monitoring Barry's phone.

I think maybe on the first day when they ran through the affair texts, the actual AA may contain copies of the texts. Those could be difficult for the girls to see.

But after hearing three days of this, I seriously see no reason why they needed a 126 page AA that's so sensitive it needs to be sealed.

They really just needed to say:

- History of DV according to SM's friends
- 2:49 Suzanne's last text was to affair partner
- 2:47 Barry's truck gets home
- 2:49 Barry's phone goes to Airplane mode
- no further communication from SM
- XXpm Barry's truck leaves, GPS wiped, unaccounted for X hours
-10xx pm Barry back home
- No contact from SM on Mother's day
- 911 call

LE finds BM with (allegedly) defensive wounds. One dish in dishwasher. Morning coffee still out. Tranq dart in drier. BM claims he was shooting chipmunks. Master bedroom door broken in.

BM tracked near evidence disposal site (bike, helmet). BM caught on surveillance dumping garbage in 5 difference places with no explanation. Hotel room smells like cleaning supplies. No alibi.

...right? Could be 5 pages with LE/FBI testifying to the results of the investigation.

You are right @Alethea . Great reasoning, excellent explanation. For now, I will continue to have a bee in my bonnet re Judge Murphy.

I agree with you @oviedo ! Especially since it seems like BM already told his daughters about the affair. Per Lauren's Tweet
"#BarryMorphew told his daughters about #SuzanneMorphews affair. He allegedly told the girls that Suzanne was a good mother. Told them that her sin was no worse than any sins we do every day. One of the daughters wiped both of her eyes as she cried when this was said."
