Could JB turn in his license?

  • #21
JB can sever all ties with her 30 days after a final judgement is handed down. He is free from the case and the client at that point outside of his ongoing obligation to maintain his clients privilege. (and not directly act against her interests.)
Thank you for this...this is what I was looking for.

When Casey was spending 8+ hours daily at JB's office, I don't think they were "working" on her case all that time. I suspect that there was some other "work" being done away from the prying eyes of Jose's staff. I'm sure you get my drift ;) Remember how Casey was dressed when she'd leave her house each morning? Need I say more?

Anyhoo, if there was a "relationship" going on behind closed doors, it was most likely consensual, but Casey will turn the tables on JB and accuse him of "inappropriate conduct". jmo
You took the words right out of my mouth.

Their lawyer, Lippmann, said on tv this week that he is prevented by law from making disparaging remarks about another lawyer but AFTER Mr Baez IS NO LONGER a lawyer he will make his feelings known. It was a jarring statement to say the least.
Based on this statement, I feel the Anthonys know things about Baez that aren't ethical. It has nothing to do with the molestation accusations.
Just my take on what he said.

I heard Lippmann make this statement. I have been taping all of the court proceedings and replay when I'm home puttering around the house. It surprised me so I went to the tv to see what the commentator would respond and he never picked up on it. I found that odd. It was as if the commentator was told NOT to question Lippman about the statement.

Wish I could be more help. But, I did hear the statement and it was on InSession.

Sincerely,

I believe his obligation ends as soon as the sentence phase concludes.
As for his ability to practice law in Florida ... I stongly believe the Anthony's lawyer will be filing charges with the Florida Bar when the case is over. That, plus the fact that his client will definitly charge him with inapropriate conduct after her conviction means his licence will be taken away LONG before he ever has an opportunity to let it lapse.

I agree with your post.

I believe Lippman will be filing Bar complaints on behalf of the A family

I also believe Casey will fill a Bar complaint and accuse Baez of something...be it inappropriate conduct, ineffective counsel..etc

I think that many will be filing complaints against JB with the Florida Bar, after this trial is over.
Those that will be filing may include, lawyers and others he used and abused.
I think his license will be quickly taken from him. IMO

What is said in opening statements is not evidence. It's just states what the prosecution or defense will try to prove. I have seen cases where they never present anything they say in opening statements. I don't think JB will lose his license over this unless Casey says he made the whole molestation and pool drowning up. IMO he is to cocky to just turn in his license, but I don't think he's going to be getting a whole lot of death penalty cases in the future.

There is so much already against JB that the Florida Bar has to mull over, I don't think his opening statements, as reprehensible as they are can or will be included.

Think about it, he has lied to the judge, misrepresented facts, refused to pay for services rendered, taken money that hasn't been accounted for, allowed his client to fall into debt with the IRS to the tune of 70,000 without advising her or setting aside monies earned from the sale of pictures. I could go on..

For what it is worth, legalmania, I'm with you on this post 100 percent.

How sad is it that- we here saw the proverbial handwriting on the wall years ago. Baez should not be running this show. He is just not skilled enough. BTW, I wonder what happened with the last bar complaint.

I can see ICA stalking Baez if by some miracle she is acquitted.. she probably has plans to be Casey Marie Baez... lol .. now wouldn't that be poetic justice...

I don't know if this has been covered before but here goes...

It seems obvious that ICA will turn on JB when the trial is over. Based on various reading, I'm not clear if he can sever ties with her if she gets LWOP. If JB is no longer a practicing attorney, could he be forced to deal with her?

I understand he could be held responsible for any accusations she makes against him but, other than that, is discontinuing his practice a method he could use to cut her loose?

Could he move to another state and, if he can qualify, practice law without getting pulled back into ICA's world?
Not an attorney, but... he would only lose his license if he is disbarred by the state, a lengthy process. I don't think Casey will win on Ineffective Counsel arguement since Cheney Mason and Ann Finnell and Andrea Lyons and others have consulted on the case. He can move to another state and take their bar exams if he wishes- nothing stopping him from doing that. In any case, he would not be Casey's lawyer for Death Penalty appeals- they have Appelate lawyers who specialize in doing that, so once the case is over, Baez is totally free to sever ties to Casey.

Hi-
Just a bit of FYI- Regardless, the trial attorney never takes on the appeals. No one on her team will be apart of that. Usually, and in the case of CA where I'm from, there are only a handful (I think 250) attorneys that are DP Appellate qualified. That means that she will have to get in line and wait for an appellate attorney to be assigned to her. I do not know the number of attorney's in FL. The transcripts and trial record will be used to dissect for any discrepancies they can capitalize on.
All these objections and pre-trial hearings were for this purpose.
In any case, JB, CM, and all the rest will never see ICA after this is over. Maybe a visit, or two- before she is transferred, but they will then move on to the next case.
They've done all they can do..........this was, quite frankly, a long shot and everyone in that room knew it going in.

ADDED: She of course can PAY for an appellate attorney and speed up the process- like SP did but it will cost her family a fortune (or donations).... But still, she needs to find a qualified AVAILABLE attorney which is next to impossible. It will be several years before it even gets started.

I can name several high profile lawyers who no longer practice law, only show up to comment (on tv, of course) on highly publicized cases, i.e., Geraldo Rivera. They find their niche out of the courtroom.
F.Y.I., Geraldo also has a law degree...

Legally JB is fine as far as KC's trial is concerned.

I am wondering about taxes on the ABC photos ($200,000 with KC owing $68,000 in back taxes now), but will not lose his license for that either.

ETA: After reading more here, does anyone want to see JB on t.v. after the trial anyway? I don't think he will be the next Judge Judy. Judge anyone, not even the Anna Nicole Smith Judge that I would never call a Judge and hope he never got the contract that was touted. Geraldo was gone in the '70's or '80's, I cannot remember but the show did not last very long. I don't think anyone will watch a Jose Baez show no matter how bad he may want it. Maybe he should have thought about being more credible and respectable for that idea. ;)

So does LP shockingly enough. I heard him tell Mark Geragos on LVM last week and nearly passed out. :)

You got it - Baez's obligation ends once the inmate is sentenced. He has no obligation to even get involved in any sort of appeal (ie, Geragos ran as far as he could from Peterson - not even showing up for sentencing).

However, IMHO, I do believe once the inmate is sentenced, the A's will go after Baez, like they've gone after practically everyone else in this case (from Padilla to Brad to Mark to Tim). I wonder if he hears that train a comin. That's not to even mention the complaints that will be filed with the Bar.

Should be interesting....

I've always thought he had her at the office so he could clock up billable hours with her to justify his $200,000 fee, and to prevent her from confessing to her parents, which could jeopardize her going to trial and him becoming famous.

Isn't LP the bounty hunter with the cowboy hat ? The one who said the defendant "uses 8 sylable words like 'resorces' " ?
He has a law degree ????
He has any degree ????
Wow

Personally, I hope he doesn't get the satisfaction of turning in his license...I want the State Bar to revoke it , for life.

And if that happens yes and Karma is a beehach. Even when she is convicted, Casey Anthony will be with him the rest of his life. He thought this high profile case was his golden goose. It will be a demon on his shoulder for the rest of his days.
