Why are they going over this DNA stuff again? We heard about it the first day.
Cause they don't have much so they're gonna hammer on what little they do have. MOO.

Ed. for grammar. More coffee plz.

it's their turn - they can present the SODDI (some other dude did it)- @Alethea gave a good explanation up thread when I asked the same thing.. it's annoying me to no end though.

Agent Cahill says the report shows that DNA from the glovebox came back to matches of investigative leads that show the partial profile came back to unsolved sexual assault cases. #SuzanneMorphew #BarryMorphew @KKTV11News

Ashley Franco @AshleyKKTV 7m
Defense says there was also unknown male DNA on the bike grips of #SuzanneMorphew bike. They say #BarryMorphew was excluded. Same goes for apparent unknown male DNA on the rear cushion in Suzanne's car. @KKTV11News

I find it a little bit odd that none of Barry's DNA was found in her car and glove box. Surely he has spent time in Suzanne's car, being her husband. And I would also think his DNA would be all over her bike, too, if for no other reason than helping her attach it to the back of her truck, when she wants to drive to a trail to ride. Surely he helped her lift her bike on occasion, since he was such a "devoted husband," and she was coming off her second bout of cancer. Or?

Defense is asking Cahill whether he would accept results from lab reports that show unknown male DNA in Suzanne's vehicle and on the bike grips? They're phrasing it that way because Cahill doesn't recall for himself.

Cahill says he would accept the lab reports. Those reports also say Barry Morphew's DNA was not found in those samples, according to defense questions.
Lets look further....did Scott, the bike guy get tested for fingerprints? Considering he had this bike just a few days earlier...no reason to think his prints would not be on the bike. So is he an "unknown" because he wasn't printed?

Sadly for Suzanne this is one of the weakest prelims I’ve ever seen. I hope prosecution have more that can’t be disputed or this guy will walk.

Yes, yes, yes. There is a funny absence of any of Barry's DNA on everyday ordinary things that should have it IMO.

The matches are from Pheonix, Chicago, and Tempe, Arizona. Tempe case was looked into in Dec. 2020. Cahill contacted the investigator in charge of the attempted sexual assault outside a local convenience store. However, the Tempe case had two suspects.

The judge is lost... many in the courtroom are also confused so he is trying to get clarification. "It is my understanding that the partial did not match the two primary suspects from the Tempe case according to another detective," Agent Cahill said.

If Barry kept his .22 locked and loaded, he would've had to expell the chambered bullet. Pick it up, pocket it. Force of habit. Same for the syringe cap.

That the bullet wound up in the bedroom makes a strong case for a scuffle.... or as I said upthread, he removed his shorts. To make a point. ...

The cap didn't fall out and only wiggled free of the pocket IMO during the drying....

Yes it seems to indicate some type of a struggle but no blood found so he didn’t shoot Suzanne. In the house anyway. Maybe he forced her somewhere else at gunpoint? Is there a chance he did not shoot her with a tranquilizer dart? Or maybe he missed and she ran? Would Barry miss with his hunting skills though? This is driving me nuts!

Plus the judge has done everything possible to protect Barry’s daughters. I think he will lower to M2 in order for BM to be with his daughters. I’m sure they have written letters to the court pleading for leniency to give their Father bond. JMO
If I were the judge, I would be inclined to keep Barry in custody for fear that his hunting would now include JL. Let's say that Barry gets out and JL disappears on one of his business trips. I guess that the defense would then say that he ran off to be with Suzanne...

We don't know the identity of the judge who signed off on the AA. Based on his statements in sealing it, I highly doubt it was this judge.
MOO
Thank You!

He
One more time:
It. Was. Judge. Patrick. W. Murphy who ruled on the AA !!!

District Court Judge Patrick W. Murphy ruled on Friday to keep Barry Morphew’s 130 page arrest affidavit sealed until at least September.
Judge Rules To Keep Barry Morphew's 130 Page Arrest Affidavit Sealed Until At Least September
I am talking about the judge who read the arrest warrant and agreed with the DA & LE that it was enough to warrant an arrest. Murphy's criticism is the AA is odd if he signed it then turned around and said it was basically not convincing (my interpretation only).

You are correct that Murphy sealed it. I really don't think he would have signed off on the arrest based on it. But, we shall see at some point today.

I desperately want justice for Suzanne. I hope I am wrong.

He always drove, he never sat as a passenger in her car. When they went somewhere, they took his truck.

Suzanne did however drive the girls places, and the DNA in the back seat probably matches MM2's BF (IMO, just a guess - but the stepfather of that boy implied that the boy spent quite a bit of time with the Morphews).

Glove compartment DNA was probably from a car wash or dealer service/detailing.

I believe the bike repair guy would not have been required to provide DNA and probably not fingerprints, either.

It isn't just that he lied, it's what he lied about. What he stated he did doesn't match with his cell data and his truck gps on the day he took a last minute work trip. That is what does it. He could have lied about what time he went to bed, what he had for dinner, what he did at the job site, having an affair, etc.. that makes him just a liar. Lying about what he did the day his wife went missing, the state of their marriage, deleting texts, etc. That is why he's in this mess. A person can be a liar and not be suspected of murder. I person can't lie about facts related to a missing person and not be suspected. Innocent people don't need to lie about these things and most people even liars understand the need to be honest with police so they aren't in trouble. It's totally different lying to people than it is lying to police. That shows a sign you are hiding things. If he was honest from the first police interview (and he was innocent) then we wouldn't be here today.
I agree. But there wasn't a lot brought up about cell phone data or gps. That is my issue.

If he gets bond, he is going to run or Fotis Dulos himself. Jmo, but I called it with FD too. My only caveat to that is if Barry sees the prelim as a complete failure on the prosecution's side, like I do. We shall see. I am so sick to my stomach that I don't even want to go back to copying the tweets. Jmo
If his family still supports him it is possible his arrogance will carry him through but then I also thought Fotis Dulos was an arrogant man and look what he did. so there's that.

your copying of the tweets is very helpful but I do understand your feelings - I really thought we would hear from a couple of key players including her friend and sister - but I guess the prosecution didn't need to have that testified to yet. disappointing IMO.

I think they've shown probable cause but not probable cause of Murder 1. JMO.
Since they obviously believe the tranquilizer dart was used in the commission of the crime, wouldn't preparing the dart be deemed as premeditation? And wouldn't incapacitating / sedating a person before murdering them be deemed as a plan and a period of premeditation?

  • #518
I'm wondering if there is info -- text messages with the sister or conversations with neighbors and friends -- that might help the prosecution but that they can't get into evidence (even at a prelim) because of hearsay rules. JMO.

  • #519
Yes, it could have been auto mechanic, car washer, or tire changer.

The defense is desperate, it ain't going to work IMO.

I think it's damning. Imagine if Scott Peterson had creeper DNA on Laci's car, instead of a vague story about dudes in the park.

and the poor excuse for a man not only walks, but he walks with HER daughters and what's left of HER inheritance from HER mother's death.
