The Supreme Court’s majority agreed the disciplinary panel improperly held Stanley accountable for ensuring her subordinate prosecutors lived up to their own professional obligations in the Morphew case. The Colorado Supreme Court, by 4-2, upheld the rare disbarment of an elected district attorney on Monday.


“True, Stanley could have, and perhaps should have, done more to guide the team once she became aware of the magnitude of certain problems,” Hood wrote. “But the highly qualified team she put in place also had an obligation to organize themselves effectively and should have been able to navigate the day-to-day challenges presented even by this complex case.”

The majority otherwise upheld the panel’s decision. It also determined Large need not have recused himself as the presiding disciplinary judge because, in his prior role as an attorney regulator, he prosecuted Stanley for her misconduct as a private-practice attorney.

Hood wrote the situation was a “close call,” but that Stanley’s prior case was not “factually connected” to the current one. Moreover, Large abstained from the portion of the decision where Stanley’s prior discipline was taken into account for sanctioning purposes.

Samour, in dissent, believed Large’s partial recusal was not enough, nor was it even authorized. He stressed that he did not think Large was actually biased against Stanley, nor did Large have an obligation to recuse every time he hears a case involving a lawyer he previously prosecuted in his regulation career.

“We live in a cynical world in which parts of the public are skeptical of judges, which means that the perception of impartiality and fairness is more important than ever — certainly, as important as impartiality and fairness themselves,” Samour wrote. But before Stanley’s “livelihood as an attorney in this state is permanently taken away, she’s entitled to a proceeding conducted in front of a tribunal whose impartiality and fairness cannot reasonably be doubted or even questioned.”

Samour would have ordered a new hearing for Stanley.

Justice Brian D. Boatright did not participate in the decision. As is the Supreme Court’s practice, he did not explain his reason for recusing.

Suzanne’s body was then found in 2023 in Alamosa County, about an hour south of the Morphews’ home. An autopsy in 2024 found the presence of a unique mixture of animal tranquilizer chemicals that Barry Morphew was known to possess, according to the new charges filed in the case. A grand jury indicted Morphew on murder charges this year, and he was arrested in Arizona, living under the alias Lee Moore.

In an email to PEOPLE, the CBI confirmed that an investigation into Quintana’s death is ongoing. The organization said that when the search for Quintana began in 2023, it led to the discovery of the remains of two other people.

The remains of 26-year-old James Montoya were found in Saguache County that July, and authorities later learned that Montoya was murdered in the Denver area, per the CBI.

Then, in September 2023, CBI agents discovered the remains of 49-year-old Suzanne Morphew near the town of Moffat. Her husband, Barry Morphew, was indicted this year on June 18 on a first-degree murder charge, according to the organization.

(ALAMOSA COUNTY, Colo.) — During Barry Morphew’s hearing, the defense requested another status hearing to be scheduled in mid-January to give time for the defense team to finish going through the evidence provided by the prosecution.

The judge set another status hearing for January 12 at 1:30 p.m. and noted that a plea is expected to be submitted by that time.

The general public is allowed to attend in person but not virtually.

The Colorado Courts released a press release Oct. 28 outlining the new orders issued by 12th Judicial District Chief Judge Amanda Hopkins, who is overseeing the case, regarding details on how proceedings will be handled.

Only credentialed media will be allowed to view the court hearing over livestream platform WebEx. Media are also allowed to attend in person, but only five seats are reserved for media and are available on a first-come, first-served basis.

Members of the media who wish to attend must have been credentialed by 4 p.m. Oct. 31 and must sign into WebEx at least 30 minutes prior to the start of the hearing, and each person from the media joining on WebEx must sign in using their full name and media outlet they represent. No media is permitted to join via telephone number, and only one media member per outlet is allowed.

Former Chaffee County resident, Barry Morphew, charged with the 2020 murder of his wife Suzanne Morphew, will appear for a status conference at 1:30 p.m. on Monday, November 3 before District judge Amanda Hopkins. The hearing will be held in the 12th Judicial District Courthouse in Alamosa. Ark Valley Voice will be part of pool coverage of the status hearing.

Morphew, who was able to post a three-million-dollar bond, has been out on bond wearing an ankle bracelet.

In a three-minute status conference for Barry Morphew Nov. 3 in Alamosa, 12th Judicial District Chief Judge Amanda Hopkins, at the suggestion of Morphew’s legal team, set another and final status conference for 1:30 p.m. Jan. 12.

Morphew’s lawyer David Beller provided a brief update to Hopkins about his team “continuing to make our way through the enormous discovery,” adding that they met with the prosecution earlier to go over some items.

“That process (of discovery) is ongoing and unfortunately time consuming,” he said.


Hopkins said she will expect a plea entrance from Morphew at that time and request that he “stay in good contact.”
