I almost feel like the prosecution was just going through the detective handbook's "means, motive, opportunity" playbook. They definitely covered all three but as the prosecutor, you have to prove that the defendant actually did it. Not just that he could have.
But during the preliminary, the burden is lower than beyond a reasonable doubt. I believe they proved probable cause to bind over.

I’m very confused. I hope the prosecution isn’t done. Is this all it takes to bind someone over for murder one and lock them up without bail are lies and assumptions? I believe he is guilty but I don’t see the prosecution having a good case.

Body cam video is played where we hear Himshoot say the dart gun did not appear to work. "You know the thing that’s really weird about the cover is the gun has not been fired. It doesn’t function appropriately. It doesn’t engage.”

Agree! But Prosecution is finished presenting evidence in the Prelim it appears! I know BM should be bound over for Mueder1, held without Bail, but I’ve been following g this case as close as one can, like white on rice. Average juror won’t have followed this at all! This prelim was disappointing imho, as far as evidence! Moo
I’m hoping someone here can explain. Otherwise, if locking someone up is a done deal, why even have a preliminary hearing?

While I'm still nervous, I think the judge will bind BM over to trial. At least BM can't claim that he had an inadequate counsel. They appear to be attacking SM's character and law enforcement's integrity rather aggressively.

Hmm, I wonder if it is his DNA on it. Would we reasonably expect a cap to have gone through a wash and dry to have the original DNA on it?

As an attorney, do you think enough evidence was shown to bind him over? As a layperson, I don't think they did, but IANAL.

Remember how the judge complained about the length of the AA and said a lot of it was not evidentiary. Justice for Suzanne is in jeopardy here. This judge just ain't buying it.

No. They have massive cell phone data, GPS records, and surveillance video. And much more. 129 pages worth.
Really? Because we didn’t hear about it. It has been suggested but I would have liked to have seen probable cause. I’m bothered that a person rights can be taken because he lies, he is mean and he is stupid and greedy. All of that. But I wanted to see evidence of murder.

After hoping for more revealing evidence to be presented today and a full day hearing from the prosecution,I feel extremely deflated.

I forgot BM was arrested and charged on M1.

Can the Judge after the PH change M1 to a lesser charge? I might get a legal book thrown at me for this question, but I'm honestly clueless. IMO

If I recall correctly, there were two unknown DNAs taken from the cap. Barry's DNA was not on the cap.

Me too, but I'm in the UK, and things are different here. I'm struggling with this, I honestly am.

IMO only, I believe the daughters will only benefit BM's defense.
I don't know. Could go either way. I think they both have good people in their lives (friends, boyfriend's family).
While I'm sure they wanted to believe their mother escaped from an abusive marriage, it's surely sunk in by now that she's dead. Hopefully their faith will move them to tell the truth.
They told the agent of their (one of them for sure) wishes for their mother to leave and get a restraining order and that certainly wouldn't be due to an accidental 'clipped' nose.
