Oh man..does this mean he has to pay back-pay as well for the past 18 years?

I agree he should have ensured that there was a written agreement ... but interesting that she waited until AFTER the whole issue of custody and visitation was done. Makes her out to be a money grubbin' sperm stealin' ho. :twocents:

No, because she waited until he was 18 YEARS OLD before filing. They had an understanding and she violated it after there would be no risk of visitation or custody problems ... just hand over the cash :croc:

Before the mother, her partner, and the child moved to Oregon in 1993, the man had contact with the child, according to court documents. He also sent the child money, gifts, and cards and letters signed "Dad" or "Daddy," and spoke to him by phone about seven times in the past 15 years.

But we don't know that she waited until he was 18 to file. She could have filed when he was 15 after receiving regular payments directly from him and not through the courts. What was the money he sent the child highlighted above? Something happens when child is 15 he stops paying, so she then files. He could have tied this up in the courts for 3 years with dna issue, we just don't know.

Few, if any cases exist that I know of filed in a childs teenage years have ordered a parent to pay retroactive to date of birth. I filed when my son was 2 weeks old and did NOT get retroactive to dob and it took close to 3 years for a permanent support order. This stuff isn't in and out like traffic court. ;)

Some states are now extending child support orders to include college if the child remains in school. Depends on the state......

My neighbors have a deal like this except the child isn't 18 yet so who knows how it'll all work out in the end.

The two women found a male friend willing to sleep with the one woman so the one woman could get pregnant, so the two women could raise a family together. Their daughter is now 4. Mimi has a new girl friend who has 2 kids so now the daughter has 2 new sisters and Mimi and the new girlfriend are looking for a man to get the new girlfriend pregnant so they can start a family together too. The mommy, the one who got pregnant and carried the baby, she's still on welfare. The little girl, she sees her daddy about once a year, but got to see him here recently because he just got married and had a baby and his wife wanted to meet his first child.

There is such a thing as a sperm bank....
He obviously did take some active part of this child's life yet he did not help support the kid.
If out of the "kindness of his heart" he was involved then why should he not have to pay child support??

It seems like the laws are so far behind what a lot of folks are actually doing as far as fertility, etc. With the sperm/egg donations, surrogates, and even some new forms of adoption, it seems a lot of folks are ending up in a bind and the law doesn't really cover it all. Did that make sense? Migraine meds are making me stupid (but I don't hurt, so it's all worth it!)

I want to hear the whole story on this one, I just keep thinking there's something we don't know about it.

Me too! I'd love to see the pleadings on this. Why on earth did she wait until her son was 18 years old to pursue child support? And quite frankly, it's the norm for child support to END rather than begin at 18 years old. Last I checked a college education was not a requirement, but optional.

Just so you know, child support, at least in NY, is mandatory until 21 yrs old unless the child gets married, joins the military or is self supporting.
