Yes, it could have been auto mechanic, car washer, or tire changer.

The defense is desperate, it ain't going to work IMO.
To me, this is a big "So what?". I agree that it could be anyone's DNA. We do know one thing...the unknown person wasn't a thief. He left Suzanne's purse with her ID and her money in her vehicle. I guess that he was just interested in her vehicle manual or registration...

One question I have...is the judge bound to a decision based solely on the evidence presented at the PH...or does the judge have the discretion to consider the AA as a whole in deciding probable cause?

He has the discretion to view the evidence as a whole. Remember those 4Tb of evidence? They were all submitted to the Court. Indeed, in my view, he is required to look at the evidence as a whole.

What I'm wondering is if the Judge is still advising counsel (both sides) to stay away from certain things mentioned in the AA, which will also be redacted before next week.

Whatever is happening, it's very frustrating. Still, if it were up to me, Barry's lies and lack of alibi (and the constant fighting about money per the spy pen) would be enough to hold him over for trial. And the breaking of the door frame, the dart cap and the admission by Barry that he was on the property with a .22 that afternoon would be enough for me, for the probable cause bar. But I'm not sure this Judge would agree (and I'm certainly not a judge!)

Well, the GPS data the prosecution has produced will be confusing to a jury, then you add this scrambled up partial DNA match the defense is presenting…ugh.

If he did, there should be some DNA, but there isn't. And I don't see how it would matter anyway - we'd expect it to be there. There's no reason to suppose that Suzanne or anyone else somehow managed to remove DNA from the RR.

How do we know that they took the RR to Moonlight Pizza?

I've no doubt BM wore gloves, and probably wiped down her vehicle after her disappearance.

When did LE pick up Suzanne's Range Rover? Was it already sold and in Indiana by then?

Maybe the glove compartment DNA is CBD Tim’s?! :D Sorry couldn’t resist. This glove box DNA argument is so confusing and irrelevant. It was not a match but IE says there is no scientific proof that it isn’t a match? Isn’t a scientific method used to match DNA? Maybe I’m missing something.

Does the defense want us to believe some sexual predator abducted Suzanne in her Range Rover, tossed the bike, raped & killed Suzanne and then returned the RR to her house?! Where there could be a security camera? And wiped all prints & DNA from everywhere except the glove box? That’s just ridiculous. If anything I would think it could indicate Barry hired a hit man so why are they pressing this issue? o_O MOO
Don't forget these crazies didn't steal her purse with credit cards and cash either after all of that.

CBI was notified that there was another DNA profile match to an unsolved sexual assault case in Pheonix Arizona from the DNA found on #SuzanneMorphew glovebox. In April 2021 Defense says there was another match from an unsolved sex assault case, this time in Chicago @KKTV11News
Does anyone know if Suzannes Range Rover was used or new when they bought it? If it was a used car, well then...

True that! Barry could have killed her easily with his bare hands. So why was the darn .22 shell on the floor in the bedroom and on Suzanne’s side of the bed? I’m wondering now if she ran to the bedroom, locked herself in and was going for a gun when Barry busted the door open. Maybe the gun wasn’t loaded and she was trying to load a cartridge and dropped one and Barry didn’t see it. Maybe it rolled under the bed? I need to get my mind of this. I just think it’s kind of a big deal or clue that this .22 shell was found where it was.

Wouldn't they have an expert come in to testify about that stuff? Someone from the cell company or someone not LE that could explain more of this? I thought the PH was only LE?

Maybe they will be to sustain Murder 1 at this hearing. Colorado Prelim standard:

It is unnecessary at a preliminary hearing for the prosecution to show beyond a reasonable doubt that the defendant committed the crime, or even the probability of the defendant's conviction. Instead, the trial court is obligated at the preliminary hearing to view the evidence in the light most favorable to the prosecution and the prosecution therefore is accorded latitude at the preliminary hearing to establish probable cause that the defendant committed the crime charged. What are the odds of DNA connecting BM to other crimes and that is what they are trying so hard not to say at the PH?

It would never be presented to a jury in the way that it was presented here. Keep in mind the Judge already has looked over all the evidence. He doesn't need the same walk-through that the jury will need. There will be experts, organizations, maps and visual aids to help the jury.

The whole reasoning is something only a lawyer could come up with- That there is no evidence its not a match. We are all partial matches to every criminal in the system at some level- every locus in the genome they interrogate has a frequency in the population, some are more variable than others. You can only get a match when its astronomically unlikely to be anybody else because you match all of the alleles that were interrogated. Just because you match one or two alleles to a random person does not mean that its more likely to be that person vs any of the other people who matched those alleles, including people who are not in the database.
