“No disrespect to any of the other individuals who are statutory victims in this case, but the two what I would consider most significant victims of this matter are strongly supportive of Mr. Morphew’s innocence and are strongly supportive of his release, and I do take that very seriously,” said Hopkins, in an Alamosa courthouse, where Morphew’s daughters were present. “Your opinion matters a great deal to me.”

Hopkins noted that Morphew has no “real criminal history.” And that even posting 10 percent of a $3 million bond through a surety would be a powerful incentive to show up for his future court dates.

Morphew’s lawyers say this fight is far from over, especially with four terabytes of discovery still to comb through and a possible trial nearly a year away.

“We believe that the facts are going to be flushed out when given the opportunity for that to be a two-sided narrative and not a one-sided narrative,” said the defense.

The defense is pushing for another hearing this fall, likely in the next 60 days, hoping to revisit bond. If Morphew posts his $3 million bond, he would have to be fitted with a GPS tracker.

Barry Morphew, in jail on murder charges in the death of his wife, is in the process of posting bond, his attorney confirmed.

But he remains in an Alamosa County jail as he waits to be fitted for a GPS ankle monitor and to finalize details with a local bondsman.

His attorney, David Beller, confirmed late Thursday night that “funds for the bond were paid by friends and supporters,” and added that there are no guarantees that Morphew would be released from jail by the weekend.

As of Wednesday afternoon, Lt. William Squires of the Alamosa Detention Center confirmed with the Citizen that Morphew was in the process of signing paperwork and being fit with a GPS ankle monitor.

As part of the stipulations of a pre-trial release, Hopkins told Morphew that he is to be monitored at all times with an ankle monitor and isn’t allowed to leave Colorado.

David Beller, one of Morphew’s attorneys, told the court, “The evidence of Mr. Morphew’s innocence is substantial.”
